(612) 4474230 / Fm (612) 4474245 PLANNING COMMISSION MINUTES APRIL 20, 1989 The April 20, 1989, Prior Lake Planning Commission was called to order at 7:30 P.M. by Chairman Wells. Present were Commissioners Loftus, Roseth, Wells, Arnold, Kedrowski, and Director of Planning, Horst Graser. ITEM I - REVIEW MINUTES OF PREVIOUS MEETING Amendment to John Meyer variance accepted. Commissioner Loftus questioned Deb Garross's comments in paragraph four on page two. Sentence amended to read as follows: Ms. Garross reported that since Lakeshore Management began, variances have not been granted greater than 503 of required setbacks. Question on paragraph seven, containing the motion. Wording of the motion as follows verbatim: MOTION BY LOFTUS, SECOND BY ARNOLD, MOVE THAT WE NOT GRANT THE REQUEST FOR THE 55.8 LAKESHORE VARIANCE FOR THE PROPERTY AT THE SAME ADDRESS, 3198 LINDEN CIRCLE N.W. THEN THE REASON BEING IS THAT IT WOULD BE AN EXTREME VARIANCE TO GRANT SUCH A VARIANCE AND IT WOULD EXCEED THE 503 STANDARD THAT WE TRY TO ADHERE TO IN ALL CASES, AND IT WOULD APPEAR THAT IT WOULD SET A PRECEDENT AND A DEVIATION FROM THE STANDARD WE TRY TO ADHERE, IN THAT SENSE HAS THE POSSIBLITY OF BEING DETRIMENTAL TO OTHER APPLICATIONS AND VARIANCE REQUESTS IN THE COMMUNITY TO APPLY THAT COMMON GOOD AND FOLLOW THE BENEFIT OF THE COMMON GOOD. MOTION BY KEDROWSKI, SECOND BY LOFTUS TO AMEND THE MINUTES AS STATED. Vote taken signified ayes. MOTION CARRIED. Mr. Graser reported that the Sienna Corporation Development would be appearing before the Planning Commission in the near future. 7:37 P.M. Recess called until 8:00 P.M. while awaiting the arrival of John Pomaville. 8:00 P.M. Meeting called back to order. ITEM I HEARING - VARIANCE - JOHN POMAVILLE John Pomaville, 14500 Shady Beach Trail. - is requesting a 57' lakeshore variance and 5' south sideyard variance to improve property. He had assumed the carpenters that were building his deck would get a permit, but they hadn't and work was started without it. 4629 Dakota St. S.E., Prior lake, Minnesota 55372 / Ph. (612) 4474230 / Fm(612)4474245 PLANNING COMMISSION MEETING APRIL 6, 1989 PAGE 2 Mr. Graser presented the information on the variances as per memo dated 4- 20 -89. Letters from the DNR and Frank Miller were presented which stated objection to granting the variances. Letter from Frank Miller was recognized as being part of the agenda and was noted in the record. Comments from the Commissioners were; trellis should be cut back, 6' removed from the deck, try to resolve differences with neighbors, it is the responsibility of the property owner to know the laws. MOTION BY KEDROWSKI, SECOND BY ARNOLD, TO APPROVE A 5 SOUTH SIDEYARD VARIANCE FOR A TRELLIS BECAUSE IT IS CONSISTENT WITH PAST PRECEDENT AND WOULD NOT EXTEND BEYOND THE EXISTING PORCH WHICH WAS PREVIOUSLY BUILT ON THE SITE. Vote taken signified ayes by Loftus, Roseth, Arnold and Kedrowski, nay by Wells. MOTION CARRIED. MOTION BY LOFTUS, SECOND BY KEDROWSKI, TO GRANT A 57' LAKESHORE VARIANCE FOR A SECOND STORY DECK - RATIONALE THAT A PORTION OF THE HOUSE IS LOCATED 18 FROM THE 904 AND THE APPROVED DECK WILL NOT EXTEND CLOSER TO THE 904 THAN THE EXISTING HOME. Discussion followed concerning: lot is substandard size, opposition to motion, unique piece of property, hardship to applicant. Vote taken signified ayes by Wells, Kedrowski, Loftus, Roseth, nay by Arnold. MOTION CARRIED. MOTION BY KEDROWSKI, SECOND BY ARNOLD, TO ADJOURN MEETING. VOTE TAKEN SIGNIFIED AYES, MOTION CARRIED. (612) 4474230 / Fax (612) 4474245 VARIANCE - DEAN FLOCK MAY 4, 1989 SUBJECT: To consider a 25' rear yard variance for 5620 Fairlawn Shores Trail. The subject site is owned by Kay and Lee Warring