PLANNING COMMISSION
MINUTES
JUNE 2, 1988
The June 2, 1988, Prior Lake Planning Commission meeting was called to order at
7:30 P.M. by Chairman Roseth. Present were Commissioners Arnold, Kedrwski,
Loftus, and Assistant City Planner Garross. Absent was Commissioner Wells.
ITEM I - REVIEW MDR)TES OF PREVIOUS MEETING
MOTION BY KEDROWSKI, SBOONDED BY ARNOLD, TO APPROVE THE MAY 19, 1988, PRIOR LAKE
PLANNING COMMISSION MDWVTF.S AS PRESENTED.
Upon a vote taken, ayes by Arnold, Kedrwski, Loftus, ROSeth; the motion passed
unanimously.
At this time, Chairman ROSeth read a letter from Matthew Nielson, Savage
Planner /Zoning Administrator, thanking the Camnission for the opportunity to
speak at the May 19, 1988 meeting and for the gifts he received.
ITEM II - VARTANCE-REQUEST RV RICHARD EDGERT N
Mr. Edgerton commented that he is requesting to build a 22 foot garage on a 75
foot substandard lot. At present, there is no garage and the proposed would be
consistent with other homes in the area.
Assistant City Planner Garross commented per memo dated June 2, 1988.

VARIANCE FOR THE EAST HALF OF LOT 24 AND LOP 25, WEST SIDE ADDITION, 4449
OOI.ORADO STREET AND SINCE THE PLANNING COMMISSION HAS GRANTED SIMILAR VARIANCES
IN INSTANCES WHERE THERE IS NO EXISTING HOME WITH NO GARAGE AND SINCE IT WOULD
NOT BE DETRINWAL TO THE HEALTH, WELFARE, OR PROPERTY VALOES OF THE
NEIGHBORHOOD.
Upon a vote taken, ayes by Arnold, Kedrwski, Loftus, Roseth; the motion passed
unanimously.
ITEM III - SHORELAND VARIANCE REQUEST BY JCHN AND SANDRA BREED ANN
Sandra Breeggemann commented that the property was purchased in 1976, and they
would like to sell the lot to a first home buyer. Therefore they are requesting
a variance fram the 10,000 square foot requirement to 9,000 square foot building
envelope. They feel they are being penalized for owning a lot before the
Shoreland Ordinance changed and what happens now since they have been paying
taxes on a buildable lot.

The audience comments were in regard to drainage, type of house, addition of
garage, and what happens with buildable lots in the Shoreland District.
Assistant City Planner Garross commented per memo dated June 2, 1988. Also, Ms.
Garross stated that she received a phone call from Mildred Borchardt, area
resident, in opposition to the variance request due to density of the area.
Cmadssioner Arnold excused himself at this time to attend wake services for
Councilman Larson's son.
The Planning C=nissioners discussed the request for a variance from the
required square footage for shoreland district, and felt that the City Council
should set policy and that the Commissioners are there to carry policies out.
However, they feel it isn't fair to the property owners who have been raying
taxes on a buildable lot but to set a precedent at this time would be
detrimental.

The June 16, 1988, Prior Lake Planning Commission meeting was called to order at
7:32 P.M. by Chairman Roseth. Present were Commissioners Arnold, Loftus, wells,
City Planner Graser, Assistant City Planner Garross, Commi.;sioner Kedrwski
arrived at 7:52 P.M.

T II - QUNMES YOODi_MRST VARIANCE CONTDMTION
City Planner Graser commented that a letter received from Mike Mueller, DNR, on
June 10, 1988, states that adjacent lots do not have to be combined if under
different ownership at the time of application. Therefore, no action is
necessary on this item.
At this time a 15 minute recess was called. The meeting resumed at 8:00 P.M.
ITESI III - SuOR&M VARIANCE REQUEST BY ELY: ' O'KEEFE
Mr. O'Keefe, realtor for the Heirs of Eunice Boltz (Ellen Magnuson Heirs
representative), commented that a 1,500 square foot variance is requested for
Lot 34 and Part of Lot 35 Fairview Beach. The buyer is requesting a loan from
the bank who in turn wants a guarantee that it is buildable before issuing the
loan.
Assistant City Planner Garross canmented per DNR memo dated June 10, 1988 and
staff's memo dated June 16, 1988.
The Planning Camnissioners felt that acting on this variance request prior to
the City Council hearing Monday, June 20, 1988 would be in conflict with a
previous similar request.

