MINUTES
JULY 20, 1989
The July 20, 1989, Prior Lake Planning Commission Meeting was
called to order at 7:30 P.M. by Chairman Wells. Present were
Commissioners Arnold, Kedrowski, Loftus, Roseth, Wells, and
Director of Planning, Horst Graser.
ITEM I - REVIEW MINUTES OF PREVIOUS MEETING
MOTION BY LOFTUS, SECOND BY ARNOLD, TO APPROVE MINUTES AS
WRITTEN.
Vote taken signified ayes. MOTION CARRIED.
Mr. Graser announced that Mr. Unmacht will be addressing the
Commissioners on several topics after the agenda items are
completed.
ITEM II KATHLEEN MORRIS - SIDE YARD, FRONT YARD AND COVERAGE
RATIO VARIAN
Don Rassmussen, contractor, represented Ms. Morris, stated that
the applicant would like to convert the existing garage to living
space and add a double garage, thus solving a water problem.
Mr. Graser presented information as per memo of July 20, 1989.
The lots in the area are extremely small, most have required
variances. Staff recommends denying the variance due to the fact
that County Road 21 is a designated collector street and the
right -of -way may be needed for future road improvements. The
variance would not be consistent with policies of the
Comprehensive Plan pertaining to collector streets.
Mr. Rassmussen offered alternatives of a detached garage or
building a second story on the existing house.
Chairman Wells read a letter from Brad Larson of Scott County
Highway Department dated July 18, 1989, recommending denial of
the variance as the construction would be too close to the road.
Comments from the Commissioners were on an excessive coverage
ratio, alternate design for construction, and solution to water
problem.

ITEM III BILL McDONALD - FRONT YARD VARIANCE
Mr. McDonald, 5500 WOOdcrest Drive, Edina, MN, owner of the

property located at 4377 Quincy St., is requesting a 5 foot front
yard variance in order to construct a single family home. A
variance request was denied two years ago for this same property,
since then the City has changed the setback regulations and the
applicant felt the location is buildable.
Mr. Graser presented the information as per memo of July 20,
1989. A brief history of the denied variance was given and the
amendment change that has expanded the building envelope.
A letter from Brad Larson of the Scott County Highway Department,
dated July 18, 1989, was read into the record stating they had no
objection to the variance as no future construction on County 21
is planned and that no access from this property onto CSAH 21
will be allowed.
Ralph and Elizabeth Vetter, 15964 Sunfish Trail S.E., and
Patricia and Thomas Malay, 4397 Quincy St., voiced their
objections to the variance application stating the same problems
exist as did in 1987, unsafe road conditions, status of property
on north side of road. A letter signed by the neighbors was
presented to be read into the record.
Chairman Wells read into the record the letter addressed to Mayor
Andren and City Planners stating the objections to the variance
signed by the following: Thomas & Patricia Malay, 4392 Quincy
St.; Mr. & Mrs. Robert Hants, 15930 Sunfish Trail S.E.; Mr. &
Mrs. Ralph Vetter, 15946 Sunfish Trail S.E.; Mr. & Mrs. Al
Winterberger, 15956 Sunfish Bay.
Comments from the Commissioners were; area is a focal point of
the city, applicant has right to build on lot, the whole Tract A
should be considered in the application, and a hardship was not
shown.
Mr. McDonald told the Commissioners that he did not have plans
for the remainder of Tract A at the present time and would like
this issue voted on tonight.
MOTION BY LOFTUS, SECOND BY ROSETH, TO DENY THE REQUEST FOR A 5
FOOT FRONT YARD VARIANCE FOR 4377 QUINCY STREET, REASON BEING
THAT THE APPLICANT HAS NOT SHOWN A HARDSHIP GIVEN THE TOTAL SIZE
OF LAND AVAILABLE IN THE TRACT.
Vote taken signified apes by Commissioners Loftus, Roseth and
Wells. Nays by Commissioners Arnold and Kedrowski. MOTION
CARRIED.

