The City is no stranger to the conditional use permit and z. is used it
quite frequently over the years. The Conditional use Provides a degree
Of flexibility in a sane. It My be authorised by the City Council if

The developer is requesting Conditional use approval for 36 units of
tcwbou es en approximately six acres. The subject property carries
en R•2 sosisg with a density of six units per acre. Since this is a
conventional rapist it is important to recognize three parcels and
that they are handled separately from a density allocation. The three
Parcels defined are -9 aCrss directly west of Five Hawks Avenue with a
maximum density of 6 snits. 4.265 acres southesst of intersection Five
Hawks Avenue and Cates Street with a maxim, density of 25 units. and
.754 acres north of Cates Street with a maxim, density of 5 units for
a total of 36 snits. The developer has tranefered one density unit to
the Parcel north of Cats Street Mich according to the caning code is
not permissible. Such A Concept is only possible under PUT, zoning
whereby the City maintains control over density and design.
The Concept 4111 PIoyed by the developer reflects an earlier Conditional
one APProved for tuenhowses north of Cates Street. In light of this
development the booming style and Concept is appropriate. The concept
would involve a replat of an earlier single family plat. Rally Circle
on the eastern edge of the development would have to be vacated along .
wi th several ezisting utility easements adjacent to property lines. A
40' drainage easement to Protect the creek draining the pondi:g area
east of the development must be extended to the eastern edge of the
Plat- All internal roadways mould remain private.

The site plan for the most part emphasizes limited land access through
the use of private streets. The exception is the parcel north of Cates
street in all, five 'driveways will face Cates Street. unless the units
are redesigned or large front and rear yard variances given the drive-
ways will remain. Much of the site planning is centered around the
architecture and design of the units. The individual unit design together
with its' single car garage make it desirable to keep the blocks of
townhouses even. This is the primary reason an 8' rear yard variance
is requested for block 2. With the exception of the above menti -ned
modification. the site plan is acceptable.
The applicant has been made aware of several pertinent issues relevant
to this discussion for which no data has been submitted. Probably the
leave with the most widespread affect on this development is the City's
Storm Water Management Plan. A dam is planned to retain storm water
during peak run off periods which will be located in the vicinity
Holly Court. The potential high water elevation can approach the
contour in affect flooding three units in block 7. Agrading rtla
will give an indication as to the maintenance or precautions necessary
to maintain the creek bed. The culvert size or creek crossing necessa
has been addressed by the applicant in his two page letter dated March 4,
lgf2. In that letter the landscapping issue has also been addressed
however asbigiously. It is impossible to visualize the plan described
in the letter much less evaluate and approve one.
The Planning Commission held two hearings on this plan, their minutes
are attached.

The Planning Commission tabled this item on February 4, 1962 to give the
applicant time to redesign the development and provide additional detail.
The revised site plan features a number of design changes however, it
lacks the detail the Planning Commission wanted. The units west of
Five Hawks Ave. have a different orientation and feature a single access
from Tiro Ranks Ave.. An 9' rear yard variance is requested for block
2 primarily became the architecture of the units and location of
garage make it desirable to keep the blocks of units even. The twelve
uraits directly east of Five Hawks Ave. vemsined essentially the same.
The entrance from Cate ST. was moved westerly for better intersection
definition.
The parcel north of Cate St. still contains six units or one more than
allowed by ordinance. The deign of this layout was slightly changed
by splitting one block of six units into two blocks of 4 units and two
unite. Ho significant changes were made to the layout of the 12 units
in the southeast section of the development.
The development does not provide a clear description of platting and
development of this proposal. It would be in the best interest of the
developer to clarify and provide detail at this time. To postpone this
information until preliminary plat review could result in possible
redesign of the development due to engineering requirements or unforseen
circumstances.
Furthermore the developer has mode few attempts at demonstrating to staff
and Planning Commission of how the natural amenities will be preserved
and integraded in the planning process.

