DISCUSSION: History: On January 3, 2000, the City Council adopted a fee schedule for the year 2000. The fee schedule sets forth the City fees and charges for virtually all City-related business. Current Circumstances: On October 2, 2000, the City began an aggressive effort to enforce City Code with respect to temporary signs erected illegally in the right-of-way. Over the last few weeks, 100:1: signs have been removed from the right-of-way for storage at the maintenance center. Enforcement of the ordinance is problematic because many of the signs are installed on Fridays, Saturdays or Sundays. This required the City to add shifts to Public Works Maintenance, Park Maintenance, and Police employees over the weekend for enforcement. In an effort to discourage repeat violations, Councilmember Gundlach has suggested that a storage fee be charged to those who wish to reclaim their signs. A fee of $10 per sign is proposed. Confiscated signs would be stored indoors. Those recovering the signs would pay the fee and acknowledge receipt of the sign. The individual reclaiming the signs will receive an information sheet explaining legal placement of signs. Conclusion: The Council needs to determine if it wishes to amend the 2000 fee schedule by adding a $10 fee for storage recovery of temporary signs in the right-of-way. ISSUES: The fee necessitates storage of the signs indoors and requires that an employee help the "owner" to identify their signs. The City has no absolute way of knowing who owns each sign and could consequently accept a fee and release a sign to the wrong person. Because the signs were illegally placed in the right-of-way, and in the absence of issuing a misdemeanor tag for a first offense, the City Attorney believes the City faces little exposure if a sign is released to other than the owner. ALTERNATIVES: (1) Adopt the proposed amendment to the 2000 fee schedule. (2) Take no action.
