(612) 447 -4230 / Fax (612) 4474245 PLANNING COMMISSION MINUTES SEPTEMBER 21, 1989 The September 21, 1989, Prior Lake Planning Commission was called to order at 7:30 P.M. by Chairperson Kedrowski. Those present were Commissioners Arnold, Loftus, Roseth, Wells, Kedrowski, Assistant City Planner Deb Garross, and Planning Intern Gary Schmitz. ITEM I - REVIEW MINUTES OF THE PREVIOUS MEETING MOTION BY ARNOLD, SECOND BY WELLS, TO APPROVE MINUTES AS WRITTEN. Vote taken signified ayes by Wells, Arnold, Loftus, Kedrowski and Roseth. MOTION CARRIED. ITEM II - LEONARD BIXBY - SIDE YARD VARIANCE Leonard Bixby, 4075 Roanoke Ave. Prior Lake, stated he is requesting a variance from Section 9.283 and 9.3B1C and a 5' east sideyard variance to build a two car garage. Gary Schmitz presented the information as per memo of September 21, 1989. Staff felt the applicant had attempted to design a structure to fit within the available building envelope and would recommend approval of the 5' east sideyard variance. As the lot is a lot of record and a substandard lot, the applicant should be allowed to develop the property and the variance is in line with the character of the neighborhood therefore the variance to Sections 9.283 and 9.3BiC 1s recommended for approval also. Comments from the Commissioners concerned sidewalk location and neighborhood development. MOTION BY ROSETH, SECOND BY WELLS, TO APPROVE A 5 EAST SIDE YARD VARIANCE FOR 4075 ROANOKE AVENUE AND SECTIONS 9.2B3 AND 9.3B1C VARIANCES OF THE SHORELAND MANAGEMENT ORDINANCE AS THE LOT IS SUBSTANDARD IN AREA AND DIMENSION AND THE VARIANCE WOULD NOT BE DETRIMENTAL TO HEALTH AND WELFARE OF THE NEIGHBORHOOD AND IS IN LINE WITH PAST VARIANCES THAT HAVE BEEN GRANTED. (612) 4474230 1 fax 1612) 4474245 PLANNING COMMISSION MEETING MINUTES SEPTEMBER 21, 1989 PAGE 2 ITEM III - DANIEL KLAMM - FRONT YARD VARIANCE Daniel K1aa¢n, 4130 - 140th St. N.E., Prior Lake, stated that he is applying for a 54'8 variance from County Rsad 42 in order to improve his home. Gary Schmitz presented the information as per the memo of September 21, 1989. A problem was discovered when the survey was received Tuesday morning, showing that the distance from County Road 42 as 94' and not 95.2, thereby making the variance needed a 56' front yard variance. This leaves three options for the applicant. Table the hearing until the next meeting in order for surrounding properties owners to be notified of variance change. Scale down application i'4 ". Change the design to conform with the variance which was provided to adjacent property owners. A ten minute recess was called at 7:40 P.M., for the applicant to consider these options. Meeting called back to order at 7:50 P.M. Mr. Klamm stated that he would take the 50' variance at this time and reapply for the 56' variance for the front yard. Mr. Schmitz stated that the home was built in 1965 and did meet requirements that were in effect at that time, therefore Staff recommends approval of the variance as the hardship was caused by the Ordinance change and not the result of the applicants actions. Norm Casperson, contractor for the project reported that the County is planning to purchase property for a proposed road to the south so the situation should improve. Chairperson Kedrowski read into the record a letter from Bradley Larson, County Highway Engineer, stating that they have no objections to the requested variance. Comments from the Commissioners were; variances on the whole structure, procedure for the variance, and frontage road system on County Road 42. MOTION BY LOFTUS, SECOND BY ARNOLD, TO GRANT A 50' FRONT YARD VARIANCE FROM COUNTY ROAD 42 FOR THE PROPERTY AT 4130 - 140TH STREET N.E., APPLICANT IS TO MAKE THE REQUESTED CHANGES WITHIN THE 50' VARIANCE FOR THE PROPERTY. RATIONALE BEING THAT THE HARDSHIP IS CAUSED BY THE ORDINANCE AND NOT BY THE APPLICANTS ACTION AND IS NOT DETRIMENTAL TO THE HEALTH AND WELFARE TO THE NEIGHBORHOOD. AN AMENDMENT TO THE MOTION STATED THAT THE APPLICANT AGREED TO PLANNING COMMISSION MEETING MINUTES SEPTEMBER 21, 1989 PAGE 3 AMEND HIS APPLICATION TO 50'. SURVEY FURNISHED IS TO BE EXHIBIT A. Vote taken signified ayes by Roseth, Wells, Kedrowski, Loftus, and Arnold. MOTION CARRIED. ITEM III COUNCIL AND PLANNING COMMISSION WORKSHOP ITEMS Items City Council want to discuss are County Road 42 and 