STAFF ANALYSIS• T e su 7ect site is zoned R -1 /S -D with a required rear yard setback of 25'. The topography of the subject lot is very steep with a sharp dropoff to the lake. The applicants lot is approximately 13,000 square feet in size. The immediate area is predominately developed with a mixture of new and older year round homes with very few vacant lots remaining. Most of the homes in the area meet the 25' rear yard setback. The topography alone the lake is very steep offering a unique set of building obstacles. There have been a few lakeside and side yard variances granted for this area. The specific proposal is to build a single family home with an attached three (3) car garage on Lot 27 and P/O Lot 26. The topography of the lot is such that the house must be setback approximately 50' from the 904 contour line. This proposal will put the east corner of the garage on the rear property line. The proposed home may be to large for this particular lot. The applicants proposed coverage ratio is approximately 238 which indicates that a redesign of the home may be necessary. Due to the rather large size of the lot the proposed location of the garage is not the only option. One possible plan could be to construct a 22' wide garage on the east side of the home. This layout would keep sitelines similiar with the adjacent homes and would blend in well with the surrounding area. The garage could be built with two levels with a storage area on the lower half. The applicant would need a 5' side yard variance with this proposal. It is staff's opinion that this type of layout would not be out of character for this neighborhood. Another option would be to scale down the garage size on the original proposal and allow a 22' two car garage. A 12.5' rear yard variance could be granted, which would follow the 508 rule. This would cut down on the amount of fill needed to support the garage and the sightline would be slightly improved. RECOMMENDATION• The recommendafion from staff would be to deny the 25' rear yard variance. Hardship is not shown, there are other design alternatives that would blend in better with the immediate area. (612) 4474230 / Fax(612)4474245 PLANNING REPORT "VA10PC" SUBJECT FRONT YARD VARIANCE APPLICANT JOHN BEAR SITE: 16770 ANNA TRAIL DATE: MAY 4, 1989 INTRODUCTION• T e Panning Department has received an application from John Bear requesting a 20' front yard variance for Lot 1, Jo -Anna Stepka's Hi -View Addition to Prior Lake. The applicant proposes to build a two story garage /storage shed, thirty feet from the right of way of State Trunk Highway 13. BACKGROUND: The su 7act site is zoned R -1 Urban Residential and is a corner lot requiring a 50' setback from STH 13 right of way and a 25' setback from Anna Trail. The northerly and westerly property lines are considered to be side yards and require 10' setbacks. Jo -Anna Stepka's High -View Addition to Prior Lake was platted in 1954. The home located on Lot 1 was built in 1961, prior to the construction of existing STH 13. The existing home contains a single car garage and is located within a few feet of STH 13 right of way. The proposal is to build a two story garage in the location indicated on the attached map. The garage will be used primarily as a storage shed. The westerly part of Lot 1 slopes dramatically to a stream which runs perpendicular to STH 13. The proposed location for the garage /shed is a logical choice considering the topographic limitations of the site. RECOMMENDATION: The recommen ation from staff is to approve the 20' front yard variance as requested. The proposed garage /shed will not encroach upon the STH 13 right of way closer than the existing single family home.
