AWARDING THE CONTRACT FOR THE BAND SHELTER AT LAKEFRONT
PARK
DISCUSSION: Historv: The purpose of this agenda item is to award the bid for the construction
of the band shelter at Lakefront Park. At the June 19, 2000 meeting, the City
Council authorized staff to advertise for bids based on the following estimates
and information provided by staff:
$30,000 for band shelter materials (city would supply shingles)
$15,000 for labor
$ 2,000 for wiring and lights
$ 2,000 for wrapping support beams in stone
$ 1.000 for storage area for folding chairs and music stands
$50,000 total estimate
When preparing the final specifications, staff discovered that the plans provided
to the City Council on June 19, 2000 did not include a 30' high by 11' wide sound
wall that would be located at the rear of the band shelter. The band director of
the Prior Lake Windjammers advised city staff that the wall is needed for
acoustical reasons so that sound projects out the front of the shelter. Staff also
believed that the costs for the column masonry would be higher than the
estimated cost of $2,000. Subsequently, the sound wall and column masonry
were included as alternates to the base bid. One other change from the June 19,
2000 staff report was made and that was to have the contractor provide the
shingles rather than the City.
The advertisement for bids was published, and the City received responses from
nine vendors.
Current Circumstances: On September 7, 2000 city staff conducted the formal
bid opening. We received the following three bids with Cannon Construction of
Cannon Falls, MN being the low bidder. .

The plans and specifications did not provide for wiring and lights. The wiring will
be contracted out to an electrician during the construction of the shelter, and city
crews will construct the shed. The estimated costs are $2,000 for the electrical
and $1,000 for the shed. Therefore, the total cost for the band shelter project is
$54,084.
Cannon Construction stated their construction completion date is April 15, 2001.
ISSUES:
There are no outstanding issues regarding the band shelter at this time~ Parks
Supervisor AI Friedges spoke with a representative of Cannon who assured him
that he can meet the City specifications at the quoted price. Cannon
Construction was the contractor for the Lakefront Park pavilion and did a
satisfactory job.
FINANCIAL IMPACT:
The City entered into an agreement with the Lion's Club who intend to contribute
$30,000 toward the cost of this project. They have made their first installment of
$10,000 which will go towards payment to the contractor when the band shelter is
completed. The remaining $41,084 and the $3,000 for the costs of electrical and
a storage shed will be expended from the Parks and Library Referendum Fund
for a total amount of $43,084.
CONCLUSION: Staff recommends that the City Council award the band shelter contract to
Cannon Construction in the amount of $51,084. Staff also recommends that
Council authorize an amount not to exceed $3,000 for the electrical and storage
shed.
ALTERNATIVES: (1) Approve Resolution OO-XX Authorizing the Award of Bid for the Lakefront
Park Band Shelter to Cannon Construction for the total cost of $51.084 and To
Authorize Staff to Expend an amount not to exceed $3,000 for electrical and a
storage shed.
(2) Table this agenda item.
(3) Deny this agenda item.

A RESOLUTON ACCEPTING BIDS AND AWARDING THE
CONTRACT FOR THE LAKEFRONT PARK BAND SHELTER

WHEREAS,
the Prior Lake Lions Club has agreed to contribute a total of $30,000 for the construction
of a band shelter at Lakefront park and has contributed $10,000 to date; and
WHEREAS,
the City Council approved the plans and specifications and authorized advertisement for
bid for the construction of said band shelter at an estimated cost of $50,000; and
WHEREAS,
on September 7, 2000, pursuant to the advertisement for bids for said band shelter, the
following bids were solicited, received and tabulated as follows:

WHEREAS, funds have been designated in the Parks and Library Referendum Fund to pay for said
band shelter less the $10,000 received to date from the Lions Club.
Now THEREFORE, be it resolved by the City Council of the City of Prior Lake that the following are
hereby adopted:
1. The contract for the construction of the Lakefront Park Band Shelter is hereby awarded to Cannon
Construction at a cost not to exceed $51,084; and
2. The Mayor and City Manager are hereby authorized to execute the City's standard construction
contract on behalf of the City; and
3. The City Manager is hereby authorized to return bid securities submitted with the proposals to the
vendors following the execution of the contract; and
4. The City staff in accordance with State Statutes and City Purchasing Policy is authorized to
undertake the completion of the electrical work and storage shed associated with the band shelter
in an amount not to exceed $3,000; and

5. City staff is directed to pay for the band shelter and electrical and storage shed costs as follows:
$10,000 from the Capital Park Fund (Lions Club donation) and $44,084 from the Park and Library
Referendum Fund.
