PLANNING COMMISSION
MINUTES
JUNE 20, 1991
The June 20, 1991, Planning Commission Meeting was called to
order by Cha irman Arnold at 7:30 P.M. Those present were
Commissioners Loftus, Arnold, Roseth, Director of Planning Horst
Graser, Assistant City Planner Deb Garross, Associate Planner Sam
Lucast, Director of Parks Bill Mangan, City Engineer Larry
Anderson, and Secretary Rita Schewe. Commissioner Kedrowski
arrived at 7:35 P.M. Commissioner Wells was absent.
ITEM I - REVIEW MINUTES OF PREVIOUS MEETING
MOTION BY ROSETH, SECOND BY LOFTUS, TO APPROVE THE MINUTES AS
WRITTEN.
Vote taken signified ayes by Loftus, Arnold, and Roseth.
MOTION CARRIED.
ITEM II - PUBLIC HEARING
Public Hearing for Comprehensive Plan, Rezoning, Preliminary Plat
of Wood Ridge Estates First Addition, and Variance were called to
order at 7 :32 P.M. The public was in attendance.
Joe Mahoney representing New Century Construction stated they are
requesting the Comprehensive Plan Amendment, Rezoning,
Preliminary Plat and Variance for the Wood Ridge Estates First
Addition in order that they can began construction of 155 houses
in the development.
Horst Graser presented the information as per memo of June 20,
1991. The applicants, Joe Mahoney and Mike Giles of New Century
Construction Company, are contract purchasers of 70 acres
recently annexed into the City. They are seeking all necessary
approvals to permit the installation of the first phase of
improvements before winter.
The requested action by the developers is to amend the 1981
Comprehensive Plan by expanding the urban service area to include
the subject site and to establish land use as low density
residential In anticipation of the annexation, Staff has
included the subject parcel in the proposed 2010 urban service
area.
When property was annexed into the City it was zoned as A -1
Agricultural. The applicants have requested the site be rezoned
to R -1 Single Family Residential.

Wood n 4 d;e Estates is a 70 acre planned single family development
consisting of approximately 155 lots, streets, and open space. A
description of the areas features and planned amenities were
presented. Although detail is missing in some areas, this
opportunity can be taken to discuss and hopefully settle the
final design of the site.
Larry Anderson, City Engineer, gave a brief summary of the
Engineering Department's memo. The grading plan needs to be
revised to save the existing trees as much as possible. Erosion
control is essential adjacent to the pond. All issues are
resolvable and the developer is in the process of addressing
concerns of the Engineering Department.
Bill Mangan, Director of Parks, stated that the proposal is close
to being acceptable. There are some lots that should be
realigned. A neighborhood park is very essential in this area.
The park land dedication requirement would be approximately 7.13
acres which would satisfy the requirement for Wood Ridge Estates.
Mike Giles, Lakeville, had comments on the grading plan, trees
lost and Mushtown Road.
Larry Anderson stated that these plans were what the
Development's Engineer presented.
A recess was called at 8:45 P.M. The meeting reconvened at 8:50
P.M.
All commissioners were in concurrence with the Comprehensive Plan
Amendment.
MOTION BY LOFTUS, SECOND BY KEDROWSKI, TO RECOMMEND TO THE CITY
COUNCIL THAT THE SUBDIVISION WOOD RIDGE ESTATES BE INCORPORATED
IN THE URBAN SERVICE DISTRICT.
Vote taken signified ayes by Loftus, Kedrowski, Arnold, and
Roseth. MOTION CARRIED.
MOTION BY KEDROWSKI, SECOND BY ROSETH, TO DESIGNATE THE AREA AS
LOW DENSITY RESIDENTIAL FOR THE PURPOSES OF THE COMPREHENSIVE
PLAN.
Vote taken signified ayes by Kedrowski, Roseth, Arnold and
Loftus. MOTION CARRIED.
The Commissioners were in concurrence with the Rezoning
Application.
MOTION BY ROSETH, SECOND BY KEDROWSKI, TO RECOMMEND TO THE CITY
COUNCIL TO REZONE THE SUBJECT PROPERTY FROM A -1 AGRICULTURAL TO
R -1 SINGLE FAMILY RESIDENTIAL.
Vote taken signified ayes by Roseth, Kedrowski, Loftus, and
Arnold. MOTION CARRIED.

HEARINGS FOR THE COMPREHENSIVE PLAN AMENDMENT AND THE REZONING
APPLICATION.
Vote taken signified ayes by Kedrowski, Loftus, Roseth, and
Arnold. MOTION CARRIED. Public Hearing closed at 8:55 P.M.
Discussion followed on the Preliminary Plat of Wood Ridge
Estates. Comments were on park area lots realignment, trees
lost, slopes, berms or natural foliage on 170th Street, lots on
Mushtown Road be 150' in depth, bike path trail, and regrading.
MOTION BY KEDROWSKI, SECOND BY LOFTUS, TO TABLE THE PRELIMINARY
PLAT FOR WOOD RIDGE ESTATES TO INCORPORATE STAFF'S
RECOMMENDATIONS.
Vote taken signified ayes by Kedrowski, Loftus, Arnold, and
Roseth. MOTION CARRIED.
MOTION BY KEDROWSKI, SECOND BY LOFTUS, TO TABLE THE VARIANCE FOR
WOOD RIDGE ESTATES.

