PRIOR LAKE PLANNING COMMISSION MINUTES
MONDAY, June 25, 2012
1. Call to Order:
Acting Chairman Roszak called the June 25, 2012 Planning Commission meeting to order at 6:00 p.m.
Those present were Commissioners, Roszak, Blahnik, Hite, and Spieler, Community and Economic
Development Director Dan Rogness.
2. Approval of Agenda:
MOTION BY BLAHNIK, SECONDED BY HITE TO APPROVE THE JUNE 25, 2012 MEETING
AGENDA AS PRESENTED.
VOTE: Ayes, Spieler, Roszak, Hite and Blahnik. The Motion carried.
3. Consider Approval of May 29, 2012 Meeting Minutes:
MOTION BY BLAHNIK, SECONDED BY SPIELER TO APPROVE THE MAY 29, 2012 MEETING
MINUTES
VOTE: Ayes, Roszak, Hite, Blahnik, and Spieler. The Motion carried.
4. Public Hearings:
A. # EP 12-117 ARTISIAN COFEE BISTRO C.U.P. Nan Zetzman is requesting a Conditional Use
Permit to allow a restaurant, Artisan Coffee Bistro, with liquor in the C-2 Zoning District. The subject
site is located in the South Lake Village Mall.
Director Dan Rogness
presented Nanette Zetzman has applied for a conditional use permit to allow a
restaurant with liquor in the C-2 (General Business) Commercial Zoning District. The restaurant is the
Artisan Coffee Bistro, a commercial tenant within Southlake Village. The site is located at 16731
Highway 13 South (Unit 104), Southlake Village shopping center. The City Council granted On-Sale
3.2 Malt and Wine Liquor Licenses to the Artisan on June 4 that is effective July 1, 2012 through June
30, 2013. The council’s approval is conditioned upon the Planning Commission granting the CUP.
Commissioner Questions:
Spieler
asked does TJ Hooligans have a full liquor license and a C.U.P.?
Rogness responded
it has a full liquor license and it has been there long enough that it precedes the
ordinance that requires it to have a C.U.P.
Spieler
asked is there a law that states two business that serve liquor have to be a certain distance
apart?
Rogness
responded my understanding there is no distance requirement from one licensed unit to
another. In this strip center there are other operations that have liquor license and are in close
proximity to one another.

Roszak
asked did the City Council already approve a portion on this topic?
Rogness
responded yes they have approved two liquor licenses, one is for on-sale 3.2 malt liquor and
a second license for wine. They approved these licenses on the condition that the C.U.P. is approved at
the Planning Commission.
MOTION BY BLAHNIK SECOND BY SPIELER TO OPEN THE PUBLIC HEARING AT 6:10 P.M.
VOTE: Ayes, Spieler, Roszak, Hite and Blahnik. The Motion carried.
Applicant Ben Peters 20181 Lake Ridge Drive
stated we are not trying to run a bar we are running a
restaurant. That is why we just need the beer and wine license. We want to be able to offer locally
made beer and wine for people at their dinner.
Commissioner Questions:
Blahnik asked
is there an outside location where alcohol could be consumed?
Applicant Peters
responded we do have some outdoor seating, but we will not be serving liquor
outside.
Spiele
r asked is there any regulation on the age of your servers if you serve alcohol?
Applicant Peters
responded they do have to be 18 years or older, we do have a few that are under 18
and they will not be serving alcohol.
Rogness
stated in regards to the outside seating statement, we do have a listed condition with the
permit that states they will not be serving liquor outside and there will be signage informing the
customers.
A MOTION BY BLAHNIK SECOND BY SPIELER TO CLOSE THE PUBLIC HEARING AT 6:14 P.M.
VOTE: Ayes, Spieler, Roszak, Hite and Blahnik. The Motion carried.
Commissioner Comments:
Blahnik
stated I will be supporting this Conditional Use Permit, it is consistent with the goals and
objectives of the 2030 Comprehensive Plan. It does not appear to have any undue adverse impacts of
the use and enjoyment of neighboring properties.
Hite
stated I too will be supporting this application, it is consistent with the intent and purpose of the
zoning ordinance and the use district in which the conditional use is located.
Spieler
stated you have addressed all the concerns and comments. You are also following all the rules
and laws that a liquor license imply. I will be supporting this.
Roszak
stated I will be supporting this as well.

A MOTION BY BLAHNIK SECOND BY HITE TO APPROVE THE RESOLUTION 12-10PC A
CONDITIONAL USE PERMIT TO ALLOW A RESTAURANT SERVING LIQUOR IN THE C-2
(GENERAL BUSINESS) ZONING DISTRICT SUBJECT THE LISTED CONTITIONS.
VOTE: Ayes, Spieler, Roszak, Hite and Blahnik. The Motion carried.

7. Announcements and Correspondence:

Rogness
presented updates from the June 4 City Council meeting. The City Council approved the
Bylaws for both the Planning Commission and the City Council. The amended changes were mostly in
regards to the hiring of the new City Attorney and changing the meeting schedules.
The City Council approved a resolution receiving the Markley Lake study. They also approve the CIC
Plat for Lakefront Plaza. Mary’s On Main will now be an owner occupied unit. The Plat Hickory Shores

4 Addition was approved. They also approved a resolution pursuant to the Orderly Annexation

Agreement for subareas 6.1, 6.2 and 8.3. Lastly the Preliminary Plat to be known as Maple Glen 4
addition was approved.
Blahnik
asked on the annexation areas do they each have their own well and septic?
Rogness
responded yes they do.
8. Adjournment:

VOTE: Ayes, Hite, Blahnik, Roszak, and Spieler. The Motion carried.