Mr. Graser requested as Mr. Unmacht is addressing the Commission

Mr. Unmacht, City Manager, updated the Planning Commission on the
Council's action. The RFP was adopted and a consultanting firm
is being considered. The second item was pertaining to a
selection from the Commissioners to serve on the Lake Review
Committee and would like a name by the next meeting. Mr.
Unmacht also presented a suggestion from the Council to have a
workshop with the Planning Commissioners. Dates and issues are
open.

HOME OCCUPATION - STEPHEN BUSH

SUBJECT:
To consider a Home Occupation at 14543 Pine Road for a waterski
school.
STAFF ANALYSIS
The subject home is an older single family lake home located in
a R -1 /S -D district. The applicantis lot measures approximately
100' x 250' with the home located about 40' above the lake. A
small structure at or near the ordinary high water mark appears
to serve as office space for the school. All of the homes in the
immediate area are single family with architecture ranging from
cabins to recently constructed homes.
The school will be private with lessons by appointment only. No
ski equipment or boats will be for sale or rent. Mr. Bush
estimated that his instruction time on Prior Lake will average
approximately 10 hours per week with 1 to 3 cars parked at his
home while lessons are being conducted. Mr. Bush will be the
only person instructing at the school.
The intent of the Zoning ordinance concerning home occupations is
to allow certain profesional occupations within homes in
residential districts. The waterski school is a unique home
occupation because it will be based within the applicants home
but will be conducted within a public area. Therefore, the
impact on the neighborhood could be severe and should be closely
monitored.
Staff has some concerns with the overall noise and safety of the
waterski school. There are several homes located along the lake
near the proposed school where early morning or late evening
skiing could become a problem. Therefore a time frame should be
placed on the school when skiing shall be prohibited. Chapter
9 -3 of the Prior Lake City Code requires that boaters shall not
operate within 150 of any bathing area, skin divers warning
flag, swimming, raft, watercraft, dock or pier. Therefore, staff
would recommend that all aspects of Section 9 -3 be read and
followed by the applicant so that the school is run in the safest
possible manner.

RECOMMENDATION:
5 a s recommendation is to approve the request contingent upon
the following:
1.) All waterskiing instruction associated with the home
occupation must be conducted between the hours of 9:00
A.M. through 9:00 P.M.
2.) All requirements outlined in Section 9 -3 "Public Waters"
of the Prior Lake City Code be strictly followed.
3.) A permit must be obtained, if necessary, from the Scott
County Sheriff's Department for the portable slalom
course used by the school.
4.) This permit should not be transferable.

Gentlemen:
I have been a resident on Prior Lake for more than 25 years and
am active in the sport of water skiing. I have attended Steve's
Ski School to try to improve my skills and found that he is a
competent instructor. I have also observed that he teaches
water safety and courtesy to all other users of the lake, such
as swimmers, sailors, fishermen, other skiers and residents.
Many people through the years have asked where they could find
ski instruction for themselves, children, etc., and I have
recommended Steve Bush. They have told me later how much they
enjoyed the learning experience with Steve, and praised his
competence.

AUGUST 3, 1989
SUBJECT:
To consider a Home Occupation at 2946 Spring Lake Road for a
photography studio.
STAFF ANALYSIS:
The app cant proposes to operate a small photography studio
within her home. The Haas's home has a 600 square foot room that
is planned to be used as the studio with a separate entrance from
the driveway. Most of the business would be by customers coming
to the home. The applicant has a large driveway which can hold
up to 10 cars with a turnaround area near the home. The
applicant estimated that three to four cars a day would be
average in the busiest months of September, October, and
November. In the winter only two to three appointments are
expected per week. The occupation will be carried on wholly
within the principal structure and will not create any
objectionable noise or other disturbances.
The subject home is a single family structure which is zoned
R- 1 /S -D. The lot is approximately 10,650 square feet in size.
The character of the neighborhood is totally residential,
therefore any use which would alter that living environment would
be totally contradictory to the nature of the development. The
occupation will be carried on by a member of the household
residing at the above referenced address. In general the use is
not going to cause any hardships on the neighborhood that could
result in a changing of the residential character of the
neighborhood.
STAFF RECOMMENDATION:
Approve the requea since it is consistent with Section 6.8 of
the Zoning Code which deals with Home Occupations. The proposal
would not endanger the established residential character of the
neighborhood and would not be detrimental to the general health
and welfare of the community as a whole. There have been similar
photography studio home occupations granted within Prior Lake
that have operated without any problems or negative impacts in
their neighborhoods. This permit should not be transferable.

