JANUARY 7, 1988
The January 7, 1988, Prior Lake Planning Commission meeting was called to order
at 7:35 P.M. by Commissioner Arnold. Present were Commissioners Kedrowski,
Loftus, City Planner Graser and Assistant City Planner Garross. Absent were
Chairman Roseth and Vice Chairperson Wells.
Motion by Loftus, second by Kedrowski to nominate Cammissioner Arn.31d as Acting
Chairperson for the January 7, 1988, Planning Commission meeting.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus; the motion carried.
ITEM I - RRVIEK OF MINUTES OF PREVIOUS MEETING
MOTION BY KEDRCWSKI, SEODRD BY LOFTUS TO APPROVE THE DECEMBER 17, 1987, PLANNING
COMMISSION MINUTES AS PRESENTED.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus; the motion passed
unanimously.

Assistant City Planner Garross discussed specific tree planting plans in
subdivisions per memos dated 1/7/88.
The Planning Commissioners discussed the Subdivision Ordinance Amendment.

MINUTES OF THE PRIOR LAKE PLANNING COMMISSION JANUARY 7, 1988
A five minute recess was called at this time. The meeting resumed at 8:00 P.M.

Dennis Fitzgerald, developer, commented that this is a new plan from the last
one discussed at the October 1, 1987 meeting. He is requesting Preliminary Plat
approval.
City Planner Graser commented per memo dated January 7, 1988. Also Engineering
memo dated December 23, 1987 and Finance memo dated December 29, 1987.
The audience had concerns over the traffic and safety off of Highway 13 and Fish
Point Road onto Omega Trail. Therefore the residents would like Omega Trail
kept �,s a trail and not widened.
The Planning Commissioners commented on the concerns. Acting Chairman Arnold
read a letter from Peter Yearneau, requesting the property be kept as is, for
the record.
MOTION BY REDROIT.iKI, SECOND BY LOFTOS TO GRANT PRELIMINARY PLAT APPROVAL FOR
"THE TREES" SUBDIVISION CONTINGENT UPON:
1.) ALL DRAINAGE AND UTILITY EASEMENTS REQUIRED BY THE CITY ENGINEER.
2.) THE STORM SH ER OGTEM WEST OF OMEGA TRAIL MUST HAVE RIP RAP AND SURGE
BASIN TO MINIMIZE FLOW VELOCITY.
3.) AN ANALYSIS OF THE EXISTING WRTERMAIN IN OMEGA TRAIL MUST BE PERFORMED
TO DE EP= 4E THAT A PRESSURE OF 20 Lffi. PER SQUARE nK9 CAN BE
MAINTAINED FOR ALL FLOW CONDITIONS.
4.) A VARIANCE BE GRANTED TO PERMIT AN 850 FOOT CUL- DE-SAC.
5.) THE TREE PLANTING REQUIREMENTS AND VERIFICATIONS BE DEFERRED UNTIL
OCCUPANCY PERMIT STAGE.
ALSO REOONMEND TO THE CITY COUNCIL TO IMPROVE THE GRAVEL PORTION OF OMEGA TRAIL
IN CONJUNCTION WITH THE "THE TREES" STREET IMPROVEMENTS.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus; the motion passed
unanimously.
MOTION BY LOFTUS TO CLOSE THE PUBLIC HEARING FOR PRELIMINARY PLAT APPROVAL FOR
"THE TREES" SUBDIVISION, SECOND BY EEDR7WSKI.
Upon a vote taken, ayes by Arnold, Redrowski, Loftus; the motion passed
unanimously.

ITEM IV - VARIANCE REQUEST BY PAUL AND SUE BRE(Y.NEit
Gary Turpening, architectural representative, commented that they had not
received the report from the D.N.R. until the meeting and would like to wait
until City Planner Graser gave his report.
City Planner Graser commented per memo dated January 7, 1988.
Gary Tyr ening commented that the request is for a 55' variance from the
lakeshore due to design of the house, also to maintain a large oak tree, and
since they are unable to obtain more land, obstruction of their view was a
concern.
The Planning Commissioners discussed the variance request and had concerns over
setting a precedent, lack of hardship, coverage ratio of 308, and the D.N.R.'s
cc mnents.
At this time the Breckners requested a conference and that their item be moved
to the end of the Agenda.
ITEM V - VARIANCE REOUFSP BY DAN DUOOS
Dan Duoos commented that he has met and talked several times in the past to City
Planner Graser, Mike Mueller of the D.N.R., and the Prior Lake City Council
about the cabin, and building an addition on the property in Seven Acres due to
the flood plain of the area. Mr. Duoos stated that he has purchased the land
north of the cabin which is in the flood plain. Be would raise the cabin, build
an addition, move the cabin into the addition, complete a lard dike to improve
the area and put in a drainage pipe to direct the `ester to help eliminate the
flooding. The owner to the south is Mr. Duoos' parents and they have no
objections. Mr. Duoos felt the letter from the D.N.R. was a total surprise
since the last time he spoke to Mike Mueller of the D.N.R., who picked out a
plan and said he would recommend it to Mr. Graser. Also Don Benson of the
Watershed District and his hydrologist met with Mike Mueller and recommended a
structure be built to help eliminate water problems. Therefore, after many
meetings and delays Dan felt the plans were now proceeding but to find out
tonight that this is not the case.
City Planner Graser commented per memo dated January 7, 1988.
Mr. Lawrence Miller, 1095 Polk Place, Minneapolis stated that the property north
of Mr. Duoos' cabin is owned by his parents. He felt Mr. Duoos is solving 2
problems with his plant the cabin and the land which is unsuitable and needs a
lot of work and expense and would benefit the City.
The Planning Camnissioners discussed the variance request and had concerns over
the lakeshore variance, flooding, moving the fire hydrant, the concerns of the
D.N.R., and setting of a precedent.

