A RESOLUTION APPROVING
A PURCHASE AGREEMENT WITH THE TRUST FOR PUBLIC
LAND FOR THE PURCHASE OF THE KINNEY PROPE R TY

WHEREAS, The Trust For Public Land has a purchase agreement with the Carolyn An n Kinney
Revocable Trust for the purchase of an 18 - acre parcel of land located on the north side of
Pike Lake and legally described as shown on Exhibit A to this resolution; and
WHEREAS, The Trust For Public Land has been working with the City of Prior L ake to obtain funding
for the purchase of this property; and
WHEREAS, The City of Prior Lake has been awarded a Natural and Scenic Area Grant for this
purpose ; and
WHEREAS, The City of Prior Lake has identified the following funding sources for the pur chase of the
property:
Funding Source Contribution
DNR Natural & Scenic Grant $ 393,500.00
Prior Lake Spring Lake Watershed District $ 100,000.00
City of Prior Lake Cash Contribution $ 350,000.00
Total $ 8 4 3,500.00
and
WHEREAS, The City will incur closing costs in an approximate amount of $5,000; and
WHEREAS, The City of Prior Lake Planning Commission found the acquisition of this property is
consistent with the 2030 Comprehensive Land Use Plan; and
WHEREAS, The City of Prior Lake and the Trust For Public Land wish to enter into a Purchase
Agreement to set forth the terms and conditions relating to the purchase of this property
NOW THEREFORE , BE IT HEREBY RESOLVE D BY THE CITY COUN CIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council enters into a Purchase Agreement with the Trust for Public Land , a copy of which was
before t he Council on September 24, 2012 .
3. The Mayor and Ci ty Manager are authorized to enter into a purchase agreement with the Trust for
Public Land for the purchase of the Kinney property .
4. The City funding source for this purchase shall be the Capital Park Fund Account #225 - 45040 - 510 .

5. The General Fund budget am endment is hereby approved to reflect a transfer of $350,000.00 plus
closing costs from the General Fund reserve to the Capital Park Fund.
6. An interfund loan of $493,500 is approved from the General Fund to the Capital Park Fund until the
proceeds from the Prior Lake Spring Lake Watershed District and DNR grant are received.

PARCEL 1:
That part of the North Half of the Southwest Quarter of Section 23, Township 115, Range
22, Scott County, Minnesota, described as follows:
Beginning at a point in the North line of said Southwest Quarter 1598.05 feet east of the
Northwest corner thereof; thence South 88 degrees 56 minutes 31 seconds East, assumed
basis for bearings, along said North line, 59 9.32 feet to the West line of the East 465.2 feet
of said North Half of the Southwest Quarter; thence South 0 degrees 43 minutes 14
seconds West, along said West line, 1313.06 feet to the South line of said North Half of the
Southwest Quarter; thence North 88 degrees 52 minutes 24 seconds West, along said
South line, 338.48 feet; thence North 0 degrees 56 minutes 02 seconds East 656.32 feet;
thence North 88 degrees 54 minutes 27 seconds West 268.18 feet; thence North 1 degree

basis for bearings, along said North line, 533.05 feet; thence South 1 degree 08 minutes
50 seconds West 326.48 feet; thence North 88 degrees 56 minu tes 31 seconds West
533.05 feet to the East line of the West 1065.00 feet of said North Half of the Southwest
Quarter; thence North 1 degree 08 minutes 50 seconds East, along said East line, 326.48
feet to the point of beginning.
PARCEL 3:
Together with a non - exclusive perpetual road easement for ingress and egress purposes
over the East 66.00 feet of the Southwest Quarter of the Southwest Quarter of Section 23,
Township 115, Range 22, Scott County, Minnesota, as set forth and described in the Quit
Claim Deed recorded as Document No. 199841 in the office of the County Recorder, as
