RESOLUTION PROVIDING FOR THE VACATION OF A PORTION OF THE DRA INAGE AND UTILITY
EASEMENTS LOCATED WI THIN MAPLE GLEN 3 ADDITION

WHEREAS, A petition for the vacation of a portion of the drainage and utility easements located in Maple
Glen 3 Addition has been duly presented to the City of Prior Lake, signed by the owners of

the property abutting the following described easement situated in the City of Prior Lake, Scott
County, Mi nnesota to wit:
Legal Description (Drainage and Utility Easements):
The West 750.00 feet of the North 35.00 feet of the South 180.00 feet of the Northeast Quarter
of the Southwest Quarter, and the West 35.00 feet of the South 145.00 feet of the North east
Quarter of the Southwest Quarter, and the North 200.000 feet of the West 35.00 feet of the
Southeast Quarter of the Southwest Quarter, All in Section 10, Township 114, Range 22 , Scott
County, Minnesot a.
WHEREAS, Notice of the hearing has been duly published and posted in accordance with the applicable
Minnesota Statutes, and
WHEREAS, A Public Hearing was he ld on said petition on Monday, August 27 , 20 1 2 , in the Council
Chambers a t City Hall, 464 6 Dakota Street SE ; and
WHEREAS, The City Counc il then proceeded to hear all persons interested in said petition and persons
interested were afforded the opportunity to present their views and objections to the granting
of said petition; and
WHEREAS, New dr ainage and utility easements will be dedi cated as part of the final plat for Maple Glen 4

Addition , so the existing drainage and utility easements are not necessary for the m aintenance
of public utilities.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
1. The above recit als are herein fully incorporated herein as set forth above.
2. The City Council of Prior Lake has determined that the vacation of said easements would be in the public
interest.
3. The following condition of approval is determined:
a)
The approval resolution vacat ing the drainage and utility easements across Maple Glen 3 Addition shall be recorded

by the applicant/developer with the Final Plat of Maple Glen 4 Addition.

4. Pursuant to Minnesota Statues 412.851, the following described drainage and utility easements are hereby
vacated:
