The October 20, 1988, Prior Lake Planning Commission meeting was
called to order at 7:32 P.M. by Chairman Wells. Present were
Commissioners Arnold, Kedrowski, Loftus, Roseth, and Assistant
City Planner Garross.
ITEM I - REVIEW MINUTES OF PREVIOUS MEETING
MOTION BY ROSETH, SECONDED BY KEDROWSKI, TO APPROVE THE OCTOBER
6, 1988, PRIOR LAKE PLANNING COMMISSION MINUTES AS PRESENTED.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth,
Wells; the motion passed unanimously.
ITEM II - LOT AREA VARIANCE REQUEST BY MARVIN DEUTSCH
Marvin Deu sc cowmen a that the request is to JOUI13 a lake view
home which will be 35 X 40' with a deck on the front of the home.
The request tonight is for a minimum lot area variance.
Assistant City Planner Garross commented per memo dated October
20, 1988.
The area residents had concerns over neighborhood quality and
value with a small structure in a congested area, and a quality
home being built. They also feel there is no hardship here and
this is not in the public interest.
Bob Walters, owner of Lot 35, commented that his big Oak tree was
severally damaged when construction started on Lot 34. He is
also opposed to the variance request in order to build a home on
Lot 34.
The Planning Commissioners discussed the concerns of the area
residents with regard to the minimum lot area variance request
for Lot 34. They felt this is considered a buildable lot of
record and the hardship is the result of the ordinance not the
property owner.

FOOT MINIMUM LOT AREA VARIANCE I=R LOT 34, BOUDINS MANOR SINCE IT
IS A BUILDABLE LOT OF RECORD, THE HARDSHIP WAS CAUSED BY THE
SHURELAND ORDINANCE ADOPTED IN 1987, NOT THE PROPERTY OWNER, AND
IT DOES OBSERVE THE SPIRIT OF THE ORDINANCE.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth,
Wells; the motion passed unanimously.
MOTION BY ARNOLD, SECONDED BY KEDROWSKI, TO APPROVE A 6% COVERAGE
RATIO VARIANCE FOR LOT 34, BOUDINS MANOR.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth,
Wells; the motion passed unanimously.
At this time the Commissioners established February 10 & 11,
1989, as first choice for the annual retreat and January 27 Q 28,
1989 as second choice. The location will be established after
review of different sites has been made.
NOTION BY ROSETH, SECONDED BY LOFTUS, TO ADJOURN THE OCTOBER 20,
1988, PRIOR LAKE PLANNING COMMISSION MEETING.

SUBJECT SITE: 16072 EAGLE CREEK AVENUE

INTRODUCTION:
The Planning Department has received an application from Charles
Brazier to consider a 2.5 foot south side yard variance. The
applicant wishes to build a 12 x 20 addition to the easterly side
of his existing home as per attached survey.
SITE ANALYSIS:
The site is a lakeshore lot which is zoned R -1 Urban Residential
and is in the S -D, Shoreland District. The neighborhood is fully
developed with single family homes and renovated cabins. The
lot slopes in a westerly direction down to the lake of Prior
Lake. There is a mature tree located in close proximity to the
area of the proposed addition. If the variance is approved, it
is likely that the tree would have to be removed.
STAFF REVIEW:
The staff review of this variance has been conducted in terms of
the four standards specified in the Zoning Code and precedent.
The hardship in this case is not due to the ordinance but would
be caused by the property owner. Literal enforcement would not
result in undue hardship, because the lot is currently developed
with a single family home. The property contains no unique
characteristics which make it different from other lots in the
immediate neighborhood.
The variance would not, in staff's opinion, be contrary to the
public interest. The home is developed in an area of the
community which is characterized by different housing styles
which were built many years ago. Many of the cabins and existing
homes are at variance with lakeshore, side yard and rear yard
setback requirements. In addition the subject site is
considered to be a substandard sized lot by today's zoning

requirements. The Planning Commission has tended to allow up to
five foot side yard variances for substandard lots, especially in
instances where the addition will follow the lines of an existing
wail.
Staff has received no objections to the variance as requested.
The DNR was not informed of this request because it does not
involve a variance from a shoreland management requirement.

16072 Eagle Creek Avenue. The approval may be granted based on

REQUESTED ACTION: The applicant wishes to build a 12 X
20 foot addition to the easterly
side of his home as indicated on the
attached survey. The addition is
proposed to be located 7.5 feet from
the southerly property line. The
required side yard setback is 10
feet. The applicant has requested
the Planning Commission to 9rant a
2.5 foot south side yard variance in
order to build his addition.
