Call to Order and Pledge of Allegiance. Those present were President Barsness, Commissioners
Criego and Mader, Executive Director Boyles, Planning Director Rye and Recording Secretary Meyer.
Consider Approval of Minutes from the June 19, 2000 Regular Meeting.
MOTION BY CRIEGO, SECOND BY MADER TO APPROVE JUNE 19, 2000 REGULAR MEETING
MINUTES.
VOTE: Ayes by Barsness, Criego and Mader, the motion carried.
CONSENT AGENDA: NONE.

OLD BUSINESS:
Consider Report on Modification of the Tax Increment Financing Plan and Budget for Districts
1-1, 1-2 and 2-4.
BOYLES: Advised that the City Council would consider amending development districts 1 and 2 which
incorporate TIF districts 1-1, 1-2 and 2-4. Districts 1-1 and 1-2 are downtown districts, and district 2-4
is in the Park Nicollet area. The amendment is necessary to separate the downtown districts from the
Park Nicollet district within the budget so that funding can be set to provide the necessary funding for
acquisition of property, relocation costs, and other potential costs associated with the downtown
redevelopment.
Consider Report on Initiation of Eminent Domain Proceedings for Property at 16675 Franklin
Trail.
BOYLES: Advised that the City Council would also consider acquiring the TJ Towing property at 16675
Franklin Trail in order to eliminate blight and potential public health and safety hazards. Although the
City desires to reach a negotiated sale with the owner, it may be necessary to acquire the property
through eminent domain proceedings. By amendment TIF budget as referred to in the earlier report,
the necessary funds could be allocated for the property acquisition. Advised that no action is necessary

by the EDA, but a recommendation could be forwarded to the Council.
BARSNESS: Asked how the initial number came about and how the division of the budget was
determined.
BOYLES: Advised that the division was made based upon the staff's estimates of what costs may be
incurred. Also noted that there is flexibility to re-modify those budgets as experience shows. There is a
requirement by law, however, to distinctly separate the budgets.
MADER: Asked if state statute is what is requiring the budget to be split, and if there is a timeline.
Commented that it might be more appropriate to see what proposals there may be in each of the
areas, before making a division of the funds.
RYE: Confirmed that state statute is now requiring that the district budgets be split, and that initial cost
estimates appeared to be well within the limits expressed in the budget. Advised that the split needed
to be made, but there was no timeline.
BOYLES: Advised that the rationale was to assure that there was no question of the purpose the
funding was placed in that budget.
MADER: Asked for clarification that the funds can clearly be re-allocated at our discretion in the future.
Concerned with making an arbitrary split.
Boyles: Confirmed and advised that staff had been working closely with the City's bond counsel to
assure that this procedure was appropriate.
MOTION BY MADER, SECOND BY CRIEGO, TO RECOMMEND TO THE CITY COUNCIL
APPROVAL OF THE DIVISION OF THE TAX INCREMENT FINANCING PLAN AND BUDGETS FOR
DISTRICTS 1-1, 1-2 and 2-4, AND THE INITIATION OF EMINENT DOMAIN PROCEEDINGS FOR
THE PROPERTY LOCATED AT 16675 FRANKLIN TRAIL.
Vote: Ayes by Barsness, Criego and Mader, the motion carried.
Consider Authorizing the Planning Commission to Conduct an Informational Meeting on the
Downtown Redevelopment Guide.
BOYLES: Advised that the EDA should consider whether to conduct an informational meeting for
Planning Commissioners so that they may have an opportunity to hear a full presentation by the
consultant and to provide input as this process proceeds.
BARSNESS: Suggested the City Council do the same.