MEMORANDUM
TO: PLANNING COMMISSION

RE: KATHLEEN MORRIS VARIANCE CONTINUATION
DATE: JULY 27, 1989
This item came before the Planning Commission on July 20, 1989
for a 3.27 foot west side yard variance and a 44 foot front yard
variance from County Road 12. The Planning Commission continued
the hearing at the request of the applicant. Mr. Rasmussen who
represented the applicant was given direction and an
approximate building envelope for the subject site. He stated
that he needed to discuss the alternatives with the applicant and
would submit a revised proposal based on the discussion by the
Planning Commission.
The negative element in the initial proposal was the resulting
7.5 foot front yard setback from County Road 12. The revised
plan calls for a two story addition reducing the County Road 12
setback by 17.5 feet. All other measurements would remain the
same (see attached revised site plan).
The variances necessary for this proposal are a 26.5 foot front
yard variance from County Road 12 and a 3.27 foot west side yard
variance. The revised plan also reduces the coverage ratio from
538 to 468 under the circumstances staff feels that this
alternative is acceptable. The only additional lot coverage is a
14 X 22 addition to the front of the existing single car garage.
A two story structure in this neighborhood is totally consistent
with its character.

The meeting was called to order by President Marvin Oldenburg at 7:40 P.M.
Minutes - After review and upon motion of Laabs, second of Kroyer, the
minutes o e May 9 general meeting were unanimously accepted.
Financial Report - Benson reviewed the financial report for the Board's
informs on, er scussion a motion was made by Adams, seconded by Kroyer, to
accept the financial report and authorize Benson to pay the bills noted thereon.
Unanimous.
Permit Applications - (a) Lakeside Marina /Dredging /89 -13. Larson reported
that n car e a this application appeared to be a maintenance project for
a previous D.N.R. permit. A letter will be sent to Lakeside Marina notifying
them of the requirements.
(b) City of Prior Lake /Streets and Storm Sewer /N89 -11. Larson reviewed
permit application and plans. Loney, assistant City Engineer was present to
answer questions. After review a motion was made by Franklin, seconded by Laabs,
granting Permit No. 89 -11, subject to receipt of analysis demonstrating an outlet
velocity of 8 feet per second or less.
(c) Donald Walz /Grainwood /Replace Retaining Wall /k89 -12. Waiz was
present to answer questions. The Board examined photographs of the area where
work is to be done and reviewed the permit application. After review, a motion
was made by Franklin, seconded by Adams, granting Permit No. 89 -12.
(d) Gail Svoboda /Grainwood /Retaining Wall. Tabled.
(e) Ron Johnson /Maplewood /Sand Blanket. After discussion the Board
directed Rick Adams to contact Keeley, representing the Maplewood area, to
encourage the property owners to proceed with retaining a contractor for this
project.
(f) Ted Jepson /Spring Lake Townsite/Lake Bed Excavation. Tabled.
(g) Savage Golf Course /N.W. Corner Hwy 13 and Co. Rd. 42. Benson
reported that the City of Savage has been advised that a watershed permit will be
required for this project.

