The plat combines four existing lots into one. The property is located on the east side of Main Avenue and on the south side of C.R. 21. There is a commercial building currently located on one of the lots to be combined. On March 27, 2000, the Planning Commission considered this preliminary plat application. The Planning Commission recommended approval of the preliminary plat subject to the condition that the developer grant NSP a requested easement if necessary. On March 30, 2000 the Planning Department received a letter from NSP stating the previously requested easement is not necessary. A draft copy of the Planning Commission meeting minutes is attached to this report for your information. Current Circumstances: The preliminary plat consists of 0.35 acres to be subdivided into 1 lot. The applicant is planning for a future building addition. The proposed addition extends over an existing lot line. Combining the lots through the platting procedure will allow for the construction of the addition. The proposed lot meets the minimum lot area and frontage requirements for the C-3 district. Access to the lot is existing and is from Main Avenue. There is no public right-of-way or parkland dedicated in this plat. In addition, there are no required or proposed utilities, including sanitary sewer, water mains, or storm sewer proposed. These services are located in the existing road right-of-way. There are no existing trees on the lot. This development is not subject to the Landscaping requirements. The applicant is working with the attorney's office with respect to title work and final plat documents for final plat approval. Conclusion: The Planning Commission concluded the preliminary plat is consistent with the Subdivision and Zoning Ordinance requirements. The Planning Commission recommended approval of the preliminary plat, subject to the following condition: 1. The developer grant a utility easement per NSP request. If NSP rescinds the request, then no easement will be necessary. NSP has rescinded its request for an easement; therefore, this condition is no longer necessary. Budget Impact: Approval of the preliminary plat will allow the developer to proceed to the final plat, which will in turn allow for a future building expansion. The future building addition will contribute to the City's tax base. The City Council has three alternatives: 1. Adopt Resolution #OO-XX, approving the preliminary plat of Carlsons First Addition with the finding that the preliminary plat is consistent with the intent and purpose of the Comprehensive Plan and the Zoning and Subdivision Ordinances. 2. Deny the preliminary plat on the basis it is inconsistent with the purpose and intent of the Zoning and Subdivision Ordinances and/or the Comprehensive Plan. In this case, the Council should direct the staff to prepare a resolution with findings of fact for the denial of these requests. 3. Defer consideration of this item for specific reasons. A motion and second to approve Resolution OO-XX, approving the Preliminary Plat to be known as Carlsons First Addition. y Manager 1:\OOfiles\OOsubdiv\preplat\carlson \carlsonc.doc Page 2 RESOLUTION OO?, J I RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE PRELIMINARY PLAT OF "CARlSONS FIRST ADDITION" MOTION BY: SECOND BY: WHEREAS: the Prior lake Planning Commission conducted a public hearing on March 27, 2000, to consider an application from Bernie Carlson for the preliminary plat of Carlsons First Addition; and WHEREAS: notice of the public hearing on said preliminary plat has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and WHEREAS: all persons interested in this issue were afforded the opportunity to present their views and objections related to the preliminary plat of Carlsons First Addition for the record at the Planning Commission hearing; and WHEREAS: the Planning Commission and City Council have reviewed the preliminary plat according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said preliminary plat to be consistent with the provisions of said ordinances; and WHEREAS the Prior Lake City Council considered an application for preliminary plat approval of Carlsons First Addition on April 17, 2000; and WHEREAS: the City Council finds the preliminary plat of Carlsons First Addition to be consistent with the 2010 Comprehensive Plan. 1. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it hereby approves the preliminary plat of Carlsons First Addition subject to no additional conditions. Call to Order: The March 27, 2000, Planning Commission meeting was called to order by Chairman Cramer at 6:30 p.m. Those present were Commissioners Atwood, Cramer, Criego, and Vonhof, Planning Director Don Rye, Planning Coordinator Jane Kansier, Planner Jenni Tovar, Zoning Administrator Steve Horsman, Assistant City Engineer Sue McDermott and Recording Secretary Connie Carlson. 2. Approval of Minutes: The Minutes from the March 13,2000, Planning Commission meeting were approved as presented. Commissioner Cramer read the Public Hearing Statement and opened the first item. 4. Public Hearings: ~ A. Case File #00-017 Bernard Carlson is requesting approval of a preliminary plat for the project known as Carlson's First Addition, located at the southeast quadrant of the intersection of Main Avenue and Eagle Creek Avenue. Planner Jenni Tovar presented the Planning Report dated March 27, 2000, on file in the office of the City Planner. Bernie Carlson has submitted an application for a preliminary plat for the 0.35 acre site located at the southeast quadrant of the intersection of Eagle Creek Avenue (CR 21) and Main Avenue. The plat will combine four existing lots into one lot, which will allow for a future building addition. A building permit cannot be issued over lot lines or on properties described as an outlot. The preliminary plat, to be known as Carlsons First Addition, is the site ofa commercial building at 16281 Main Avenue. Staff felt the proposed preliminary plat met the standards of the Subdivision Ordinance and Zoning Ordinance.
