EAW decision City Council Workshop December 18, 2000 Environmental Assessment Worksheet Ryan Contracting Mining and Excavation Permit Presentation Format Application History 1 Background . The City Council received a petition to require an EAW as a result of an application for a CUP to allow mining and excavation on the McKenna property . The City Council adopted Resolution #00-12 on February 12, 2000 ordering the preparation of the EAW Discussion of Issues ~ Issues Identified by the Council . Potential impacts on bedrock topography and bedrock hydrology . Potential impacts on groundwater . Potential impacts on SMDC well and wellhead protection area . Potential impacts on lakes, wetlands, the Boiling Spring and the Savage Fen 2 Bedrock.To 0 ra h & Bedrock Hydrology . Existing depth to bedrock is 130' minimum (140' average) . Under operating conditions, depth to bedrock will be at 100' minimum (110' average) . There are no sinkholes or karst conditions in this site area . Existing depth to groundwater is 70' minimum (+80' average) . Under operating conditions, depth to groundwater will be at 42' minimum (50' average) . The bedrock aquifer on the site is not considered susceptible to short.term contamination due to depth to groundwater and less permeable unconsolidated soils rotectlon Area . The SMDC Well is located 1/3 mile northwest, and down gradient of the site . Mitigative measures used to prevent contamination include: . Compliance with local, state & federal regulations . Use of best management practices . Maintenance and protection of on-site monitoring well 3 lakes Wetlands the Boilin Springs & the Savage Fen . The site generally drains north and west, away from the Boiling Springs and the Savage Fen . Surface runoff will be directed to an on-site sedimentation pond to allow sediment to settle before exiting site Environmental Assessment Worksheet Purpose Process EAW Purpose . Designed to set out the basic facts necessary to determine whether an Environmental Impact Statement (EIS) Is required . Legal purpose: . Provide the Information necessary to determine the potential for significant environmental effects . Inform the public about the project . Identify mitigative measures TI -----"- 4 EAW Process . Project proposer supplies data to RGU . RGU prepares the EAW '. . The public has 30 days to comment on the EAW . RGU makes a decision on the need for an EIS Comment Period . Notice of the EAW was published in the Prior Lake American and in the EQB Monitor . The EAW was distributed to federal, state and local agencies for review and comment . The 30-day comment period expires on December27,2000 EAW Decision 5 Decision . The City Council is the Responsible Governmental Unit (RGU) . The City Council Is the designated body which will make a decision on the EAW Decision . Must be made within 30 days following the expiration of the comment period . Must be based on specific findings of fact . A "negative declaration" means there Is no need for an EIS . A "positive declaration" calls for an EIS based on specific findings . Type, extent and reversibility of environmental effects . Cumulative potential effects of related or anticipated future projects . The extent to which environmental effects are subject to mitigation by ongoing public regulatory authority . The extent to which environmental effects can be anticipated & controlled as a result of other environmental studies 6 ,.- Criteria for Decision on Need for EIS: .