DNR Information - (a) Transferring of Mike Mueller to Cambridge. Benson
informe a oar at Mike Mueller, who had worked with this district on
numerous projects, was being transferred to Cambridge. After discussion a motion
was made by Laabs, seconded by Kroyer, directing Benson to write a letter of
commendation and appreciation to DNR. Unanimous.
(b) Eurasian Watermilfoil Warnings. Benson reported that DNR has
posted signs at public accesses.
(c) Natural Ordinary Low Water. Benson reported that he had conversed
with Lokkesmoe at the DNR regarding the NOLW. Bates reviewed a legal document
which referred to a natural ordinary low water level. It was the determination
of the Board and DNR that no Natural Ordinary Low Water level has been legally
established.
(d) Permit Work at 902.5. Larson recommended that the level for
obtaining a permit for work to be done to be lowered from 904 to 902.5. The
Board discussed the requirements for obtaining a permit and directed Larson to
submit a letter to DNR asking for their concurrence.
Project 76_2 Status - (a) DNR Permit. Benson reported that DNR Permit
No. - as een renewed to 6/30/90.
(b) Schedules "B" and "C" Appraisals. Benson reported that Bowler
appraisals were nearly complete and ready to be reviewed. A special meeting was
set for Monday, June 19th, at 7:30 P.M. to review the easement appraisals.
(c) Schedule " A " and "D ". Larson reported that Schedule "D" has been
completed and reviewed and has met with City approval. Schedule "A" is completed
and will be reviewed next week.
(d) Shakopee Aware of Delay. Larson reported that he has been in
contact with the City of Shakopee and that they are aware of the delay in
completion of the total project.
Pump Project 77 -6 Status - (a) Well. Mahoney reported that the pump and
motor are n PT ace.
.(b) Power Supply. Benson reported that he, Ron Jabs of MVEC and Wes
Green had looked at the pump area. The Board discussed the financial needs for
the hook up. After further discussion it was determined that the Board would
proceed with the electrical hook up after receiving a response from DNR regarding
the tuAing on of the pump..
SCS Funding - Laabs provided the Board with an update on the application for
SCS gran un ng. He indicated that the Board should resubmit the application
for approval. Franklin reported that his conversation with Pascal of the SCS
office indicated that it was unlikely that this district would receive any
funding because the TR20 •model was not in conformance with SCS quality control.
Larsgp reported that his discussions with SCS staff indicated that he had
provided all of the information requested for conformance. After discussion
Oldenburg indicated that he would contact John Bisek of SWCD to try to clarify
the situation and directed Larson to contact Pascal.
Railroad Peninsula - Benson distributed and reviewed a letter from Robert
Johnson regarding the railroad peninsula. Bates was directed to contact the
Attorney General's Office regarding ownership of the land and to research the
procedures necessary for removal.
1988 Audit Status - Benson reported that Evermann has started the audit and
has o a nb�T ed a copy of a state audit for one watershed district and a private
audit of another to review for information for preparing the audit for this
district.
Summer Tour /Detroit Lakes /June 23 and 24 - Laabs was the only member who
indicated a he might e able to atteno a portion of the summer tour.
Lower Minnesota River 509 Plan - Larson reviewed and distributed a summary
and his comments or e totai plan for the benefit of the Board. A motion was
made by Laabs, seconded by Kroyer, accepting the comments and directed Benson to
send a letter to Lower Minnesota advising that this District approves their 509
Plan. Unanimous.
Other - (a) Osness Letter. The Board reviewed a letter from Russ Osness
regar3rng the lake level which appeared in the Prior Lake American.
(b) Annual Report. Benson reported that the annual report had been
completed and distributed to the necessary governmental entities.
(c) Four - drawer File Cabinet. Benson reported the need for an
additional file cabinet. Franklin indicated that he would check into a known
source and report back.
(d) Outlet Beautification. After discussion, Larson was directed to
meet with landowners and submit a plan to the Board.
(e) Watershed Spokesperson. Adams recommended that Franklin be
appointed as spokesperson for the Board to relay information on Board policies to
the media.
(f) Soil Erosion. Kroyer had heard that there are steep banks washing
Into the lake. He did not know where but wanted to alert Board and staff.

