Those present were Commissioners Loftus, Arnold, Kedrowski, Wells, Roseth, Director of Planning Horst Graser, Assistant City Planner Deb Garross, and Secretary Rita Schewe. ITEM I - REVIEW MINUTES OF PREVIOUS MEETING MOTION BY ROSETH, SECOND BY KEDROWSKI, TO APPROVE THE MINUTES AS WRITTEN. Vote taken signified ayes by Kedrowski, Loftus, Arnold, Wells, and Roseth. MOTION CARRIED. ITEM II - PUBLIC HEARING - SIGN ORDINANCE AMENDMENT - STAFF Public Hearing called to order at 7:37 P.M. The public was not in attendance. Deb Garross presented the information on the proposed Sign Amendment as per memo. Ms. Garross explained the problems pertaining to the control and enforcement of the Sign Ordinance relative to temporary sign display. Discussed were: Section 5 -7 -1, Purpose: Rationale for sign regulations. Section 5 -7 -5, Exemption from Fees: To remove paragraph (B) temporary signs from section 5 -7 -5 which exempts certain types of signs from payment of sign permit fees. Section 5 -7 -5 Amend language related to election sign display: This amendment would bring the existing ordinance in compliance with State Statute. Section 5 -7 -7, Fees: Propose creating a fee for temporary signs. Proposed Section 5 -7 -9, Removal of signs: This amendment is proposed in order to assist in the enforcement of the Ordinance provisions. Recommendation from Staff is to approve the amendments as proposed and forward to the City Council for consideration. Comments from the Commissioners were on; recommended changes, time limits on permit, garage sale, car sale, hot air balloon signs, real estate signs and that the amendments would seem to provide the tools needed to enforce the ordinance. 4629 Dakota St. S.E., Prior Lake, Minnesota 55372 / Ph. Commissioner Wells suggested that public relations /educational information related to yard sale signs be incorporated also, perhaps through news articles and information in the Prior Lake Wavelength. MOTION BY KEDROWSKI, SECOND BY LOFTUS, TO CLOSE PUBLIC HEARING. Public Hearing closed at 5:25 P.M. ITEM III - PUBLIC HEARING - CHRISTENSON BUILDERS Horst Graser reported that the applicant had not submitted information for consideration. Recommendation from Staff is to table the application for conditional use and variance. MOTION BY KEDROWSKI, SECOND BY WELLS, TO TABLE THE CHRISTENSON BUILDERS APPLICATION FOR CONDITIONAL USE AND VARIANCES. Vote taken signified ayes by Kedrowski, Wells, Roseth, Arnold, and Loftus. GRASER PUBLIC HEARING: YES X NO DATE: JANUARY 2E,_1991 HISTORY /BACKGROUND SITE ANALYSIS The Planning Department has received a variance application from David Hunt at 4580 Lords Street. The applicant is requesting a 55' lakeshore variance to construct a deck and home addition to an existing house. PREVIOUS PROPOSALS The applicant has entered into a purchase agreement to buy the single family home at the above referenced address. The home was built in 1963 in the Township of Eagle Creek. Eagle Creek Township was consolidated in 1973 and annexed to Prior Lake. The building permit is not on file at Prior Lake City Hall. Many of the early township records were never transferred after the annexation. Also, there are no records of any variances granted for the subject property. The subject site is part of what is commonly referred to as "Lords Islano". All but one lot is developed. Lords Island was never platted but divided by meets and bounds. Several of the lots are extremely shallow and could not be developed today without variances. PHYSIOGRAPHY /EXISTING DEVELOPMENT : The lot contains about 11,100 square feet and is very shallow, measuring 97 feet at the east property line and only 12 feet at its westerly line. The L- shaped single family walko•it rambler is built into the hillside. Retaining walls along th,a lake and westerly and easterly sides of the house maintain the steep grades. The lot contains about 16 feet of relief from its southeasterly point to the lake. The home is a typical 1960's rambler with no apparent design emphasis for lake living. The lakeside of the home does not have a deck nor are there provisions for a deck. Apparently the 10X40 foot concrete slab on the walkout level of the house provides recreation opportunity and level open space. Other than the concrete slab the remainder of the lot between the home and lake is too steep for activities. The home's orientation appears to place more emphasis on the parallel arrangements to the road than to the lake. The homes northwesterly lakeshore setback is only 20 feet. The setback increases to 37 feet at the northeast corner of the home. The proposed 5 foot deck is to extend along the entire length of the home. The deck expands to 8.5 feet for the easterly 36 feet. In addition to the deck, the applicant has proposed a 16X26 foot two story addition to the east end of the home. ADJ ACENT USES The lot adjacent to the east is developed with a single family home that has an equadistant setback from the road as the subject home. The 250 feet of property east of the home, is the narrowest part of Lords Island and is not buildable. There is a winter lake access in this narrow area which is primarily used by ice fisherman. DEVELOPMENT SUMMARY The lot is zoned R -1 Urban District. The required setbacks line, 25 feet from the R/W line lowest building elevation is 909. Residential and S -D Shoreland are 75 feet from the 904 contour and 10 feet side yard. The RECOMMENDATION: The recommendation from Staff is to approve the variance application as submitted. The home is considered to have a legal non - conforming setback to the 904 nontour. The proposed construction will not encroach closer to the 904 than the existing legal non - conforming setback of the home. The Planning Commission has allowed some degree of variance for lakeshore homes so that each riparian owner has the opportunity for a deck to provide reasonable use of the property. The widest portion of the deck (8.5 is located on the northeasterly part of the home which is the furthest point from the 904. The proposed 5 foot walkway provides exterior access to the deck area. Staff is of the opinion that the applicant has attempted to design a deck that involves the least amount of encroachment toward the lakeshore. Hardship can be found in that the lot is of irregular shape and is very shallow. No home could be built on this site under current standards without variances. The 904 encroaches toward the existing home which further limits development options for this property. The site and circumstances are unique and not caused by the land owner. Staff does not recommend tree planting in this circumstance due to the limited lot area available for the planting of additional trees.