Gary Turpening, representative, commented that they discussed the 308 rule and
felt that could be met. However, the 55' variance request would be a concern
due to the obstruction of their view.
The Planning Canmissioners discussed the variance request and were concerned
over granting a 55' variance and the concerns of the D.N.R.

At this time the Commissioners decided upon March 11th and 12th for their annual
retreat.

The January 21, 1988, Prior Lake Planning Commission meeting was called to order
at 7:32 P.M. by Chairman Roseth. Present were Commissioners Arnold, Kedrowski,
Loftus, City Planner Graser, and Assistant City Planner Garross. Commissioner
Wells arrived at 7:42 P.M.
ITEM I - REVIEW OF MINUTES OF PREVIOUS MEETING
MOTION BY KEDROWSKI, SEODND BY LOMS TO APPROVE THE JM ARY 7, 1988, PRIOR LAKE
PLANNING COMMISSION MINUPFS AS PRESENT®.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth; the motion passed
unanimously.
At this time a 2 minute recess was called. The meeting resumed at 7:35 P.M.
Ralph Heuschele, partner, manager, and attorney for H 6 H Land Development,
presented Greg Ropischke of Westwood Planning S Engineering Company.
Mr. Kopischke commented that Wind Song started in 1979 as Prior HighlanUs
project. Then in 1983, the site came back to the Commission as Wind Song P.U.D.
and given conceptual approval for an equestrian development consisting of 26
lots, a horse barn, and backlot lake access. Due to economic conditions, the
development did not materialize and the P.U.D. was amended in April of 1986.
This time, it was amended for a recreational area including an 8 acre chipping
golf course. The site and utility improvements were completed in 1985. The
amendment to the P.U.D. is to plat the golf open space area at the northern end
of the P.U.D. into 12 single family lots, and delete the community building and
swimming pool complex located in the common area adjacent to the lake. Also,
they would like 10 additional boat slips for a total of 38 as per one boat per
legal lot.
City Planner Graser coimented per memo dated 1- 21 -98, Engineering memo dated
1- 14 -88, and D.N.R. memo dated 1- 15-88.
The audience had concerns over the planting plan and additional dock slips.

MINUTES OF 111E PRIOR LAKE PLANNING COMMISSION JANUARY 21, 1987
The Planning Commissioners discussed the P.U.D. Amendment with regard to higher
density, additional boat slips, the tree planting plan, and traffic at the
intersection of County Road 21 and Lord's Street.
At this time, Chairman Roseth read a message that was telephoned in to the
Planning Department on January 19, 1988, by Harold Dellwo, 4287 Grainwood
Circle, opposing the Wind song Amendment, specifically the addition of boat
slips.
MOTION BY KEDROWSKI, SECOND BY LOFTUS, TO CONTINUE THE PUBLIC HEARING FOR WIND
SONG ON THE LAKE P.U.D. AMENDMENT TO FEBRUARY 18, 1988 AT 8:30 P.M. TO ALLOW
TIME FOR MORE INFORMATION TO BE GATHERED.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.

ITEM III - DISCUSSION OF DOWNTOWN REDEVELGPMENT BY KAY SCH UDLACH
This item was cancelled due to illness.
ITEM IV - VARIANCE CONTINUATION BY DAN WOOS
Dan Duoos camiented that he met with Mike Mueller of the D.N.R. last week and
received approval for his building plan. The plan is to shift the house plan to
the southeast requiring less fill below the 904 contour line, develop an
evacuation plan for the area, relocate the fire hydrant and manhole at the end
of Cove Avenue, and move the cabin into the proposed addition, thus needing a
46' lakeshore variance and a 22' front yard variance. Mr. Duoos stated that he
will work with City Engineer, Larry Anderson, on moving the fire hydrant and
manhole.
City Planner Graser commented per memo dated 1 -21 -88 and the D.N.R. memo dated
1- 19 -88.
The Planning Commissioners discussed the variance.
MOTION BY WELLS, SECOND BY LOFTUS, TO APPROVE THE VARIANCE FOR DAN 1XX= AT
14670 COVE AVENUE SE, CONTINGENT UPON THE FDLIOWING:
1.) GRANT A LAKESHORE VARIANCE OF 46 FEET.
2.) GRANT A VARIANCE FROM SECTION 4.1P TO ALLOW A S1HUCIURE TO BE MOVED
WITHIN THE CITY.
3.) GRANT A VARIANCE TO PERMIT FILL TO EXTEND LESS THAN 15 FEET BEYOND THE
LIMITS OF ANY STRUCTURE BELOW ELEVATION 909.
4.) REQUIRE THE APPLICANT TO MOVE THE FIRE HYDRANT AND MANHOLE AT HIS OWN
EXPENSE.
5.) GRANT A 22 FOOT FRONT YARD VARIANCE.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.

At this time, a 15 minute recess was called. The meeting resumed at 9:15 P.M.
ITEM V - VARIANCE ODNTINUATION FOR PAUL AND SOE BRECRNER
Gary Turpening, representative, commented that the small cabin on the lot would
be torn down and replaced with a new hone. The entrance is built around a yard
of 5 mature oak trees and the driveway angles from the south, due to a private
drive along the north end of the lot. The structure will be a modern home,
country style with lots of glass. The applicant is requesting a 50' lakeshore
variance.
City Planner Graser had no specific camnents since he did not receive any new
additional information before the meeting.
The Planning Commissioners discusseu the variance request and coverage ratio.

At this time, City Planner Graser stated that the Planning Commission Retreat
will be held at the Hilton on March 11th and 12th.