The special meeting was called to order by President Marvin Oldenburg at
7:43 P.M. Oldenburg noted that the purpose of this meeting was to review the
easement appraisals for outlet repair.
Terry Hanson - The Board reviewed the appraisal of Ed Bowler for Terry
Hanson and upon motion of Laabs, second of Franklin, the Board unanimously
accepted the appraisal.
David Lucast - The Board reviewed the appraisal of Ed Bowler for David
Lucast and upon motion of Franklin, second of Laabs, the Board unanimously
accepted the appraisal.
Robert Reed - The Board reviewed the appraisal of Ed Bowler for Robert Reed
and upon motion of Laabs, second of Franklin, the Board unanimously accepted the
appraisal.
After discussion a motion was made by Laabs, seconded by Adams, directing
Huemoeller to proceed with coordination and negotiation with Shakopee to obtain
these easements and to prepare the appropriate resolutions. Huemoeller was also
directed to proceed with condemnation, if necessary. and to prepare appropriate
documents for condemnation on those easement parcels which are not settled
otherwise. Unanimous.

AUGUST 3, 1989
The August 3, 1989, Prior Lake Planning Commission Meeting was
called to order at 7:30 P.M. by Chairman Kedrowski. Present were
Commissioners Loftus, Roseth, Kedrowski, Director of Planning,
Horst Graser, Assistant City Planner, Deb Garross, and Planning
Intern, Gary Schmitz. Absent were Commissioners Wells and
Arnold.
ITEM I - REVIEW MINUTES OF PREVIOUS MEETING
MOTION BY ROSETH, SECOND BY LOFTUS, TO APPROVE MINUTES AS

ITEM II - STEVE BUSH - HOME OCCUPATION PERMIT
Steve Bush, 14543 Pine Road, Prior Lake, presented his request to
operate a waterski school from his residence. He would give
approximately 8 -10 lessons a week and does meet the Scott County
requirements on water regulations.
Gary Schmitz presented the information as per memo of August 3,
1989. Staff is concerned with the noise and safety of the
waterski school in a residential area. Recommendation by Staff
is as follows; hours should be from 9:00 A.M. to 9:00 P.M., all
requirements outlined in City Code Section 9..3 be strictly
followed, obtain permit for slalom ski course if necessary, and
permit should not be transferable.
Jean Engles 14514 Pine Road: Robin Lee 1097 Von Baron , Shakopee,
MN; Marten Trench 14552 Pine Road, Prior Lake; Michael Benedict,
15380 Breezy Point Rd S.E. Prior Lake; gave their support to the
applicant for his school. All felt the starting time could be
earlier, no parking problems in area, and the applicant is safety
conscious.
Chairman Kedrowski read into the record a letter from Sam Dalal,
State Farm Insurance Agent, 14163 Commerce Ave. N.E. Prior Lake,
stating Mr. Bush has adequate coverage. The second letter was
from Mr. Frank Wicker, 3280 Todd Road, Prior Lake, MN, commending
Mr.Bush on his waterski school. Also noted into the record was a
petition with forty -eight signatures in support of the school and
starting at 7:30 A.M.
Comments from the Commissioners were on starting time, insurance
;overage, permit from other agencies, number of employees,
structure used for office, any interference with DNR lake
access.

Gary Schmitz, Planning Intern, presented the information as per
memo of August 3, 1989. Staff recommendation is approval of
application as it is consistent with Section 6.8 of the Zoning
Code and would not be detrimental to the health and welfare of
the neighborhood.
Commissioners comments were on signs, delivery truck traffic,
expansion of business, additional employees, and reviewal of the
application if additional employees are hired.

