AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPOINTING A PERSON TO FILL
THE PRESENT VACANCY ON THE CITY COUNCIL
DISCUSSION: Introduction
The purpose of this agenda item is to have the City Council complete the process
of filling the existing vacancy on the body.

On November 6, 2012, Ken Hedberg was elected Mayor. On January 6, 2013, by
operation of law, Ken became Mayor leaving a vacancy on the City Council. In
December 2012 a process was initiated to solicit candidates to fill this vacancy
through appointment.
Current Circumstances
Seven residents submitted applications to be considered for appointment to the
City Council by the January 18 deadline. One of the applicants withdrew citing
work-related conflicts.
The remaining six candidates were interviewed by the City Council on January 23,
2013 including:
Rick Bump
Lloyd Erbaugh
Warren Erickson
Mike McGuire
Jodi Langhorst See
Gene Tremaine
Copies of their applications are included for information.
Interviewees were afforded five minutes to introduce themselves, ten minutes to
comment on the questions contained on the application and up to 15 minutes for
additional City Council questions.
Following the interviews, the City Council, as part of a special meeting, discussed
each of the applicants. The city council narrowed the candidates to three finalists
by identifying each of their individual finalists (not prioritized).

A motion was then unanimously adopted acknowledging that Bump, Erickson and
McGuire are the three finalists (not prioritized). Each council member expressed
sincere appreciation to all six candidates for their interest, quality of presentation
and time invested in this pursuit.
Conclusion
Tonight, the City Council should determine which candidate should be appointed
to fill the remaining term of Ken Hedberg's City Council position. A resolution of
appointment is attached which requires the city council to fill in the candidate's
name.
ISSUES: State Statute provides that the City Council may, by majority vote, fill the City
Council vacancy.
In the event of a tie vote state law provides that the Mayor may appoint a person
meeting the statutory criteria regardless of whether that individual has submitted
an application to serve pursuant to the recruitment process previously authorized
by the Council.
FINANCIAL None to minimal.
I M PACT:
ALTERNATIVES: The alternatives available to the City Council are:
1. Motion, second and majority vote to appoint one of the finalists to fill the re-
maining term of Ken Hedberg's City Council position.
2. If, there is a tie vote then the Mayor may appoint anyone who meets the mini-
mum statutory criteria to serve the remainder of the term of the office.
RECOMMENDED As determined by the City Council.

A RESOLUTION APPOINTING A PERSON TO FILL A VACANCY ON THE PRIOR LAKE CITY
COUNCIL
Motion By: Second By:
WHEREAS, A vacancy exists on the Prior Lake City Council effective January 6, 2013; and
WHEREAS, Pursuant to Minnesota Statute 412.02 subd. 2a the City Council will fill the vacancy by
appointment; and
WHEREAS, The City Council has caused the vacancy to be announced twice in the legal newspaper; and
WHEREAS, Seven persons applied for the opening; and
WHEREAS, One candidate withdrew and the remaining six were interviewed by the City Council on
Wednesday, January 23, 2013; and
WHEREAS, Following the interviews and after extensive discussion, the City Council named three finalists
(not in priority order) including: Richard Bump, Warren Erickson and Michael McGuire; and
WHEREAS, The finalists have been considered by the City Council at the January 28, 2013 meeting.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporatetl herein.
2. The City Council appoints to fill the unexpired term of the vacant City Council position
previously held by Ken Hedberg, beginning February 11, 2013.
