The easement was ranted for the purpose of locating, onstr ction�tallin and maintainingutility lines over, under and across the easement area. The .�- urpose of the utility easement was to provide a necessary utility connection between Sunray Court SPIV and Maple Drive SW, as well as provide a storm grater utility connection to the wetland located south of Maple Drive SII. A new drainage and utility easement will be dedicated with the final plat of Maple Glen Fourth Addition and therefore, the easement dedicated to the City of Prior Lake on September 27, 2005 is no longer necessary. Commissioner Comments andQuestions: Spieler asked for further explanation on the meaning of a utility and easement vacation. Specialist McCabe responded by showing some additional slides of the plat, and he further described where the current easements are and where the new ones will be dedicated. Blahnik stated that he will be supporting this vacation based on a _� r not Inconsistent with the 2030 Comprehensive Plan. Roszak stated that he will be supporting this as well. Hite stated that she will be supporting this; the vacation is consistent with the 2030 Comprehensive Plan. The new r plat of Jeffers Fond 6th addition dedicates the necessary easements. 2 Blahnik stated this is just a matter of procedure due to their reconfiguration of the lots, so they also need to reconfigure the easements as well. It is necessary vacate the existing ones and designate new easements with the now plat. He will be supporting this. Roszak stated that he echoes his fellow commissioners and will be supporting this as well. Minnesota State Statute 462.356 provides that all proposed real property acquisitions be reviewed by the Pianning Commission for consistency with the 2030 Comprehensive Land Use Plan. DISCUSSION: Minnesota State Statute 282.01 addresses the classification and sale of forfeited properties. Scott County Taxation Department notified the City on July 18, 2012 of two parcels that had been forfeited to the State of Minnesota due to non-payment of property taxes. (See Exhibit A On September 10, 2012, the City Council approved a resolution to hold these two parcels from public auction for further consideration, City Staff received the costs associated with the two forfeited parcels that were held from public auc- tion if we acquired them for a public purpose which includes right of war, park, wetland, storm grater or similar purpose. The City currently has easements over both of these properties for storm water management. By owning these properties, the City is in a better position to enforce encroachments on these wetlands and stormwater ponds. The Planning Commission's function is to review the proposed acquisitions to determine their com- pliance with the Comprehensive Plan. Section 2.2 "Goals, Objectives and Policies" of the 2030 Com- prehensive Land Use Plan provides guidance on "public and private land use, development, redeve- lopment and preservation of all lands and waters grit in the City." Minnesota State Statute 462.356 provides that all proposed real property acquisitions be reviewed by the Planning Commission for consistency with the 2030 Comprehensive land Use Plan. DISCUSSION: The City of Prior Lake has been awarded a Natural and Scenic AreGrant from the Minnesota De- partment of Natural Resources to assist with the purchase of the Finney property located north of CSAH 42, east of CSAH 21, and gest of Pike Lake Tail. The approximately 18 acre parcel is directly adjacent to Pike Dake and Pike lake Park. This property is high quality natural land with approximate- ly 1,545 feet of lakeshore and an additional 100 feet of shoreline on Prior geek where it flows out o the lake. The site is a crucial addition to the -acre Pike lake Natural Area property, which the DNF helped the Trust for Public land and the City of Prior lake purchase in Zoo. The second phase of the project will offer connectivity between the existing City -owned lands and protect and augment the investments made to date by the City and State. The Trust for Public Land (TPL), a nonprofit lard conservation organization that helps communities acquire land for natural areas and parks, has an option to purchase this important resource for public enjoyment. Contingent upon sufficient funding, the City of Prior Lake has agreed to acquire this land from TPL and provide permanent stewardship. Under the City's ownership and management, ger ent, the site will provide opportunities to protect wildlife habitat, improve water quality, preserve scenic viewsheds, and provide public access to a natural area in a community facing tremendous growth. On March 19, 2012, the City Council held a public hearing and approved a resolution supporting the grant application. The purchase price of the property i $843,500.