Dan Rasmussen, representing Ms. Morris, presented a new design
featuring a two story home for consideration by the
Commissioners. The variance needed would be 26.5 foot front yard
from County Road 21 and 3.27 foot west side yard.
Mr. Graser presented information as per memo of August 3, 1989.
Staff felt that the alternative design is acceptable and would
recommend approval.
Comments from the Commissioners; they were impressed with the new
design and have no objections, and would water problem be
solved.

next meeting.

SUBJECT: FRONT YARD VARIANCE APPLICATION
APPLICANT WADE ALLISON
SITE: 4330 DAKOTA STREET S.E.
DATE: AUGUST 17, 1989
INTRODUCTION:
The Planning Department has received a variance application from
Wade Allison to consider a 17 foot front yard variance from West
Avenue. Mr. Allison has proposed to build a 32 x 24 foot
detached garage 8' feet from the westerly property line of Lot 1,
Block 1, Prior Acres 3rd Addition.
BACKGROUND:
T ee sou jest site is a corner lot which contains approximately
9,500 square feet. The lot is zoned R -1 /S -D and the required
setbacks are 25 feet from the south and west property lines and
10 feet from the north and east property lines. Mr. Allison
wishes to convert an existing tuck under garage into living space
and add a detached garage on the northwest corner of the
property.
DEVELOPMENT ISSUES:
The att map is a drawing prepared by the City Engineering
Department. The map illustrates the location proposed for the
detached garage as well as the location of four homes to the
north of the subject site. It is evident that structures located
along West Avenue in the immediate vicinity of the subject site,
maintain a consistent setback from the roadway.
STAFF ANALYSIS:
When tha application for variance was first discussed, it was
thought by the applicant that there was enough lot area to locate
the 9araye 12 feet from the property line. Staff reviewed
possibilities of reducing the length of the garage from 32 to 22
feet in order to reduce the degree of variance needed. However,
once the proposal was drawn to scale, it was discovered that
there was much less area available to the westerly side of the
home and that an extreme variance would be needed in order to
construct the garage as proposed.

A site analysis was conducted by staff, where it was found that
the proposal would not be consistent with the development
patterns of the neighborhood. The applicant has use of an
existing garage, even though it is not as large of a storage
space as he would like. Staff would find it difficult to find
hardship to substantiate granting a variance to this site. The
subject site is not unique and no evidence has been presented to
demonstrate that a hardship exists. Perhaps the applicant should
explore other alternatives to increase the living space of the
existing home in a manner which does not require setback
variances.
STAFF RECOMMENDATION:
The recommendation from staff is to deny the variance on the
basis that the subject site is not unique with respect to other
lots within the neighborhood; the proposed garage would not
observe the spirit of the ordinance; the variance requested is
extreme (688 variance); and the proposed location and setback
would not be consistent with existing development patterns in the
neighborhood.

PLANNING REPORT
SUBJECT: CONTINUATION OF INDUSTRIAL PARK OFFICE
DEVELOPMENT PROPOSAL
APPLICANT: RICHARD SWENSON
SITE: 16940 WELCOME AVENUE

INTRODUCTION•
The developer, Mr. Richard Swenson, has petitioned the Planning
Commission and Council to grant all necessary permits and
variances for a 9600 square foot office warehouse development in
the Prior Lake Industrial Park. Specifically the following
variances being requested:
1. 28 foot setback variance from County Road 12.
2. A variance from all the requirements of the
subdivision ordinance.
BACKGROUND:
This came before the Planning Commission on July 6, 1989,
for a review. The Planning Commission tabled the item to allow
the applicant time to gather additional data and address specific
issues (see attached Planning Report dated July 6, 1989, Planning
Commission Minutes of July 6, 1989). The consensus of the
Commission was in favor of the concept and Staff should work with
the developer to bring the plan to fruition. The developer also
appeared before the Council on July 3, 1989, to seek an amendment
to the fire suppression code which requires a building of this
kind to be sprinkled. There was general support for an
amendment. The issue however was continued until the applicant
came before the Commission to work out site details and apply for
the necessary variances.
STAFF ANALYSIS:
T e su 7ec s to is located at the intersection of County Road 12
and Welcome Avenue. This is perhaps the most visible and one of
the best sites in the park. The industrial park has evolved over
the years without much direction, little if any focus or ride.
The Planning Commission is asked to continue its abstention by
waiving setback and the entire subdivision ordinance. I do not
believe this community is that desperate for any industrial
growth that it can ignore all health and safety requirements.
Staff has no issue with the County Road 12 setback variance. In
fact this section of the road will be turned over to Prior Lake
when County Road 21 is completed to the south of the site. The
setback will eventually be reduced to 85 feet from the centerline
of the road. County Road 12 after its turned back to Prior Lake
will be a local access street and not carry regional traffic.

