A RESOLUTION TO APPROVE AN AMENDMENT TO THE PLANNED UNIT DEVELOPMENT (PUD )
FINAL PLAN KNOWN AS HICKORY SHORES

WHEREAS, Wyatt Pudel Pointer LLC has submitted an application for a n amendment to the Planned
Unit Development Final Plan known as Hickory Shores; and
WHEREAS, The proposed amendment is a “ minor amendment” for administrative and procedural
purposes as defined in Section 1106.711 of the Zoning ordinance, which proposes
alterations to the g rading plan of the approved Final PUD Plan as identified in Exhibit A ;
and
WHEREAS, The Prior Lake City Counci l considered the proposed PUD Amendment on March 19,
2012 ; and
WHEREAS, The City Council finds the PUD Amendment to be in substantial complian c e with the
approved Final PUD Plan; and
WHEREAS, The City Council finds that the PUD Amendment is compatible with the st ated purposes
and intent of Section 1106 ( Planned Unit Developments ) of the Zoning Ordinance.
NOW THEREFORE , BE IT HEREBY RESOLVE D BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Planned Unit Development Amendment is hereby approved subject to the following conditions:
a. The developer must obtain the required permits fr om any other state or local agency prior
to any work on the site.
b.
All comments as outlined in the Engineering and Public Works Department Mem o randum dated
March 2, 2012 shall be addressed as identified in Exhibit B.

Subject: Hickory Shores Second Addition
The Engineering and Public Works Department s reviewed the PUD amendment dated 2/16/2012,
grading plan with a plan date of 12/08/2011 and revised stormwater management report with a
date of 12/21/11 for the subject project and we have the following comments .
PUD Amendment
The amendment to the PUD proposes to provide two benefits to the City . The initial public
improvements for the Hickory Shores development were accepted containing a water quality
pond that was oversized and constructed in a sand layer. The location and size of pond provided
exceptional infiltration capacity that did not a llow the pond to maintain a consistent water
elevation. This PUD amendment proposes to line the pond with a compact soil liner such that
the modified pond will hold water at a more consistent elevation. The method chosen to line the
pond is to import 2 f eet of fill from nearby lot grading operations and regrade, place and compact
the fill building up the bottom of the pond.
This method of pond lining represents a trade - off: Benefits of lining the pond will be improved
aesthetics through more consisten t pond elevations and an open water feature in the
neighborhood and safety by providing a water elevation at an expanded flat pond bench, instead
of the steeper pond slopes. Costs include a reduced pond maintenance cycle due to the loss of
pond capacity.
Grading and Utilities
1. Provide fill detail and modified storm outlet details from stromwater report on plans.
2. Storm sewer structure modification is required between units 2 and 3 to account for change in
grade.
3. Specify exact fill depth, material clay cont ent, compaction and permeability for pond liner on
plan sheet and provide copy of geotechnical report that addresses maintenance of pond water as
goal of liner.
4. All relevant requirements such as compaction, thickness, and material to maintain water leve l
must be shown on the revised plan as this will replace the approved plan that is referenced in the
developer agreement.
5. If developer chooses not to investigate soil and quality of fill material to meet the goal is not
know n , include process in the plan f or testing and specifications for amending that soil with
imported clay during construction.
Site Hydrology, Water Quality and Storm
1. Reduce peak rate for 2 year storm below 0.05cfs/ac.
2. For all other requirements the proposal reduced peak rate and volume below the already approved
stormwater management plan meeting requirements.
3. Confirm that NPDES permit is still open, or apply for new NPDES. Provide modified or new
SWPPP for review.