The March 4, 1962 meeting of the Prior Lake Planning Commission was
called to order at 9 %30 P.M. by Chairmen Roseth. Present at the
meeting were Commissioner's Arnold, Foster, Fitzgerald, City Planner
G rarer and City Consolting Planner Tooker. Absent was Commissioner
Michael Pelix.
The minutes of the previous meeting were reviewed. Motion was made by
Commissioner Arnold to approve the minutes as written, seconded by
commissioner Pbster. upon a vote taken, the motion was duly passed.
Item I, Nome occupation Permit for Stew Collins was called to order.
Mr. Collins was present to answer questions.
City Planner Graser stated that Mr. Collins is requesting a Homs
Occupation Permit for a Pbotography Studio in his home at 4500
Colorado Street SE. Staff recommended approval since it would not
be objectionable to the neighborhood nor cause the residential
character of the neighborhood to deteriorate.
Notion was made by Poster to approve the Nose occupation Permit, seconded
by Arnold. Upon a vote taken, the motion duly passed.
Item II, Continuation of Townhouse Conditional Use for Cy Schweich.
Cy Schweich, Ted Schweich and Greg Schweich were present to answer
questions.
City Planner Grazer stated staff's position which included the following
pointst
1.) The plan submitted for this hearing incorporated some of the
Planning Commission's suggestions with respect to design.
2.) The plan did not go into detail or provide a clear description
of the platting and development of this proposal.
3.) Postponing the submittal of information (mostly engineerinq)
until preliminary plat could result in redesign of the plat
due to engineering requirements or unforseen circumstances.
4.) The natural amenities have not been addressed with respect
to prservetion and integration in the planning process.
Mr. Schweich presented a letter ( Planning Commission Exhibit "8 ") to
the Planning Commission which he reviewed in detail.

The Planning commission reviewed Plannina Commission Exhibit "A" which
is the site map submitted by the applicant pith the following recommend-
ation to co to the Council: Motion by Fitzgerald seconded by Foster to:
1.) Grant an 8' rear yard variance for the four units consisting of
block 2.
2.) The culvert and size necessary to build the road serving block 6
and 7 be determined.
3:) The proposed dam and potential high water elevation and the effects
it would have on this plat be reviewed by the City Engineer,

5.) Block 8 and 9 shall only be serviced by two access drives.
6.) Only five units north of Cates Street be permitted to be consistent
with the Zoninq Ordinance.
Upon a vote taken, the motion duly passed.
At this time Chairman Roseth called for a 5 minute recess.
The Planning Commission meeting reconvened at 9e45 P.M.
Item III, variance request by Mark Hyland was called to order. Mr. Nyland
was present to answer questions.
City Planner Graver commented that Mr. Hyland is requesting a 5.5' side
yard variance from the north property line and 2' side yard variance from
the south property live for Lot 36, 8oudins Manor. Staff recommended
approving the 2' side yard variance from the south property line and a
4.S' side yard variance from the north property line.
Mr. Hyland stated that the 34' garage side was incorrect it should be 24'.
Also Mr. Hyland stated be needs the S.5' variance to accommodate 2 cars
which will just barely fit.
Lotion was made by Pitsgarald seconded by Arnold to approve the variance
per staff recoppene"tion since the variance would perserve the residential
characteristic* of neighborhood and consistent with previous actions on
similar situations.
Item IV, Discussion by Staff and Planning Commission on Rural Land Use
Density.
City Consulting Planner Tooker referred to Memorandum dated January 15, 1982
on Agricultural Zoning in Prior Lake. Mr. Tooker feels the Comprehensive
Plan should be changed at this time per the model distributed by the Metro
Council.
The Planning Commissioners discussed this item at length and the Zoning
Ordinance is adequate for now and until changes are needed to keep it
as such.
Notion was made by Fitzgerald, seconded by Arnold to reject the Agricultural
density concept and retain the 10 acre minimum lot size but reduce the front
footage requirement or width to 330' based on:
1.) The density concept is fraught with problems.
2.) The density concept would be an impossible administration problem.
3.) The density concept would constantly qenerate variances due to
unique situations.