The variance from the requirements of the subdivision ordinance
has on the other hand considerable more long range impact on the
industrial area than a setback variance. The unfortunate
situation here is that a variance absolves the landowner from
addressing general health and welfare issues and the City from
developing a focus and answers to some major development issues.
However, the applicant should address those elements of the
subdivision ordinance which by the nature of their requirements
are applicable. These include:
1. Park Dedication; Chapter 6 -6 -8 - Park dedication has
been established for the 1.3 acres site at $910.00.
2. Lot location; Chapter 6-6 -4 - Requires lots to have
frontage on a public street. In this case Welcome
Avenue is a private street. The applicant should
furnish proof of an easement over Welcome Avenue to give
him access to County Road 12.
3. Topsoil and sodding; Section 6 -7 -2 - Requires the
applicant to spread a minimum of four inches of topsoil
over the boulevard, front, and side yards. Sod must be
placed on the front yard and side yards plus the
boulevard.
4. Required Subdivision Trees; Section 6 -7 -1A. The
applicant is required to plant four 2.5 caliper trees.
Due to the excessive frontage the developer should plant
seven boulevard trees.
The attached site plan submitted by the applicant shows greater
detail than the plan of July 6. The site plan indicates a 9600
square foot building reduced from 12,000 square feet. The site
septic system design shows an increase in capacity from 350 gpd.
to 672 gpd. An alternative site is shown and will be reserved in
the event it becomes necessary. The well is located directly to
the west of the building and meets all code requirements.
2440 square feet of the building is devoted to office which
requires nine parking spaces. Eleven are provided for that
purpose in the front of the building. A 24 foot wide paved
driveway from Welcome Avenue provides access to the front of the
building. The driveway however, should be redesigned to provide
a perpendicular alignment with the parking lot. The northerly
most driveway must be reduced to 24 feet in width to meet code.
A seventh tree should be added 15 feet to the north of this drive
to balance plantings.
The outside storage or parking area to the rear of the building
is defined by a gravel surface. The plan does not indicate a
fence but eventually such storage areas are fenced for security
purposes. Generally such storage areas produce a poor visual
impression due to the disorganized nature of the stored materials
and vehicles. Therefore this area should be fenced to 80%
translucent to eliminate such a negative element.
STAFF RECOMMENDATIONS:
Staff recommends that a 28 foot front yard variance be granted
since County Road 12 will be turned back to the City in the near
future and be designated a local street under which the purposed
setbacks are within code. To move the building north for
compliance would reduce the outside storage at the rear of the
building and relocate it in the front adjacent to County Road
12 would be a negative impact to the area, and that the setback
variance be contingent on:
The realignment of the southern access drive.
The addition of one 2 1/2 inch boulevard tree 15 feet
north of the north drive.
The fencing of the storage area to be at least 80%
translucent.
That the daily water usage not exceed 672 gallons per
day.
The warehouse area not contain floor drains.
And that a variance be granted to deviate from the requirements
of the Subdivision ordinance with the exceptions as previously
outlined.

