DISCUSSION:
HISTORY
Scott County has proposed the turnback of three County
road segments to the City. The turnbacks are desired by the
County because each of the subject segments no longer
serve a County purpose. Instead each segment serves a
local purpose as feeders to larger roadways. Under the
state statutes, the county can turn the roads over to the City
by resolution without making improvements and only
providing maintenance for two years. Scott County as a
matter of policy typically provides money or improvements
for roads they turn back to cities or townships.
The three proposed segments are listed below and shown
on an attached maps:
1) 170th Street - East from TH 13 to CSAH 23. (0.15 miles)
2) CSAH 39 (Franklin Trail) - From TH 13 South to TH 13
North. (1.21 miles)
3) CR (County Road) 81 - From TH 13 to CSAH 12. (0.58
miles)
In consideration of the City assuming responsibility for the
above highway segments, Scott County would provide either
an overlay or a sum of money equal to $30,000 per mile

($58,200 total). In addition the Council must decide to either
select a 2 year maintenance option or a pay equivalent of
$5,958 per mile per year ($23,117 total).
At the C.ity Council's October 20, 1997 meeting a policy for
the acceptance of county highway turnbacks was
considered. In response to this policy, the County requested
from the City a specific list of work we expect them to
accomplish before the turnbacks occur. This list was
provided to the County (see attachment to the Memorandum
of Understanding) and the County has committed to perform
all work listed if the Council chooses to select the overlay
option.
CURRENT CIRCUMSTANCES
Attached to this report is the memorandum of understanding
drafted by the Scott County Highway Engineer covering the
financial and maintenance considerations associated with
the turn backs. This proposal is the same as has been
offered to Scott County townships wherein the County
proposes to turn roads back to the town board. The County
indicated they wanted to be fair and treat the Cites the same
as the townships.
The County's cash offer is to pay an equivalent of $30,000
per mile. This cash proposal is inadequate to address the
existing roadway problems. The $30,000 figure translates to
a 3/4 inch overlay. Typically a 1 1/2" overlay is expected.
Using 1998 bid prices to complete the Pleasant Street
overlay, the cost equates to $87,400 per mile. As indicated
in the County's proposal this would amount to the following
for each road segment under their proposal compared to our
experience with Pleasant Street:

ISSUES
170th Street
The centerline of 170th Street (behind County Market) is the
City's boundary with Spring Lake Township. To date, the

township has not accepted this turnback. The County
Engineer has indicated that whichever option the City
selects will be applied to the Township, whether it is the
overlay or pay equivalent.
The realignment of County Road 23 and Five Hawks at TH
13 is proposed in the CIP for the year 2004. This project
may affect the eastern edge of the 170th St. turnback
segment.
CSAH 39
A separate resolution is included with this report to remove
the County State Aid Highway designation from CSAH 39.
This resolution will be submitted to State Aid at the same
time as the turnback jurisdiction so that the City could add
this highway to our Municipal State Aid street system without
affecting our 20% cap.
CONCLUSION
Based on the staff's estimates to overlay these road
segments, it is our recommendation that the council select
the overlay option for all three turnback segments. This
work would include the additional scope that is attached to
the Memorandum of Understanding. This work is to be
completed by the end of 2000.
By selecting to have the County maintain the roadways for 2
years, the City could further delay the additional
maintenance costs that it would incur for these additional
miles of roadway. If the City chooses to accept the $23,117
of maintenance cost per mile, this money should be used to
increase the Public Works Streets budget to offset the
additional cost to maintain the turnback segments.
By accepting these turnbacks, the City's maintenance costs
will increase in order to maintain 1.94 miles of additional City
roadways. The City's Municipal State Aid apportionment
will increase by adding CSAH 39 into the City's system.
The alternatives are as follows:
1. Approve Resolution OO-XX authorizing the Mayor to
approve the Memorandum of Understanding accepting
the County Highway turnbacks and selecting the overlay

Statutes 163.11, to transfer the following County highway jurisdictions:
1) 170th St. - East from TH 13 to CSAH 23 (0.15 mile)
2) CSAH 39 (Franklin Trail) - From TH 13 South to TH 13 North (1.21 miles)
3) CR 81 - From TH 13 to CSAH 12 (0.58 miles)
WHEREAS, Scott County will perform an overlay on each segment of street listed above by
December 31,2000; and
WHEREAS, Scott County will maintain the street segments listed above for 2 years after the
County board turnback decision;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
that the City of Prior Lake enter into a memorandum of understanding with Scott County, Minnesota,
to transfer jurisdiction of the County Highway segments listed above to the City of Prior Lake in
accordance with the terms and conditions set forth and contained in the memorandum of
understanding, a copy of which was before the Council.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute such agreement on behalf of
the City.

WHEREAS, the County of Scott is proposing to revoke the county State Aid Highway designation of
CSAH 39 as follows:
Beginning at a point on the southeasterly right of way line of State Trunk Highway 13
approximately 1700 feet west of and 650 feet south of the east quarter corner of
Section 2, Township 114, Range 22, Scott County, Minnesota; thence easterly,
northeasterly, and northerly along said county State Aid Highway 39 (Franklin Trail) to
the southeasterly right of way line of State Highway 13 approximately 1120 feet east of
and 990 feet north of the southwest corner of Section 36, Township 115, Range 22,
Scott County, Minnesota and there terminating.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
that the City Council approves and accepts such removal of the County State Aid Highway
designation upon the Scott County Board of Commissioners revoking County State Aid Highway
designation from CSAH 39.

WHEREAS, the County of Scott is proposing to revoke the county State Aid Highway designation of
CSAH 39 as follows:
Beginning at a point on the southeasterly right of way line of State Trunk Highway 13

1. That the City Council approves and accepts such removal of the County State Aid
Highway designation upon the Scott County Board of Commissioners revoking County
State Aid Highway designation from CSAH 39.
2. That the roadway described above, be and hereby is established, located, and designated
a Municipal State-Aid street of Prior lake subject to the approval of the Commissioner of
Transportation of the State of Minnesota.
