DISCUSSION:
Introduction:
The purpose of this agenda item is to consider approval of an
ordinance that would adopt by reference the City's official fee
schedule. The fee schedule identifies those types of service charges
and permissible license fees that may be charged on a user basis to
recover city-associated costs as directed by the City Council in an
effort to reduce reliance upon the property tax. The intent is that the
user who benefits should pay the ultimate cost of the service
provided.
Current Circumstances:
New legislation that became effective in April 2003 requires that
cities must adopt their planning and zoning fees by ordinance. Since
our "Official Fee Schedule" includes a subsection of planning and
zoning fees it would seem appropriate to adopt the entire fee
schedule. Therefore the ordinance has been drafted to approve the
City of Prior Lake Official Fee Schedule by reference. Attached is
the proposed 2004 City of Prior Lake Official Fee Schedule that lists
all license fees and service charges. Fees proposed for increase are
indicated in the table below alongside their present amount:

The Water and Sewer Rates for Un-assessed Parcels have not
been adjusted since established some 20 years ago. This rate is
primarily used for parcels that connect to the city's municipal
system when utilities become incidentally available but have not
been assessed. The city experiences very few of these connections
however Engineering recommends updating the water rate to
$50.00/ff and the sewer rate to $70.00/ff based upon cun-ent
construction costs.
Trunk Water and Sewer Acreage charges have not been changed
since 1995. Bonestroo has recently completed a Sanitary Sewer
Study that includes the annexed area and in order to finance the
sanitary sewer trunks detailed in this plan the trunk sewer area
charge needs to be increased to $4913/acre. The water trunk acreage
charge has remained the same since 1995. The Council has approved
a rate study, as part of the Comprehensive Water Plan Update, to
analyze our utility water and sewer rates as well as determine the
appropriate trunk water acreage charge at build-out. To provide an
interim water trunk acreage charge, Staff would recommend that our
CUlTent trunk water charge of $1750/acre be increased 3% annually
(1996-2003) to $2,2l7/acre. In light of this study, both fees should
be considered interim until the study is completed.
Contractors routinely request filling of bulk tank trunks for watering
street boulevards. A meter is affixed to a hydrant at the Maintenance
Building to avoid any water disturbance in residential areas. Staff is
requesting that a Bulk Water Rate charge of $5.00/1000 gals. be
implemented. This will be the first time this charge will be
implemented.
The Impoundment fine (1st unlicensed offense) for dogs is
recommended to be increased. Impoundment for licensed dogs is
$25, $50 and $100 for the first, second and third impoundment
respectively. For unlicensed dogs the first impoundment would
double to $50 and subsequent impoundments would remain the
same.

Members of the AMM, LMC and State Building Codes and
Standards Division developed a sample Building Permit fee
schedule cooperatively in 2003 in an effort to provide a consistent
fee schedule those cities may use as a guide in setting local building
permit fees. The fee schedule was endorsed by 20-some city
representatives in an effort to provide consistent fees within the
metropolitan area and because the cunent fee schedule associated
with the 1997 UBC has not been updated. The new schedule
represents a 6% increase from the 1997 UBC building pennit fee
schedule. Staff has taken the initiative to notify the building
contractors that the City Council would be considering the new
schedule at this meeting so that they would have adequate time in
developing their cost estimates ahead of time for home construction
bids.
The MCES sac charge increase of $75.00 from $1275 to $1350 is
required by the Metropolitan Council Environmental Services. The
fee helps pay the capital costs of construction of the Metropolitan
sewer interceptor system. This rate has increased incrementally by
$50-75 each year for the past 15-20 years.
Boat Trailer Parking and Daily Admission at Sand Point Beach
have not been increased for the past 7 years and the fees should be
increased by $5 to $15 and by $1 to $5.00 per day respectively. In
addition, the Park Season Stickers for both residents and non-
residents should be increased to $25.00/$35.00.
Based upon the recommendation of the Parks Advisory Board the
Skate Park fees have been re-structured to reduce the daily
admission fee from $3 to $2 and to replace the old season pass with
a pre-paid admission punch card that would allow for either 5 or 10
visits at a cost of $S or $15. Also a $10 seasonal membership
requirement for non-residents is proposed. These cuts are intended
to encourage skate park usage.
Due to the time invested by the DRC (Development Review
Committee) in reviewing development concept plans, the Planning
Department has proposed a Concept Plan fee of $200.00 to be
charged to recover city time spent meeting with owners and
developers. Also from a cost recovery standpoint, Staff would
recommend establishing a Facade Improvement Application Fee
of $250.00 to cover the administration of the grant program.
Our cunent flat fee charge for Aerial Maps of $5 is proposed to be
tiered at $5/$10/$15 for small, regular and large size aerial maps.
Similarly the $1 City Map charge should be $1/$5/$10 depending
upon the size. The range for Topo Map charges is proposed to be
$10/$15/$25 for small, regular and large size topos.

Because of the cost associated with creating GIS data in a CD-rom
fonnat the following GIS fees are recommended:
a) Planimetric data - $12/acre
b) Parcel data - $.05/parcel
c) Custom data - $50.00/1n".
Engineering is going to require that wetlands and ponding areas
within development proposals that the city controls be marked by
Wetland Marker Signs at a cost of $5 so that the public is aware of
these areas and are not to alter theIr physical characteristics.
With the adjustments proposed, all city fees will be fairly typical
and fall in the range of what other cities charge according to the
most recent Association of Metropolitan Cities' "Municipal License
& Permit Fee Survey" conducted every two years.
The following alternatives are available to the City Council:
1. Approve An Ordinance Amending Section I 06 Of Prior Lake
City Code Providing For Adoption Of An Official Fee Schedule as
presented.
2. Approve An Ordinance Amending Section I 06 Of Prior Lake
City Code Providing For Adoption Of An Official Fee Schedule
subject to specific Council amendments.
3. Delay action on the ordinance if the Council requires additional
information.

AN ORDINANCE AMENDING SECTION 106 OF THE PRIOR LAKE CITY CODE
PROVIDING FOR ADOPTION OF OFFICIAL FEE SCHEDULE.
The City Council of the City of Prior Lake does hereby ordain that:
1. Section 106 of the Prior Lake City Code is hereby amended to add:
106.600 Adoption of Official Fee Schedule: The City Council hereby adopts by reference an
Official Fee Schedule as required pursuant to Minnesota Statutes 462.353. The Official
Fee Schedule shall include all city license fees, user charges and permit charges of the
City of Prior Lake. The Official Fee Schedule shall be amended from time to time on an
annual basis as approved by the City Council.
This ordinance shall become effective from and after its passage and publication.
Passed by the City Council of the City of Prior Lake this 5th' day of January, 2004.
