She plans to move the school to the church and continue to operate in the same fashion as the Rustic Road site. The Minnesota Valley C®s:ity Church was recently constructed at the end of Timber Trail a single family residential area. There are 15 single family lots platted with access to Timber Trail half of which are developed. The school will operate Monday - Thursday for 2 hours from 9:00 A.M. to 11:15 A.M. and 2 hours in the afternoon on Tuesday and Thursday from 12:30 P.M. to 2:45 P.M. The church site is at the end of a cul—C sac significantly reducing the contact the school will have with the residential neighborhood. Present were Mayor Andren, Councilmembers Fitzgerald, Scott, White, City Manager McGuire, City Engineer Anderson, Assistant City Engineer Loney, Intern Garross, and City Attorney Kassel. City Planner Grazer arrived at 8:44 p.m. Councilmanber Busse was absent. Mayor Andren called the meeting to order and asked everyone to rise for the pledge of allegiance. The minutes of the September 2, 1956 meeting were reviewed by Council. Councilmember Fitzgerald stated the following statement should be added at the end of paragraph 1 on page 5: - Mayor Andren than terminated the discussion on this item over the abjection of CounailIamber Fitzgerald." Mayor Andren called the public hearing to consider the assessment of Lord's Street Bridge Construction to order at 7:35 p.m. and read for the record the notice of the hearing as it appeared in the Prior Lake American on Monday, August 25, 1986. The tape will be kept on file in the Office of the City Manager as the official record of the hearing. City Engineer Anderson stated the total cost of the project was $197,436.00. The Minnesota aepartaent of Transportation was funding $109,573.00 of the project and the remaining mount of $87,863.00 was being assessed on a 606/4011 unit basis. She City's share was $35,145.00 and the remaining amount ($52,718.00) was assessed to 41 units at $1,285.80 per unit. Mr. Anderson reviewed the payment options available and showed a sample assessment and payments for ten years. Comments were made from the audience followed by a brief Council discussion. Mayor Andren called the public hearing Lo order at 9:40 p.m. to consider the assessment of Project 86 -1.2, Cates Street, and read the notice for the record as it appeared in the Prior Lake American on August 25, 1986. The tape will be kept on file in the Office of the City Manager as the official record of the public hearing. City Engineer Anderson explained that there are two property owners involved in this project. It is being 3006 assessed on a front footage basis at a rate of $110.18 per foot. City Manager MoGuire read for the record a letter from CST Properties asking that the hearing be tabled for one week or if it could not be tabled, they were stating opposition to their assessments. Mr. McGuire stated that in order to allow property owners 30 days to pay off their assessment and to levey and certify the special assessments with the Ccunty by October 15, the hearing could not be tabled. Discussion by Council followed regarding scheduling the hearing so close to the deadline and not allcuiM flexibility in delaying a hearing if necessary. Councilmesber Fitzgerald asked City Manager McGuire why the hearings were scheduled in September rather than July. Mr. McGuire responded that from a practical standpoint the City wants to have as much of the project done as possible and, therefore, schedules the hearings as close to the September 10 date as possible. Mr. McGuire further stated that in the future the hearings could be scheduled a week earlier. Councilmember White requested that Staff not schedule assessment hearings so close to the deadline in the future. The public hearing adjourned at 9:54 p.m. The Council than moved to item 48 to consider a request from Pat McGinnis for a conditioml use permit for a nursery school. The Planning Commission considered and approved the request at their September 4, 1986 meeting and Staff was recommending approval. The discussion was opened to the audience. Pat McGinnis was present and addressed the Council. Other members of the audience, including members of the Minnesota Valley Community Church, made comments in favor of the nursery school. Residents of Timber Trail addressed the Council regarding the noise that would be created by the school, the traffic on Timber Trail by the activities of the church and the additional traffic generated by the school, and evaluating an access on to Highway 13 for the church. Mayor Andren read for the record a letter she received from Linda Whitmore, who lives at Fish Point Road and Timber Trail. Discussion by the Council followed. The next item on the agenda was an update on the North Shore Project. City Engineer Anderson informed the Council that a meeting was held with the Update m contractor that morning and the contractor had agreed to continue working on the Nn d Shm project. The contractor was asking additional payments on several claims that Project were yet to be resolved. Discussion by Council, Staff and the audience followed. Lloyd Berggren asked why the assessment acreage rate did not increase when the front footage rate increased. Staff was directed to report on this during the project assessment hearing on September 15.
