A RESOLUTION ACCEPTING BIDS AND AWAR D ING THE CITY’S STANDARDIZED CONSTRUCTION
CONTRACT FOR THE BOUDINS PHASE II IMPROVEMENT PROJECT (CITY PROJECT #12 - 01 1)

WHEREAS, Pursuant to an advertisemen t for bids for the Boudins Phase II Improvement Project (City
Project #12 - 01 1) which includes sanitary sewer, water main, storm sewer, aggregate
base, concrete curb and gutter, bituminous pavement, turf restoration and appurtenant
work; and
WHEREAS, Bids were received, opened, and tabulated according to law; and
WHEREAS, The following bids were received complying with the advertisement:

Geislinger & Sons, Inc. $2, 391,576.08
Northdale Construction $2, 863,256.42
and;
WHEREAS, Northwest Asphalt is the lowest responsible bidder.
NOW THEREFORE , BE IT HEREBY RESOLVE D BY THE CITY COUNCI L OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Northwe st Asphalt is the lowest responsible bidder.
3. The Mayor and City Manager are hereby authorized to enter into the City’s standard contract with
Northwest Asphalt in the name of the City of Prior Lake for the 2012 Street Rec onstruction Project
(Project #12 - 01 1) in the amount of $2,287,195.98 .
4. The City Manager is hereby authorized and directed to return to all bidders the deposits that
accompanied their respective bids.
5. The City Council authorizes funding for this project as shown in the following table:

Sewer Fund $68,271.80
Water Quality Fund $115,201.72
Crossroads Development Contract Fund $16,691.00
Private Driveway Funding $86,860.50

6. Construct ion costs will be recorded in t he Construction Fund (#501 - 48373 - 501) for the Boudins Phase
II Improvement Project .
7. The City has determined to make a declaration of official intent (“Declaration”) to reimburse certain
estimated costs for this project from p roceeds of bonds in accordance with the Internal Revenue
Service Reimbursement Regulations (Treasury Reg. 1.150 - 2).
8. This Declaration has been made no later than 60 days after payment of any original expenditure to be
subject to a reimbursement allocation with respect to the proceeds of bonds, except for the following
expenditures:
a. costs of issuance of bonds;
b. costs in an amount not in excess of $100,000 or five percent of the proceeds of an issue;
or
c. “preliminary expenditures” up to an amount not in exc ess of 20 percent of the aggregate
issue price of the issue or issues that are reasonably expected by the City to finance the
project for which the preliminary expenditures were incurred. The term “preliminary
expenditures” includes architectural, engineer ing, surveying, bond issuance, and similar
costs that are incurred prior to commencement of acquisition, construction or rehabilitation
of a project other than land acquisition, site preparation, and similar costs incident to the
commencement of constructi on.
9. This Declaration is an expression of the reasonable expectations of the City based on the facts and
circumstances known to the City as the date hereof. The anticipated original expenditures for the
Projects and the principal amount of the bonds are con sistent with the City’s budgetary and financial
circumstances. No sources other than proceeds of bonds to be issued by the City are, or are
reasonably expected to be reserved, allocated on a long term basis, or otherwise set aside pursuant to
the City’s bu dget or financial policies to pay such Project expenditures.
10. This Declaration is intended to constitute a Declaration of the Official Intent for the purposes of the
Reimbursement Regulations.
11. T he City Council authorizes an inter - fund loan from the Water Fu nd to provide interim funding until
addi tional bonds are issued in 2013.
12. Proceeds from the bond sale will be deposited in the Construction Fund.
