RESOLUTION PROVIDING FOR THE VACATION OF DRAINAGE AND UTILITY EASEMENTS LOCATED
WITHIN JEFFERS POND 2 ADDITION
ND

WHEREAS, A petition by Ryland Homes, Inc. for the vacatio n of drainage and utility easements located in
Jeffers Pond 2 Addition has been duly presented to the City of Prior Lake, signed by the

owners of the property abutting the following described easement situated in the City of Prior
Lake, Scott County, Min nesota to wit:
Legal Description (Drainage and Utility Easements):
All Drainage and Utility Easements Lying Over, Under and Across Lots 1, 2, 10, 11, 12, 13, 14,
Block 1, JEFFERS POND SECOND ADDITION, according to the recorded plat thereof , Scott
Cou nty, Minnesota, as delineated and dedicated on said JEFFERS POND SECOND
ADDITION .
WHEREAS, Notice of the hearing has been duly published and posted in accordance with the applicable
Minnesota Statutes, and
WHEREAS, A Public Hearing was he ld on said petition on Monday, September 10 , 20 1 2 , in the Council
Chambers a t City Hall, 464 6 Dakota Street SE ; and
WHEREAS, The City Council then proceeded to hear all persons interested in said petition and persons
interested were afforded the opportunity to p resent their views and objections to the granting
of said petition; and
WHEREAS, New dr ainage and utility easements will be dedicated as part of the final plat for Jeffers Pond
6 Addition , so the existing drainage and utility easements are not neces sary for the

m aintenance of public utilities.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The City Council of Prior Lake has determined that the vacat ion of said easements would be in the public
interest.
3. The following condition of approval is determined:
a) The approval resolution vacating the drainage and utility easements across Lots 1, 2, 10, 11, 12, 13,
14, Block 1, Jeffers Pond 2 Addition shall be recorded by the applicant/developer with the Final Plat

of Jeffers Pond 6 Addition.

4. Pursuant to Minnesota Statues 412.851, the following described drainage and utility easements are hereby
vacated:

PASSED AND ADOPTED THIS 10 DAY OF SEPTEMBER , 20 12 .
