History: Under Prior Lake City Code, the City collects two fees - park dedication and park support - to fund park land acquisitions, development and redevelopment. Park dedication is collected from the developer through the development agreement. It may consist of up to 10% of the gross property of a subdivision in land dedication, or a cash dedication of 10% of the property based upon a $13,000 per acre value of raw land. The dedication can also be cash only or a combination of land dedication and cash. A park support fee is also collected . on each building permit based upon $850 per residential unit. The City Attorney has previously reviewed City fees and recommended that studies be undertaken with respect to certain of the fees to assure that there is a strong correlation between the fees collected and the actual City need. Current Circumstances: We have not adjusted our park fees for some years in anticipation of conducting a study. As the Council is aware, we are in the process of completing such a study regarding our storm water acreage fee. I am recommending that the City Council authorize the preparation of a Request for Proposals to conduct a park fee study. While each proposer may have a slightly different approach, all will use the City's Comprehensive Park and Trail plan to define park and trail needs in developing areas. From the Comprehensive Plan and discussions with City representatives, an estimated number of park and trails and their costs can be estimated. From that a fee system can be developed. While I expect that the total fee required will be similar to our combined fees, I believe the administrative process used to collect the fees is likely to change. Conclusion: The park dedication and support fees are the primary means for the City to develop its park and trail system. The completion of a study will assure that a sufficient amount is collected to develop the park and trail system. The City Council briefly discussed this topic at a Capital Improvement Program workshop, My impression is that the Council concurs that such a study is appropriate. The cost for this study may vary from $15,000 to $50,000 depending upon vendor and scope of work. We hope to encourage numerous vendors to 16200 Eagle Creek Ave. S.L Prior Lake. The cost for the study should be paid by the Capital Park Fund which is the account where park dedication and support fees are placed. I have generally discussed this project with representatives of the Twin Cities Builders Association. They confirm that this subject is a high priority. They have suggested that I place any funding request in writing for their consideration. Such action can be taken once proposals have been solicited. ALTERNATIVES: (1) Authorize the preparation of RFPs and solicitation of proposals. RECOMMENDED MOTION: (2) Take no action pending receipt of additional information. Alternative (1). A motion and second to authorize staff to prepare Request for Proposals and solicit proposals for a Park Dedication and Park Support Fee Study.