ITEM III - GREG SCHRADER - VARIANCE (CONTINUED)
Greg Schrader, 5308 Candy Cove Trail, stated that he has revised
his building plan and the only variance needed is a 18.5 foot
front yard variance. He will construct a 9 X 22 foot addition to
the existing garage.
Deb Garross presented the information as per memo of June 20,
1991. The application has been revised from the 23 foot front
yard and 8.5 foot side yard variance that was before the Planning
Commission on June 6, 1991. After conferring with the Director
of Planning and the Building Official, the applicant revised his
plan. Part of the legal non - conforming structure will be
retained and an addition of 9 X 22 feet will be added to the
westerly part of the garage. This proposal eliminates the ne d
for a side yard variance due to the grandfathered setback
established by the existing garage.
Recommendation from Staff is to approve the 18.5 front yard
variance. Hardship is due to the substandard lot size and
development practices of a former government and is not the
result of the applicant or the City of Prior Lake.
A letter from Dick Lewin was read into the minutes, stating he
had no objections to the construction.
Comments from the Commissioners were on closeness of buildings,
drainage, site line, and installation of gutters.

MOTION BY KEDROWSKI, SECOND BY ROSETH, TO APPROVE THE 18.5 FOOT
FRONT YARD VARIANCE TO CONSTRUCT A GARAGE AT 5308 CANDY COVE
TRAIL. RATIONALE BEING THAT HARDSHIP IS CAUSED BY THE LOT BEING
A SUBSTANDARD LOT AND THE DEVELOPMENT PRACTICES OF A FORMER
GOVERNMENT. GUTTERS FOR DRAINAGE CONTROL SHALL BE INSTALLED ON
THE GARAGE AS REQUESTED BY THE BUILDING OFFICIAL.
Vote taken signified ayes by Kedrowski, Roseth, Arnold, and
Loftus. MOTION CARRIED.

HISTORY BACKGROUND
The Panning Department received an application for variance from
Mark Danes of 5330 Crossandra Street, Prior Lake. The
application is for a 2,900 square foot minimum lot area variance
from the 10,000 square foot lot area requirement to build a home
at 2948 Terrace Circle as proposed on the attached survey. See
attached maps and materials for reference to this item.
PREVI PROPOSALS
This tract was administratively divided in 1983 prior to the
improvement of Terrace Circle. Lots 4 and 5, Block 24, Spring
Lake Townsite were re- divided in order to provide access from
Center Road to both parcels. The subject site is a legal
non - conforming lot of record which contains 7,100 square feet and
measures 71 x 100 feet. The site is a corner lot which fronts on
unimproved Center Road and Terrace Circle. There are no other
permits or information on file for this property.
PHYSIOGRAPHY•
The lot is vacant and contains weeds, volunteer tree growth and
some debris. The applicant proposes minimal regrading as
indicated on the attached survey. The grading will likely
destroy the tree cover on the lot which consists of approximately
six, 6 11 and 8 caliper trees and brush. The trees appear to be
volunteer growth and are believed to be varieties of elm and
cottonwood.
EXISTING CONDITIONS:
The adjacent properties are fully developed with the exception of
one vacant lot located directly across the street to the
southeast. The lot is substandard in size and area. Corner lots
should contain at least 12,000 square feet and 96 feet of
frontage along each front yard. There is a drainage easement
across the northerly part of the lot which further restricts
development opportunities for this property.
RECOMMENDATION:
The recommendation from staff is to approve the 2,900 square foot
minimum lot area variance subject to the condition that four
trees be planted in the yard as per attached "Subdivision Tree

Planting" requirements. The hardship in this case is due to the
changes that have occurred in the ordinance since the time that
this lot was legally subdivided. The applicant has presented a
plan that requires no setback nor lot coverage variances. If the
lot area variance is not qranted, this lot would be rendered
non - buildable. Staff has received verbal comment from Pat Lynch
of the DNR who states that there is no opposition to the granting
of the requested lot area variance.

STREET do YARD TREE PLANTING REQUIREMENTS
All boulevard and yard trees shall have a trunk not less than 2 1/2' in
caliper and the root shall be balled and burlapped.
Required street trees shall be located as shown above: between four
.and ten feet from the front property line. Front yard trees may be
located anywhere in the front yard but not less than four feet from the
front property line. Trees may not be planted in areas which would
interfere with underground utilities (water, sewer, gas, telephone,
electric). Consult utility company before planting.
On comer lots, no trees shall be permitted within the clear view
triangular area defined as follows: Beginning at the intersection of
the projected lot lines of the corner lot, thence forty feet (40
along one lot line, thence diagonally to a point forty feet (40 from
the point of beginning on the opposite lot line. See diagram for
clarification.

3. Not less than two nor more than three species of trees shall be planted
in any block. Not less than 20 percent nor more than 50 percent of the
total trees planted in a block may be of the same species.
4. No required tree shall be planted in soil too poor to insure the growth
of such trees unless 27 cubic feet of soil is removed and replaced with
loam.
5. The soil over the root system shall be - dished to accommodate 5
gallons of water and a 3 deep wood chip mulch shall be installed over
the area disturbed in planting.
6. Required trees shall be wrapped with first quality heavy water proof
crepe paper manufactured for this purpose during a period from
September 15 to April 1 of the first growing season.
7. Trees shall be given a minimum application of 10 gallons of water per
week during the first growing season.

PURPOSE OF HEARING: To consider a variance application
for Mark Danes of 5330 Crossandra
