Baptist Church MEETING DATE: AGENDA #: PREPARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT OCTOBER 2,2000 tOD JANE KANSIER, PLANNING COORDINATOR DON RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING AN AMENDMENT TO THE 2020 COMPREHENSIVE PLAN FOR PRIOR LAKE BAPTIST CHURCH ON THE PROPERTY LOCATED AT 5680 AND 5690 CREDIT RIVER ROAD (Case File #00-064) History: On September 5, 2000, the City Council approved an application for a Zone Change for the property located at 5680 and 5690 Credit River Road from the 1-1 (General Industrial) District to the R-1 (Low Density Residential) District. This property is the site of the Prior Lake Baptist Church and a single family home. When the Planning Commission considered the rezoning on August 14, 2000, the Commission recommended approval of the rezoning, and, at the same time, the Commissioners initiated an amendment to the 2020 Comprehensive Plan Land Use Plan to designate this property for Low to Medium Density Residential uses. This property is presently zoned R-1SD (Low Density Residential, Shoreland District), but is designated as P-I (Planned Industrial) on the 2020 Comprehensive Plan Land Use Map. In order to ensure the designation and zoning of this property are consistent with one another, as required by Minnesota Statutes, the Planning Commission initiated this amendment to the Comprehensive Plan. The Planning Commission considered this proposal at a public hearing on September 11, 2000. The Planning Commission voted to recommend approval of the proposed Land Use Plan Amendment. A copy of the draft minutes of the September 11, 2000 meeting is attached to this report. Current Circumstances: Adjacent to this site on the east is vacant land, zoned R-l and planned for Low to Medium Density Residential Uses. To the north and west are industrial buildings, zoned 1-1 and planned for Industrial uses. Thp T~!W(I~. This property is designated for Planned Industrial uses on the 2020 Comprehensive Plan Land Use Map. The existing use is inconsistent with the Comprehensive Plan Land Use designation. On September 5, 2000, the City Council approved the rezoning of this property to the R-1 district. The proposed R-L/MD designation is consistent with this district. Minnesota Statutes require the zoning of a property be consistent with the Comprehensive Plan Land Use Map designation. rnnr'II~;nn. Approval of this request may facilitate the development of this property. The City Council has three alternatives: 1. Adopt a Resolution approving the proposed Comprehensive Plan Amendment to the R-L/MD designation as recommended by the Planning Commission. 2. Direct the staff to prepare a resolution with findings of fact denying the proposed Comprehensive Plan Amendment to the R-L/MD designation. 3. Continue the review for specific information or reasons per City Council discussion. Alternative # 1. A motion and second to adopt a Resolution approving the Comprehensive Plan Amendment to designate this property as R- L/MD is required. 1:\OOfiles\OOcompam\OO-064\00064cc.doc Page 2 ,o~ RESOLUTION oo-~ RESOLUTION APPROVING A PROPOSED AMENDMENT TO THE 2020 COMPREHENSIVE PLAN LAND USE MAP FOR PROPERTY LOCATED AT 5680 AND 5690 CREDIT RIVER ROAD MOTION BY: SECOND BY: WHEREAS, the City of Prior Lake Planning Commission initiated an amendment to the City of Prior Lake 2020 Comprehensive Plan Land Use Map from the P-I (Planned Industrial) designation to the R-UMD (Low to Medium Density Residential) designation for the property legally described as follows: That part of the East 3/4 of the Southeast Quarter (E 3/4 of SE 1/4) of Section 1, Township 114, Range 22, Scott County, Minnesota, described as follows: Commencing at the Southeast corner of said Section 1; thence on an assumed bearing of N 01021'00" W, along the line between the Southeast corner and the Northeast corner of said Section 1 i",a distance of 1251.72 feet; thence at right angles S 88039' W, a distance of 1875.73 feet; thence S 6011 '30" W a distance of 84.66 feet to the East line of the West 30.0 feet of the East 3/4 of the SE 1/4 of said Section 1, said point being the actual point of beginning of the property to be described; thence N 86011 '30" E, a distance of 514.66 feet; thence bearing South a distance of 704.31 feet to the center line of County State Aid Highway #12; thence N 63037'56" W along the center line of said Highway #12 a distance of 566.47 feet to the East line of the West 30.0 feet of the East 3/4 of the Southeast 1/4 of said Section 1; thence N 0049'11" W along said East line of the West 30.0 feet of the East 3/4 of the SE 1/4 of said Section 1, a distance of 418.59 feet to the point of beginning. and WHEREAS, legal notice of the public hearing was duly published and mailed in accordance with Minnesota Statutes and Prior Lake City Code; and WHEREAS, the Planning Commission conducted a public hearing on September 11, 2000, for those interested in this request to present their views; and WHEREAS, on September 11, 2000, the Planning Commission recommended approval of the proposed amendment to the Comprehensive Plan on the basis the R-UMD designation is consistent with the goals and objectives of the Comprehensive Plan and with the current R-1 (Low Density Residential) Zoning District; and WHEREAS, on October 2, 2000, the Prior Lake City Council considered the proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the above described property to the R-UMD designation and; 1:\OOfiles\OOcompam\OO-064\rsOOxxcc,doc Page 1 16200 Eagle Creek Ave. S,E,. WHEREAS, the City Council received the recommendation of the Planning Commission to approve the proposed Comprehensive Plan amendment along with the staff reports and the minutes of the Planning Commission meeting; and WHEREAS, the City Council has carefully considered the testimony, staff reports and other pertinent information contained in the record of decision of this case. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The above recitations are herein fully incorporated as set forth above. 2. Vote taken indicated ayes by all. MOTION CARRIED. 5. Old Business: Criego questioned discussions on the bluff ordinance. Kansier saidstaffmelwith DNR Area Hydrologist Pat Lynch to discuss the original intention of the ordinance and how the City was applying it consistently with State Rules. The purpose of the ordinance.is ~o preserve the structure of the existing bluff. It is also an aesthetic purpose, to preserve the existing bluff, topography and landscaping. It makes enforcement more difficult in Prior Lake because most of the lake is already developed. "The DNR cond\!ded staff enforced the ordinance as intended and recommended no changes. . Criego questioned the grading process. K~jer and Rye explairi~d the grading and DNR restrictions. Basically, the staff reviews gradirlg:permits on a case by case basis keeping in mind the intent of the bluff ordinance. In caseswhetethe bluffhas previously been disturbed, the staff is more likely to approve grading 'that is both a structural and aesthetic improvement. In case where the bluff has not previously be disturbed, very little grading will be allowed. The staffwill work with the DNR on all questionable cases. The Commissioners briefly discussed the process. Stamson suggested having the DNR (pat Lynch) review the Shorelinegtading-permits. Criego felt the State should not be involved any more than they are now. Rye commented on the process. 6. New Business: 7. Announcements and Correspondence: Rye poiiitedout there is 272 single family vacant lots and 291 townhome vacancies. Although single family construction is down this year, the City will set an all time housing record~ Vonhof questioned the status of the downtown redevelopment project. Rye said the EDA is recommending a proposal to present to the City Council. City Council adopted the overlay ordinance for senior care facilities but in the process amended not to permit senior care in the Cl, C2 and C4 Districts.
