GoS HISTORY DATE: AGENDA #: PREPARED BY: SUBJECT: Construction of Linden Circle is included in the 2000 Capital Improvement Program. It is one of the few remaining gravel streets within the City. At the July 17, 2000 Council Meeting, the Council approved plans and specifications and authorized the advertisement for bids for Linden Circle Improvements (Project 14-00). This project was petitioned for by the Linden Circle property owners and subsequently placed in the Capital Improvement Program. Four easements were needed to complete the project. All easements have now been granted by the respective property owners. At the July 17th council meeting, staff recommended assessing the project on a unit basis and holding the assessment hearing prior to awarding a contract. The unit basis assessment means each of the twelve properties, regardless of front footage will have the same assessment. CURRENT CIRCUMSTANCES Bids for the Linden Circle Improvements were opened on August 1, 2000. The results are as follows: CONTRACTORS Valley Paving, Inc. Northwest Asphalt, Inc. Hardrives, Inc. Bituminous Roadways, Inc. BID AMOUNT $73;888.75 $84,180.20 $99,450.50 $109,623.10 1. The bid consists of $10,125.00 for watermain and storm sewer improvements proposed to be paid through Trunk Reserve. The remainder of the project cost, 16200A~oGralilkmwe. In accordance with the Assessment Review Committee's recommendations, staff recommends to assess the Linden Circle properties on a unit basis and to conduct the assessment hearing on September 5, 2000. The proposed unit rate based on the low bid is $6,907.74/unit. This amount is comparable with the estimated unit assessment from the feasibility which was $6,533.08/unit. Staff recommends that the City Council declare the costs to be assessed, order preparation of the assessment roll, and establish the Assessment Hearing date as September 5, 2000. The City Council can elect whether or not to proceed with the project following the special assessment hearing. If the proposed assessments are adopted after an assessment hearing, financing of the improvements will be as follows: Funding Source Amount Assessments $82,892.87* Trunk Reserve $10,125.00 Project Total $93,017.87 *The numbers shown above include 30% indirect costs for design, survey, inspection, administration, and financing. The alternatives are as follows: 1. Approve Resolution OO-XX declaring the costs to be assessed, and ordering the preparation of the proposed assessment roll for Projects 14-00 Linden Circle Improvements and approve Resolution OO-XX establishing September 5,2000 for the assessment hearing. 2. Deny the resolutions for a specific reason and provide staff with direction. 3. Table this item for a specific reason. A motion and second to adopt Resolution OO-XX declaring costs to be assessed and ordering preparation of the proposed assessment roll and Resolution OO-XX setting the assessment hear[i.n. date for Linden Circle Improvements for September 5,2000. i RESOLUTION OO-XX RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENTS FOR PROJECT 14-00 LINDEN CIRCLE IMPROVEMENTS MOTION BY: SECOND BY: WHEREAS, bids have been received and costs have been determined for the improvement of Linden Circle Project 14-00 and the contract price for such improvements is $73,888.75 and the expenses incurred or to be incurred in the making of such improvements amount to $19,129.12, so that the total cost of the improvements will be $93,017.87. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The portion of the cost of such improvements is to be paid by the City is hereby declared to be $10,125.00 to be drawn from the Trunk Reserve, and the portion of the cost to be assessed against benefited property owners is declared to be $82,892.87. 2. Assessments shall be payable on an equal principal installment method extending over a period of 10 years for street improvements. The first installment shall be the annual principal plus interest calculated from the public hearing date to the end of this year plus twelve months of the next year and shall bear interest at the rate of a minimum of 8% per annum from the date of the adoption of the assessment resolution. 3. The City Manager, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvements against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection. 4. The City Manager shall upon the completion of such proposed assessment, notify the Council thereof. Passed and adopted this 7th day of August, 2000. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. A hearing shall be held on the 5th day of September, 2000, in City Council Chambers at 7:30 P.M. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given the opportunity to be heard with reference to such assessment. 2. The City Manager is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Finance Director, except that no interest will be charged if the entire assessment is paid within 30 days from the adoption of the assessment. He may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid, excepting the installment portion appearing upon the current year's property tax statement. Council Chambers at Fire Station No. I, 16776 Fish Point Road, on Tuesday, the 5th of September, 2000 at 7:30 P.M. to consider the assessment of the following street: PROJECT DESCRIPTION LINDEN CIRCLE Reconstruction of Linden Circle including grading, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work. The area proposed to be assessed is every lot, piece, and parcel benefiting from said improvements, whether abutting or not, within the following described areas: Linden Circle east of Northwood Road within the northwest quarter of Section 3, Township 114 North, Range 22 West, Scott County Minnesota. Specific property descriptions included in the above described area, but not inclusive, are as follows: Northwood Addition Har Wil Lew Addition The estimated total of the assessment roll is $82.892.87. The Council proposes to proceed under the authority granted by Chapter 429 M.S.A. The proposed assessment roll is on file in the City Manager's office and any written or oral objections will be considered at the public hearing. No appeal may be taken as to the amount of any assessment unless a signed, written objection is filed with the City Manager prior to the hearing or presented to the presiding officer at the hearing. The City also has adopted a deferred assessment ordinance whereby the City Council may defer the payment of special assessments for those individuals who are permanently disabled or have attained the age of 65 or older. Guideline criteria and applications are available at City Hall. Applications must be made within 30 days following the adoption of the assessment roll by the City Council.