The applicant is requesting a conditional use permit to construct townhouses on 5.92
acres. The three parcels Involved in this application were resorted to R -2 with a
permitted density of 6 units per acre. Since this is a conventional replat it is
Important that the three parcels are handled separately from a density standpoint. The
three parcels defined are .9 acres directly vast of Five gawks Avenue with a maximum
density of 6 units. 4.265 acres southeast of intersection Five Hawks Avenue and Cates
Street with a maximum density of 25 units, and .754 acres north of Cates Street with a
saximum density of 5 units for a total of 36 units.
The developer bas transferred one density unit to the parcel north of Cates Street
which according to the zoning code Is not permissible. Such a concept is only possible
under PUD zoning whereby the City maintains control over density and design. The
purpose of the conditional use permit in to evaluate whether or not the proposed use
conforms to the neighborhood. The evaluation criteria is found on pages 22 and 23 of
the zoning ordinance.

ance. Considering the amount of land available. it would appear the variance is not
justified. It would be desirable to include some on site guest parking for these
units since all the units In the development have single car garages. It would be
desirable for the drive serving these units to line up with the one to the south.

The southeasterly area of the development consisting of 12 units
could be greatly improved by good utilization of the natural features
of the site. The orientation of the 6 westerly units should be north-
westerly towards the creek. The other six units could be split into
two clusters using topography to give more character and reduce monotony.
This site is extremly prone to erosion once construction is started,
precaution should be taken to reduce the potential for sediment erosion
into the creek. Because of the sensitive nature of the site additional
information will be required in order to make a thorough analysis. A
grading plan will be required with established building elevations and
street slopes. The culvert size must be established which in turn have
a direct effect on low slab elevations. A statement on filling and
maintenance of the drainage area both short term and long ten. The
slope between finished road grade and building to creek channel must
be established. These factors will have a direct bearing on the number
of wits for this site and their orientation.
Staff recommends the Planning Commission first establish whether or not
this concept is feasible for the area fro..a the information available.
Then proceed to evaluate the individual parcels. If additional inform-
ation is desired then a list prepared and the develper informed.

The February 4, 1982 meeting of the Prior take Planning Commission was
called to order at 7.35 P.M. by acting Chairman Roseth. Present at the
meeting were Commissioner's Foster, Fitzgerald, City Planner Graser.
Commissioner Arnold was absent.
The minutes of the previous meeting were reviewed. Motion was made by
Commissioner Fitzgerald to approve the minutes as written, seconded by
Commissioner Foster. Upon a vote taken, the motion was duly passed.
Item I, Rezoning Request by Gary Hanson was called to order. Gary Hanson,
Norm Erickson, and Dean Norlock property owners were present to answer
questions.
City Planner Graser made a presentation as per his memorandum dated
February 4, 1982. He noted that Mr. Hanson is requesting the rezoning
Of a parcel of lard 1 acre lying directly southeast of intersection
of Franklin Trail and S.T.H. 13. The property is located at the northern
fringe of the S.T.H. 13 commercial strip which extends southward along
S.T.H. 13 for 1.9 miles. Mr. Hanson is requesting rezoning to B -3.
City Planner Grazer stated that this application is in direct conflict
with Prior Lake's Comprehensive Plan. "TO create unified fully developed
commercial service centers, all shopping will be confined to the downtown
Brooksville Center and a neighborhood oriented center at the intersection
of County Rd. 42 and Highway 13. Also this area has been denied rezoning
twice by the City Council.
Staff's recommendation was to deny this petition for rezoning of the property.
Norm Erickson said it would be common sense and only good judgement since
the corner is natural for commercial.
Wally Johnson ajoining property owner felt a rezoning was needed.
Howard Olson ajoining property owner directly east stated that it is
evident the property is commercial.
Discussion followed by the Planning Commissioner's. Commissioner Foster
felt the request was premature due to the new 9 member committee assigned
by the Mayor to look into future Commercial s Industrial Property sites.
Commissioner Fitzgerald questioned why the request was for B -3 instead
of B -1, but felt a B rezoning was adequate for this property. Commissioner
Roseth stated that the Comprehensive Plan was approved by the Commission
and should be a guideline. Also he felt a sketch or something tangible
was needed to show what would be built on the property. At this time