PLANNING GUIDE TO THE PLANNING COMMISSION AND CITY COUNCIL FOR ADDITIONAL

SUBJECT:
DISCUSSION: The draft of the Downtown redevelopment guide was distributed to
members of the EDA, City Council and Planning Commission for their review and
comment. The Planning Commission discussed the report at the July 24th meeting and
concluded it was acceptable as a guide to development activities in the Downtown. The
Council heard a presentation from Mark Koegler at the August ih meeting but took no
formal action at that time. The EDA may wish to formally request the Council have a
discussion on the Guide at their September 5th meeting with the idea of moving forward
toward the adoption of the Guide.
On related matters, staff has been meeting with a prospective tenant for the old library.
Some improvements being contemplated for the building include a new window on the
County Road 21 side of the building, awnings and improvements to the ventilation
system.
Staff has met with the prospective developers of Block 9 at the comer of Main and
Dakota to discuss the issues arising from development of that site. The developers were
encouraged to develop more definite numbers for the cost of development and to define
what types and level of assistance they would be requesting from the City.
The Senior Care Overlay zoning district was recommended for arproval by the Planning
Commission and is scheduled for Council action on September 5t .
ACTION REQUIRED: Motion to request Council action to move the Downtown
Redevelopment Guide forward in the approval process.

AGENDA ITEM: CONSIDER APPROVAL OF RESOLUTION OO-XX APPROVING RELEASE OF
DEVELOPMENT AGREEMENT BY AND BETWEEN THE EDA AND ENIVID
REALTY CORPORATION DATED APRIL 2,1990.
DISCUSSION: History:
In 1990, the City of Prior Lake through its Economic Development Authority
(which was the City Council) entered into a development agreement with Enivid
Realty Corporation. The development agreement contemplated the construction
of a new grocery store (County Market) behind the Priordale Mall on what has
now become the Post Office site (Lots 1 and 2, Block 1, Enivid First Addition).
The development was never completed.
Current Circumstances:
The Post Office desires to acquire these lots from Enivid to construct a 20,000
square foot post office facility. Their research has identified this agreement and,
as a housekeeping measure, they have asked the City to release the agreement.
The City staff and attorney have reviewed the documents and the City is in a
position to release it.
Conclusion:
Since the City supports the construction of the post office facility and because the
development agreement is an impediment to consummating the sale, the EDA
should release the agreement if there are no issues once a review of the
document is complete.

RELEASE
FOR VALUABLE CONSIDERATION, the receipt and sufficiency of which are acknowledged, the City
of Prior Lake, a Minnesota municipal corporation, through the authority granted by its City Council, on
behalf of itself and its successors and assigns, hereby releases and quit claims all interest held by
virtue of that certain Development Agreement by and between the EDA and Enivid Realty Corporation
dated April 2, 1990, recorded April 13, 1990 as Document No. 269322, and as amended and restated
by Document No. 293225, in the office of the Scott County Recorder against the following described

GOALS
Develop a proactive strategy for future economic development activities which will
build on the efforts to date and further enhance the City's reputation as a place to
do business.
Continue to explore redevelopment opportunities in the Downtown area.
Supportive private as well as public redevelopment plans in the Downtown area.
Develop a plan to capitalize on traffic generated by Shakopee Mdewakanton Dakota
Community and The Wilds.
Develop promotional materials cooperatively and create a dialogue with the Mystic Lake
Casino and The Wilds Golf Course.
Expand Business Office Park
· Facilitate development of 58 acre Deerfield property.
Inventory and review existing commercial and industrial properties and develop a
position on development possibilities.
· Develop a recommendation on extension of utilities to old industrial park.
· Explore the relationship between housing availability and business development.
· Convert Tax Increment Policy to a more general document which addresses other
financial incentives and which addresses likely types of development and
redevelopment.
Explore redevelopment opportunities for the Priordale Mall/Park Nicollet site to
facilitate expeditious redevelopment/development.
· Work with private sector developers to complete the Ring Road from Franklin Trail
to Tower Street. (November for Official Map)

the streetscape public improvements. Insure the study addresses the old library and
other City property Downtown as well as public relations necessary for effective
redevelopment. (August 2000)
. Revise and advertise the improved access to Prior Lake from 1-35 via CSAH 21,
bringing traffic through downtown Prior Lake. (Completed)
. Sell 4.5 acre parcel
. Arrange for two EDA members to interview all Waterfront Passage businesses and
other large businesses in the City for retention purposes. (June)
. Have the Chamber of Commerce provide a Business Retention report to the EDA .
when interviews are complete.
. Cooperate with the Chamber of Commerce to follow up on any issues arising from
their interviews.
. Discuss recruitment at joint meeting with Planning Commission and City Council.