13. Mr. Schmitz was called on to give a brief summary of the Savage Council meeting he attended regarding this area. Consensus from the Commissioners that an item of discussion at the workshop should be on communication with Savage. MOTION BY ARNOLD, SECOND BY WELLS, TO ADJOURN MEETING. DATE: October 5, 1989 INTRODUCTION• To co nsider a 56' front yard variance from County Road 42 for Daniel Klamm. The applicant owns an existing home which is located 100' from the centerline of County Road 42. The proposal is to add a 6' entry way feature to the front of the existing home. BACKGROUND: An applied ion for a 54' 8" front yard variance came before the Planning Commission on September 21, 1989. An error in measurement on the site plan mandated that a 56' front yard variance would be needed with the original proposal. The Planning Commission granted the applicant a 50' front yard variance so construction could begin on the sides and rear of the home. The 56' front yard variance would become a separate variance application with new notices sent to the respective property owners. STAFF ANALYSIS• The entry way will extend six feet closer to County Road 42 than the existing home coming to within 94' of the centerline of County Road 42. The current setback standard from County Road 42 is 150' measured from the centerline of the traveled roadway. A copy of this application was forwarded to Brad Larson, the Scott County Highway Engineer for review. Comments from Scott County will be presented at the meeting. STAFF RECOMMENDATION: The recommendation fFom staff is to approve the 56' front yard variance as requested. when the home was built in 1965 it was compliant with the 50' setback standard used at that time. In subsequent years the standard was raised from 50' to 150' which caused the structure to become nonconforming. The hardship is caused by the ordinance and is not the result of actions of the property owner. The variance observes the spirit of the ordinance, produces substantial justice to the property owner and would not be contrary to the public interest. 4629 Dakota St. S.E. Prior Lake, stated that he is applying for a 56' front yard variance in order to add a 6 way to the front of his existing home. Gary Schmitz presented the information as per memo of October 5, 1989. Due to an error in measurements on the applicants original variance proposal, Mr. Klamm is now requesting a 56' front yard variance. The Planning Commission granted the applicant a 50' variance so that he could begin construction on the sides and rear of the home at the September 21, 1989, Planning Commission meeting. Schewe Director of PLanning Recording Secretary "VA27PC " PLANNING REPORT SUBJECT LOT AREA VARIANCE APPLICANT WAYNE LUNDGREN SITE: LOT 50 AND THE EAST 1/2 LOT 51, BOUDINS MANOR DATE: OCTOBER 19, 1989 INTRODUCTION: The Planning Department has received a variance application from Wayne Lundgren who resides at 14349 Watersedge Trail. Mr. Lundgren has proposed to build a new single family home on Lot 50 and the East 1/2 of Lot 51, Boudin's Manor. See attached maps and survey for reference to this application. BACKGROUND: Boud'iTManor was platted in 1950 into predominantly fifty foot wide lots. The area was later annexed to the City of Prior Lake in 1974. The subject site is zoned R -1 Urban Residential and is located within the S -D Shoreland District. The minimum lot size for all non lakeshore lots within the Shoreland District is 10,000 square feet. The subject site contains 9,366 square feet. The applicant is requesting a 634 square foot minimum lot area variance in order to build a new single family home as per attached survey. STAFF ANALYSIS• Bou 1n s Manor is fully developed with single family homes and cabins except for seven lots which are all of similar or smaller size than the subject site. Lots in Boudin's Manor have been assessed for sanitary sewer and paving improvements and have been platted lots of record since 1950. The Zoning Ordinance grandfathers lots of record as buildable even though their area and width are less than the minimum requirements of the Ordinance. The shoreland management regulations which do not contain a grandfather clause. Instead the City Council elected to deal with substandard lots of record that are in the Shoreland District through the variance process.
