PRIOR LAKE PLANNING COMMISSION MINUTES
MONDAY, October 15, 2012
1. Call to Order:
Chairman Phelan called the October 15, 2012 Planning Commission meeting to order at 6:00
p.m. Those present were Commissioners, Blahnik, Phelan, Roszak, Hite and Spieler,
Community and Economic Development Director Dan Rogness, Planner Jeff Matzke
2. Approval of Agenda:
MOTION BY PHELAN, SECONDED BY SPIELER TO APPROVE THE OCTOBER 15, 2012
MEETING AGENDA AS PRESENTED.
VOTE: Ayes, Blahnik, Spieler, Hite, Roszak and Blahnik. The Motion carried.
3. Consider Approval of September 17, 2012 Meeting Minutes:
MOTION BY BLAHNIK, SECONDED BY PHELAN TO APPROVE THE SEPTEMBER 17, 2012
MEETING MINUTES.
VOTE: Ayes, Blahnik, Roszak, Hite, Phelan, and Spieler. The Motion carried.
4. Public Hearings:
A. #EP 12-122 STEVENSON REAR YARD SETBACK VARIANCE.
Bruce Stevenson is requesting
a Variance from the minimum rear yard setback in the R-1 (Low Density Residential) Zoning
District to construct an addition on his residential home. The property is located northwest of
Lakefront Park on lower Prior Lake off of West Ave.
Planner Matzke
presented Bruce Stevenson, owner of the subject property, is requesting a
variance from the minimum rear yard setback of a property in the R-1 (Low Density Residen-
tial) located at 15747 West Avenue SE. The property is located along the east-ern shores of
Upper Prior Lake, north of County Hwy 21. The proposed variance is a 9.7 foot variance from
the required minimum 25 foot rear yard set-back. There is a 10 foot utility easement behind
the subject lot. Since that easement is in place if variance is granted there will still be
significant building separation between the subject property and home behind.
Commissioner Questions:
Hite
asked the utilities that are currently in the easement behind the home, they will not be
impacted if this variance is granted?
Planner Matzke
responded that is correct staff looked into the location of the utilities in the
easement and there will not be any interference.
Blahnik
asked the city ordinance allows for 30 percent impervious surface, the survey states
the impervious surface is at 40.2, is it currently at 40.2?

Planner Matzke
responded yes it is currently at 40.2. The City’s ordinance allows for property
owners to move around or maintain their current non-conforming impervious surface. when
adding additions people will often remove hard surface elsewhere to allow for the addition of
hard surface somewhere else.
MOTION BY SPIELER SECOND BY ROSZAK TO OPEN THE PUBLIC HEARING AT 6:15

VOTE: Ayes, Blahnik, Spieler, Hite, Roszak and Blahnik. The Motion carried.

MOTION BY HITE SECOND BY BLAHNIK TO CLOSE THE PUBLIS HEARING AT 6:16 PM
VOTE: Ayes, Blahnik, Spieler, Hite, Roszak and Blahnik. The Motion carried.
Commissioner Comments:
Roszak
stated his support and that it is consistent with the Comprehensive plan.
Hite
stated her support of the variance do to the small size of the lot and topography of the
area.
Spieler
stated his support for the variance
Blahnik
stated his support, the variance does meet the practical difficulties criteria
Phelan
stated support for the variance, it is consistent with the 2030 Comprehensive plan and
meets the practical difficulties criteria.
MOTION BY PHELAN SECOND BY BLAHNIK TO APPROVE A RESOLUTION APPROVING
A VARIANCE FROM THE REQUIRED MINIMUM REAR YARD SETBACK TO ALLOW FOR A
BUILDING ADDITION TO A RESIDENTIAL PROPERTY WITHIN THE R-1 ZONING
DISTRICT.
VOTE: Ayes, Blahnik, Spieler, Hite, Roszak and Blahnik. The Motion carried.

Council Meetings.
8. Adjournment:
MOTION BY BLAHNIK, SECONDED BY SPIELER TO ADJORN THE MEETING.
VOTE: Ayes, Blahnik, Hite, Roszak, Phelan, and Spieler. The Motion carried.
The meeting adjourned at 6:24 p.m.
The Planning Commission adjourned to a work session to discuss possible ordinance
amendments and areas related to the 2030 Comprehensive Plan.
