AGENDA ITEM: CONSIDER APPROVAL OF THE APPOINTMENT OF A SECOND CITY
COUNCILOR TO THE ECONOMIC DEVELOPMENT AUTHORITY
DISCUSSION: Introduction
On January 7, 2013 Mayor Hedberg recommended and the city council confirmed
appointment of himself to the Prior Lake Economic Development Authority (EDA).
That appointment filled one of two vacant councilor positions on the EDA
beginning in 2013. At that same meeting, the City Council decided to wait to
appoint the second councilor until the vacant City Council position had been filled
by appointment on January 28. On January 28, the City Council decided to wait
on the appointment again in order for the Mayor to further evaluate all those who
may express interest in the EDA.

The EDA Bylaws provide:
ARTICLE 3. BOARD OF COMM/SSIONERS
3.1 APPOINTMENT AND TERMS. The Prior Lake Economic Development
Authority shall consist of five (5) members. The five (5) member Authority shall be
comprised of two (2) members of the City Council and three (3) members
appointed from the public. The appointments shall be made by the Mayor and
approved by the City Council. The public members initially shall be appointed for
staggered terms of two, three and four years and thereafter upon expiration of the
initial term for four (4) year terms. The City Council members appointed to the
Authority shall serve four (4)-year terms that coincide with their term of office.
Members of the EDA are not term limited.
Current Circumstances
The City Council appointed a new councilor on January 28 effective February 11,
2013 to fill the vacancy created when Ken Hedberg was elected mayor. Now that
the appointment has been made, the Mayor can make an appointment of the
second councilor to the EDA, subject to approval by the City Council.
Conclusion
The Mayor and City Council are ready to fill the vacant EDA position.
ISSUES: The mayor's initial recommendation was to appoint the new city councilor to serve
in this capacity. During the course of the discussion, councilors Morton and
Keeney indicated their interest in serving on the EDA. Now that a new councilor
was appointed at the January 28 meeting, Councilor McGuire will be present and
participating in the council proceedings at the February 11 meeting.
The city attorney's office at council direction has recommended changes in the
EDA Bylaws which would expand it from a five to seven member body. These
amendments would not have any impact upon any aspect of the appointment of a
second city councilor.
The city attorney's office has also opined that a councilor who has been
recommended for this appointment should abstain from the vote on his/her
appointment since voting for oneself can be construed as a conflict of interest.

ALTERNATIVES: 1. Motion and second to affirm the mayor's recommended appointment to fill the
second city councilor vacancy on the EDA.
2. Motion and second to defer action on this agenda item to a time certain.
