1. Call to Order:
Commissioner Criego called the May 12, 2003, Planning Commission meeting to order at
6:30 p.m. Those present were Commissioners Atwood, Criego, Lemke and Ringstad,
Planning Coordinator Jane Kansier and Recording Secretary Connie Carlson.

The Minutes fi:om the April 28, 2003, Planning Commission meeting were approved as
presented.

Commissioner Criego read the Public Hearing Statement and opened the meeting.
A. Cases #03-034 and 03-035 Shamrock Development is requesting an
Amendment to The Wilds PUD to remove 8 acres - Outlots I and J and Rezone
from Planned Unit Development (PUD) to High Density Residential (R-4).
Planning Coordinator Jane Kansier presented the Planning Report on file in the office of
the City Planning Department.
Shamrock Development has filed an application for an amendment to The Wilds Planned
Unit Development and for a rezoning fi:om The Wilds PUD to R-4 (High Density
Residential) on approximately 8 acres of property located on the east side of CSAH 83,
1//4 mile south of CSAH 42, and directly north of Wilds Parkway. The proposal removes
the 8 acres from the PUD and rezones the property to R-4.
This property is presently zoned C-4 PUD (Low Density Residential) and C-4 (General
Business-The Wilds Planned Unit Development) and is designated as C-HG (Hospitality
General Business) on the 2020 Comprehensive Plan Land Use Map. The Planning
Commission recommended approval of a request to amend the Comprehensive Plan for

this site to R-HD (High Density Residential) on April 28, 2003. The City Council will
consider the Comprehensive Plan amendment on May 19, 2003.
The Wilds original PUD plan identified this area for commercial uses, specifically a
hotel. This site was also the location of the original sales building, which has since been
removed, for the development. At this time, the applicant is planning to develop these 8
acres in conjunction with the property to the north in The Wilds North, akeady planned
for High Density Residential uses.
Staff recommended approval of the Amendment to The Wilds PUD Plan and the
Rezoning from PUD to R-4 as requested.
There were no comments from the public.
Comments from the Commissioners:
Lemke: · Agreed with staff- the property across the road on County Road 83 is high
density as well.
· It is appropriate, will support.
Atwood, Ringstad & Criego: · Agreed with staff.
· Support the Amendment, it falls in line with the Comprehensive Plan.
MOTION BY LEMKE, SECOND BY ATWOOD TO RECOMMEND APPROVAL OF
THE AMENDMENT TO THE WILDS PUD PLAN TO REMOVE THE 8 ACRES
IDENTIFIED AS OUTLOTS I AND J, THE WILDS.
Vote taken indicated ayes by all. MOTION CARRIED.
MOTION BY LEMKE, SECOND BY ATWOOD TO RECOMMEND APPROVAL TO
THE WILDS PUD PLAN AND THE REZONING FROM PUD TO R-4.
Vote taken indicated ayes by all. MOTION CARRIED.
This item will go before the City Council on June 2, 2003.
B. Case #03-037 Consider and Amendment to Section 1004.1000 of the
Subdivision Ordinance requirements pertaining to parkland dedication.
Planning Coordinator Jane Kansier presented the Planning Report on file in the office of
the City Planning Department.

The purpose of this public hearing is to consider an amendment to the Subdivision
Ordinance pertaining to parkland dedication requirements. This amendment was initiated
by the City Council on April 7, 2003.
In January, 2001, the City conducted a study to determine the appropriate park and trail
dedication fees. In that year, the City established a dedication fee of $1,685.00 per unit
for residential development and $3,550.00 per acre for commercial development. This
fee was based on land values and the cost to acquire and develop new parks.
Due to the dramatic change in Prior Lake in the last 2 years, the City hired a consultant,
Ingraham and Associates to update the park study to assure that it is appropriate and the
fees are adequate to fund the improvements for which it is collected.
The use of net area in this calculation is consistent with the way in which other
development fees are calculated. The higher parkland dedication fee was also based on
the use of net area. The staff recommended approval of this request.
Ringstad questioned if this applies to just commercial property. Kansier explained that it
applies to all development.
Atwood asked for an explanation of the amount versus reducing the area. Kansier
responded it is a more equitable way to factor the fees. It will allow the City to build a
fired not only to approve parks but to have a fund to purchase parkland.
Lemke questioned the net increase to the City - Kansier said it would be a net increase in
dollar amount of land but it does decrease the amount of parkland from any single
subdivision. Staff is going to be very picky on what they accept for dedication purposes.
Lemke questioned if this is similar to other cities parkland dedication. Kansier responded
the 10 percent is generally accepted number. The developers are aware of this method of
calculation. It is a proof positive method. Everyone can understand how it is done.
There were no comments from the public.
MOTION BY RINGSTAD, SECOND BY ATWOOD, RECOMMENDING
APPROVAL OF ORDINANCE NO. 03-XX AMENDING SECTION 1004.1000 OF
THE PRIOR LAKE CITY CODE AS RECOMMENDED BY STAFF.
Vote taken indicated ayes by all. MOTION CARRIED.
This will go before the City Council on June 2, 2003.
6. Old Business:
Kansier gave an update on the bluff impact zone issue before the City Council on May 5,
with a slight language change. The language clarified the intent of the ordinance stating

it was not intended to allow someone to essentially tear everything down and rebuild in
the same location. That will take away some of the concern of tearing down walls and in
the event the City is ever challenged, it will state the exact intent of the ordinance.

regular planning commission night.