ITEM VI -RICK SWENSON- SETB SUBDIVISION & SEPTIC CODE VARIANCE
Rick Swenson, 1941 Normandale Road, Prior Lake, MN, stated his
proposal is to build a 12,000 sq. ft. office /warehouse building
at 16940 Welcome Ave. in the Industrial Park and he is requesting
a variance from the county road setback requirement, waive
subdivision requirements and a variance on septic code
standards.
Deb Garross presented the report as per memo of July 6, 1989
Variance has been changed from 50 to 29' from the county road.
Staff recommends tabling the application until site plans, septic
study and building plans are completed. At this time the
Planning Commission was asked to consider the concept plan and
give direction to the applicant.
Comments from the Commissioners were in favor of concept, City
should take action to help develop the Industrial Park,
clarification on usage, coverage ratio, and the consensus was
that a plan could be worked out.

A three minute recess was called at 9:57 p.m. Chairman Wells
asked to be excused and turned the gavel over to Commissioner
Kedrowski for the remainder of the meeting. Meeting called to
order at 10:00 p.m. by Commissioner Kedrowski.
Dave Unmacht, City Manager, addressed the Commission on several
items. Congratulations were extended to Commissioners Arnold,
Roseth and Loftus on being reappointed to the Planning Commission
for two years.
Mr. Unmacht asked for a volunteer from the Commissioners to serve
on the Lake Review Study Committee. The Committee's
responsibil.ties were outlined briefly to the Commissioners and
Mr. Unmacht would like the name of the volunteer by August 3.
The second item Mr. Unmacht presented to the Planning Commission
was the Industrial Park situation. The atmosphere has changed
from residential to industrial planning. Several possiblities are
being pursued. Professional consultants are being considered to
conduct an industrial location study for the City of Prior Lake.
The clarification on the duties of the Economic Development
Committee was given to the Commissioners. Suggestion was made
that the Planning Commissioners be placed on the EDC mailing
list.
Minutes of the Prior Lake City Council July 3, 1989
The next order of business was Discuss Business Request Regarding
City Owned Vacant Lot in Downtown. This item was removed from
the agenda due to cancellation by interested parties.
The next order of business was a public hearing at 8:00 p.m.,
however, due to the fact it was only 7:35 p.m. Council decided to
adjourn for a closed attorney /client session to discuss the
McDonald lawsuit.
MOTION MADE BY WHITE, SECONDED BY SCOTT, TO ADJOURN THE MEETING
FOR A CLOSED ATTORNEY /CLIENT SESSION.
Upon a vote taken, ayes by Andren, Fitzgerald, Scott and White,
the motion passed unanimously.
The Attorney /Client session was called to order at 7:35 P.M. Attorney
Those present were: Councilmembers Andren, Fitzgerald, Scott and client
White, City Manager Unmacht, Attorney Kassel, Recording Secretary Sesssion
Birch, Assistant City Manager Schmudlach and City Planner

Councilmember Fitzgerald stated that he would sit in on the
session but would not enter into any discussion on the matter
due to the fact that he had at one time held an interest in the
property.
The regular meeting reconvened at 7:50 p.m.
City Manager Unmacht commented briefly on the recent LMC Wrap Up
Session and the status of the City's 1989/1990 budget process.
Counc.lmember Fitzgerald brought up the subject of The Harbor and
its violation of the PUD. Discussion occurred on what type of
enforcement was necessary and to what degree the PUD was being
violated. General concensus of the Council was for staff to
actively enforce the violations.
The next order of business was a Public Hearing to Consider Fire
Suppression Code Amendment in I -2 District.
The Public Hearing was called to order at 8:08 p.m. City Manager
Unmacht explained the Fire Suppression Code and how it had come
to be adopted. City Planner Graser presented details of Rick
Swenson's proposal to build an office - warehouse building in the
Credit River Industrial Park. Swenson is requesting that Council
consider an amendment exempting the I -2 Industrial District from
the requirements of City Code Section 4 -4 -1 (B) 5 Fire
Suppression Sys'.ems. Discussion followed. General consensus
of support existed for the amendment, however, no formal action
was taken at this time.
