History At its August 7, 2000 meeting the City Council approved a request to declare two vehicles; a 1993 Sun Voyager Motor home, and a 1999 Arctic Cat snowmobile, as surplus to City needs and authorized the disposal of each. The Council will recall that these vehicles had been acquired through various forfeitures set forth in State Statute. According to Statute, the disposition options for such forfeited property include keeping the property for use by law enforcement and the sale of such property. As per ordinance, the vehicles were advertised in the Prior Lake American and sealed bids were accepted until 1 0:00 A.M. on Tuesday, September 5,2000. Current Circumstances Three bids were received for the motor home, and four bids were submitted for the snowmobile. The high bids are as follows: $20,100.00 for the motor home $ 2,951.00 for the snowmobile $23,051.00 As per Minnesota State Statute, 609.5315, subd. 5, "The money or proceeds from the sale of forfeited property, after payment of seizure, storage, forfeiture, and sale expenses, and satisfaction of valid liens against the property, must be distributed as follows: (1) 70 percent of the money or proceeds must be forwarded to the appropriate agency for deposit as a supplement to the agency's operating fund or similar fund for use in law enforcement; 1649.Q.~~~~MW@C~~enJOOm- Lake, Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER ALTERNATIVES: RECOMMENDED MOTION: REVIEWED BY: (2) 20 percent of the money or proceeds must be forwarded to the county attorney or other prosecuting agency that handled the forfeiture for deposit as a supplement to its operating fund for similar fund for prosecutorial purposes; and (3) the remaining ten percent of the money or proceeds must be forwarded within 60 days after resolution of the forfeiture to the state treasury and credited to the general fund. . ." 1. Authorize the acceptance of the high bids for the sale of each of the surplus pieces of equipment identified above by adoption of the attached resolution and the distribution of the proceeds as outlined in State Statute. 2. Reject one or both of the bids and direct staff accordingly. Motion and second to adopt Resolution OO-XX, accepting the bids for the sale of surplus city uipment to the highest bidders. Second By: WHEREAS, the City has obtained through various forfeitures as provided under State statutes one 1993 Sun Voyager motorhome and one 1999 Artic Cat snowmobile; and WHEREAS, the City Council at its August 7, 2000 meeting, declared both pieces of equipment surplus to City needs and authorized the solicitation of bids for the sale of each; and WHEREAS, three bids were received for the motorhome and four bids for the snowmobile as shown below: 1993 Sun Voyager Motor Home Bidder Amount ! The sale of the 1993 Sun Voyager motorhome is authorized to Jon Donovan in the amount of $20,100. 2. The sale of the 1999 Artic Cat snowmobile is authorized to Chris Zweber in the amount of $2951. 3. The City staff is directed to distribute these proceeds to the County and State in accordance with Minnesota Statutes Section 609.5315. PASSED AND ADOPTED THIS 18TH DAY OF SEPTEMBER, 2000.
