AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING A COMMON IN-
TEREST COMMUNITY PLAT NUMBER 1196
DISCUSSION: Introduction
Chase Commercial Properties LLC has applied for a CIC Plat Number 1196
(Fountain Hills Business Park Association). The CIC plat is proposed to sepa-
rate the various tenant spaces within the building into individual lots.
History
The existing commercial building was constructed in 2000. The 3.5 acre property
is zoned C -2 (General Business Commercial) and is currently occupied by two
businesses and other open tenant spaces.
Current Circumstances
The purpose" of a CIC plat is to allow the subdivision of a multi- tenant building
into individual lots for sale. Essentially, the plat creates a lot around the walls of
the various units. CIC plats are typically done following the actual construction
of the buildings in question. The subdivision of the single lot into a 5 -unit Com-
mon Interest Community Plat will not alter the current use of the site.
ISSUES:
CIC plats do not require a development contract. The required developer im-
provements were included as part of the development contract for the construc-
tion of the building.
Conclusion
Staff has reviewed the CIC plat amendment and finds it consistent with the ap-
proved site plan and original CIC Plat. A copy of the CIC plat is attached to this
report.
FINANCIAL
There are no financial impacts with the approval of this CIC plat since the build -

ing has already been built.
ALTERNATIVES:
1. Adopt a Resolution approving the Common Interest Community Number
1196 CIC Plat.
2. Deny the resolution approving the CIC plat.
3. Defer this item and provide staff with specific direction.
RECOMMENDED
City Staff recommends Alternative #1. A motion and second to recommend the

RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1196 (FOUNTAIN
HILLS BUSINESS PARK ASSOCIATION) CIC PLAT
MOTION BY: SECOND BY:
WHEREAS, Chase Commercial Properties, LLC has applied to the City of Prior to subdivide commercial
office property located on Fountain Hills Drive as a Common Interest Community (CIC) Plat;
and
WHEREAS, The building proposed to the be subdivided into a CIC plat is located on an existing platted lot
known as Lot 1, Block 2, Fountain Hills Addition; and
WHEREAS, The City Council has found the Common Interest Community (CIC) Number 1196 is in
substantial compliance with the existing building and does not change the site plan; and
WHEREAS, The City Council hereby approves the Common Interest Community (CIC) Number 1196.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
1. The above recitals are fully incorporated herein as set forth above.
2. The amendment to the CIC plat must be filed by the owner /applicant with the Scott County Recorder's Office
within 60 days from the date of City Coucil approval. Failure to record the documents by September 23, 2012
will render the CIC plat null and void.
3. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