ITEM IV - SIDE YARD VARIANCE REQUEST BY MICHAEL MCGAHEY
Mr. mcGahey comented that construction on the lot is restrained by sanitary
sewer line, steep topography, and the 50 foot lot size. There is a small summer
cottage on the lot which they are making into a permanent hone but there is no
garage and a storage area is needed. Therefore, the request is for a five foot
east side yard variance for 14948 Pixie Point Circle, Lot 5, Eastwood First
Addition.
Assistant City Planner Garross commented per memo dated June 16, 1988. Ms.
Garross also stated that a letter was received from Edward S Lynn Fieker, area
property owner, with no objection to the variance request except that the
drainage situation is a concern.
The Planning Camnissioners discussed this variance request.
MOTION BY WELLS, SECONDED BY KIDROASKI, TO APPROVE A FIVE FOOT EAST SIDE YARD
VARIANCE FOR 14948 PIXIE POINT CIRCLE, LOT 5, EASTWOOD FIRST ADDITION, SINCE THE
VARIANCE WOULD NOT BE DETRIMENTAL TO THE HEALTH OR GENERAL. WELFARE OF THE
O"UNIITY AND IS CONSISTENT WITH PAST DECISIONS OF THE PLANNING COMMISSION.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.
ITEM V - LAKESHORE VARIAN' REDDEST BY JOHN B. KELLY
Mr. Kelly, 5460 Candy Cove Trail, commented that the variance requests are
needed due to the steep slope of the lots. However, he could work within the 25
foot variance rule.
Assistant City Planner Garross commented per memo dated June 16, 1988.
The Planning Commissioners discussed the variance requests with regard to
alignment of existing structures, notification of neighbors, coverage ratio, and
compliance.
MOTION BY WELLS, SECONDED BY ARNCiD, TO APPROVE A 4 LOOT SIDE YARD VARIANCE MID
A 25 FOOT LAKESHORE VARIANT: FOR LOT 16, CANDY OWE PARK, SBKZ IT IS NOT
DETRIMENTAL TO THE HEALTH AND WELFARE OF THE COMMUNITY AND CONSISTENT WITH PAST
SIDE YARD VARIANCE REDUESTS.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, RDseth, Wells; the motion
passed unanimously.
NOTION BY WELLS, SECONDED BY ARN(LD, TO APPROVE A 7 FOOT SIDE YARD AND A 25 FOOT
LAKESHORE VARIANCE FDR LOT 17, CANDY COVE PARK, SINCE IT IS IN LINE WITH CURRENT
STRUCTURES AND IT IS NOT DETRIMENTAL TO THE HEALTH AND WELFARE OF THE
COMMUNITY.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.
CITY OF PRIOR LAKE
REED'S ISLAND INC., - VARIANCE
JUNE 16, 1988
SUBJECr:
4b consider a 63' foot lakeshore variance for Heed's Island. The applicant,
Larry Gensmer, has submitted a proposal to build a 36 x 40 foot seasonal cabin
on the island as per attached survey. The island is owned by some 25 different
individuals. The proposal is that all owners will be required to enter into and
follow the stipulations of the attached Anchor Point Yacht Club Association
Rules and Regulations.
STAFF ANALYSIS:
Reed's Island is located on lower Prior Lake between the Points of Martinson's
Island, Breezy Point and Candy Cove. The island is unsewered and is zoned
R- 1 /S-D. The request is to build a seasonal cabin on the westerly pert of the
island. The required structure setback is 100 feet for unsewered areas of
General Development Ickes. The proposal is to locate the cabin 37 feet from the
904 contour which requires a 63' foot lakeshore variance. Attached find a
survey, structural plans and association rules and regulations.
The proposal consists of a 36 x 40 structure which will be placed as per survey.
Comments from the DNR have indicated that the structure must be constructed on
fill so that the lowest floor (including basement) is at or above the regulatory
flood protection elevation of 909. In addition, the finished fill must extend
at least 15 feet out from the structure in all directions. When this
application was first submitted, a septic system was proposed for the site. The
setback requirements for septic systems are 75' feet from the 904 which cannot
be met as originally proposed. The DNR has indicated that the septic tem
must also be elevated above the flood elevation and recommends that state S PCA
requirements be adhered to. Due to the topographical constraints of the island,
the applicant has amended his request whereby a gas incinerator toilet system is
proposed instead of a traditional septic system.
The proposed structure indicates a kitchen facility. The disposal of waste
water generated by the kitchen use has not been addressed in this application.
Also, the survey submitted indicates only the exterior walls of the structure.
However, the structural plans indicate two screen doors and deck additions on
both the north and south sides of the structure. The variance requested is for
the structure only, no attempt has been made to indicate the deck additions on
the survey. Both issues pertaining to waste water and the deck additions should
be addressed by the applicant prior to approval of this variance.

The recommendation from the DNR is attached to the agenda packet. There is
really no alternative location on the island for a structure to be placed which
will meet £load plain requirements. The structure will be seasonal in nature
and has been proposed in the most logical location of the island. Staff
recamrends approval subject to the following conditions:
1. Floodplain Ordinance elevation and fill requirements be satisfied.
2. Waste water situation pertaining to the proposed kitchen be addressed to
the satisfaction of staff.
3. Applicant redesign the location of the proposed decks in a manner which
minimizes the amount of variance required.
4. A copy of the association agreements be placed on file with City Hall.
S. Erosion control measures be implemented immediately upon removal of arr
vegetation or ground cover and natural vegetation be restored
immediately upon coWletion of construction.
