A RESOLUTION ADOPTING ASSESSMENTS FOR THE 201 2 UNPAID SPECIAL CHARGES

WHEREAS, P ursuant to proper notice duly given as required by law, which notice is affirmed
and ratified by Council direction herein given, the Council has met and heard
and passed upon all objections to the proposed assessments for the 201 2
Unpaid Special Charges .
NOW THEREFORE , BE IT HEREBY RESOLVE D B Y THE CITY COUNCIL O F PRIOR LAKE,
MINNESOTA
as follows:
1. The recitals set forth above are incorporated herein.
2. The proposed asse ssment for the 201 2 Unpaid Special Charges , a copy of which is attached
hereto and made part hereof, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein included is
hereby found to have benefited from the service provided by the City .
3. Assessments for Snow Removal, Weed Abatement, Delinquent Utility Charges and False
Alarms shall be payable pursuant to Minnesota Statute 429.101 and Section s 704.1003 and
806.301 of the City code in one (1) single installment payable in 201 3 . The single i nstallment
shall include the annual principal , a delinquent assessment administration charge of $30
plus interest calculated from the date of the adoption of the assessment resolution to the end
of 201 2 plus twelve (12) months of the next year and shall be ar interest at the rate of 3.98 %
per annum.
4. Oak Wilt Assessments shall be payable pursuant to Minnesota Statute 429.101 and Section
602.704 of the City code which provides that all assessments less than $1000 shall be
payable in one (1) single installment payable in 2013 and all assessments over $1,000 be
paid on an equal principal installment method extending over a period of five (5) years for
the abatement. The installment (s) shall include the annual principal, an assessment
administrative charge of $30 plus interest calculated from the date of the adoption of the
assessment resolution to the end of 2012 plus twelve (12) months of the next year and shall
bear interest at the rate of 3.98% per annum.
5. The City Manager shall submit a list of the costs for services the City has incurred for unpaid
utility bills, snow re mo val, mowing , false alarms and oak wilt abatement , as provided by law,
and shall file a copy of such proposed assessment in the office of the City Manager for
p ublic inspection.
6. T he owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property
including the delinquent assessment administration charge , with intere st accrued to the date
of the payment, except that no interest will be charged if the entire assessment is paid within
thirty (30) days, and the individual may at any time thereafter, pay to the City’s Finance
Director the entire amount of the assessment r emaining unpaid, excepting the installment
portion appearing upon the current year’s property tax statement.
7. The Finance Director shall forthwith transmit a certified duplicate of this assessment to the
County Auditor to be extended on the property ta x lists of Scott County. Such assessments
shall be collected and paid to the City in same manner as other municipal taxes.
8. The portion of the cost to be assessed against benefited property owners is declared to be
$ 9,576.03
