APRIL 2, 1987
The April 2, 1987 Prior Lake Planning Commission meeting was called to order at
7:35 P.M. by Chairman Loftus. Present were Commissioners Arnold, Kedrowski,
Roseth, Wells, City Planner Graser and Assistant City Planner Garross.
ITEM L - IWIrw MINUTES OP PREVIOUS MEETING
MOTION BY R1SETH TO APPROVE THE MI14UTES OP THE MAIM 19, 1987 PLANNING
COMMISSION MEETING AS PRESENTED, SBODRDED BY ARNOLD.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, RDSeth, Wells; the motion
carried.
City Planner Graser commented that SAS Development called and felt they could
not be ready with their data by this meeting. The Public Hearing was
continued to April 16, 1987 at 7 ;35 P.M.
ITEM III - IANCE EQUE .T BY M7 =
Greg Eide commented that the request is for a 34 foot front yard variance from
the southeast property line for Lot 26, Fairview Beach.
Assistant City Planner Garross commented per memo dated 4 -2 -87.
The Planning Commissioners discussed the request and felt the hardship was due
to the substandard lot and felt that every home should have a garage.

PROPERTY LINE FOR 3013 FAUMM ROAD MW= TO MMIBIT "A', DECLARATION OF

WELLS.
Upon a vote taken, ayes by Arnold, Kedro+ski, Loftus, Roseth, Wells; the motion
carried.
ITEM IV - PUBLIC HEARING FOR n n r AMENDMENT _ vwmnn 6TH AMITION
The developer, Wes Green, appeared before the Commission to request a change of
use. Lots 1 -3, Block 1 had been designated for 3 single family homes. The
Proposal is to replace the single family homes with 5 tomlxme units.

City Planner Graser commented per memo dated 3 -31 -87 and discussed the history
of the P.U.D., site elements such as overstory, location of units, density and
transition between single family hares and townhomes.
Several residents were opposed to the change from single family to townhomes.
Specifically, they felt that the townhomes would devalue their property and that
two rows of single family homes were needed for adequate buffer.
The Planning Camnissioners discussed the Harbor 6th P.U.D. Amendment with regard
to increased density, buffer area between single family homes and tawnhemes,
height of townhomes buildings, terrain/elevations, the preservation of trees on
the site, green space and open area, market value and quality and design of the
townhomes and single family homes.
MOTION BY ROSETH TO APPROVE THE HARBOR 6TH ADDITION P.U.D. AMENDMENT FOR LOTS I,
2, 3, BLOCK 1 AS PRESENTED. THERE IS No OVERALL CHANT' M THE P.U.D. AND THE
AMENDMENT WOULD NOT BE DETRIMENTAL TO THE EiVIR1241NT NOR DXREASE DENSITY
BEYOND WHAT WAS ORIGINALLY APPROVED, HEMMED BY KEDACW I.
Upon a vote taken, ayes by Arnold, Redrmaski, Roseth, Wells; nay Loftus (He had
concerns regarding the height of the structures and felt the additional row of
single family homes would serve as a better buffer to the existing homes in the
area), the motion carried.

City Planner Graser commented that the Public Hearing should be continued to
April 16, 1987 at 9:00 P.M. due to lateness of the hour.
At this time a 10 minute recess was called. The meeting resumed at 9:20 P.M.
ITRM VI _ VARLB210E REQUEST BY STEVE McDONA D
Steve McDonald, representative for William McDonald, commented that the request
is for a 36.5 foot front yard variance for 4377 Quincy Street S.E. to construct
a 1500 square foot single family home. Due to the County taking Tract B of the
parcel there is not sufficient room to build without a variance.
City Planner Grazer commented per memo dated 4 -2-87 regarding the 36.5 foot
front yard variance next to County Road 21. The applicant is eligible for one
building permit for the entire 2.5 acre parcel. The building envelope on the
south side of Quincy Street is too restrictive for a home to be built without
variance. There is sufficient property available north of Quincy to build a
home.

Residents were opposed to the variance for the following reasons: due to safety
factors along County Road 21, location of the home south of Quincy Street,
obstruction of view, setting a variance precedent, and because the structure
would be out of alignment with other hones along County Road 21.
The Planning Commissioners felt the application should reflect the entire parcel
not just the land available south of Quincy Street since the entire parcel is
eligible for only one permit. The Commissioners felt that an adequate building
envelope was available on the site north of Quincy Street and therefore, there
is no justification for a variance.
Jack @igberg spoke on behalf of the applicant. He felt the hardship was that
the applicant had invested in the property and can no longer build on the
parcel without variance due to the taking of land by Scott County.

Upon a vote taken, ayes by Arnold, Redraw ski, Loftus, Roseth, Wells; the motion
passed unanimously.
At this time a two minute recess was called. The meeting resumed at 10:25 P.M.

Chairman Loftus turned the gavel over the Vice Chairman Hoseth due to personal
interest in the next item. Mr. Loftus left the meeting.

Daniel Shoquist commented on the variance request.
City Planner Graser cemented per memo 4 -2 -87.
Tory Thelen, contractor, commented that the variance was requested so that the
hone can be aligned with existing homes.
Elece Shoquist commented that if they had known the problem before they bought
the lot it could have been worked out.
At this time Vice Chairman Roseth read a letter from Leanne Overbee and entered
it into the record.
The Planning Commissioners felt when the applicant bought the home from the
developer they should have checked for setbacks, codes, restrictions and
covenants.

ITEM VILL - FINAL PLAT OF TST VIEW 5TH ADDITION
City Planner Graser commented on the Final Plat of Island View 5th Addition.
Preliminary plat approval was given based on 6 contingencies: the protection of
the creek, variance for Lots 2, 3, 4, Block 2, Lot 1, Block 5 remain, County
Road 83 concerns, sanitary sewer issue with Mdewakanton Sioux Community, park
land, and backlot access for 21 lots.
The Planning Camnissio:ers discussed the Final PIZ& of Island View 5th Addition
with regard to the contingencies and felt the developer worked with staff in
fulfilling the requirements.
MOTION BY WELLS TO RECOMMEND FINAL PLAT APPROVAL TO THE CITY COUNCIL FOR ISLAM
VIEW 5TH ADDITION CONPINGENf UPON:
1. A 20 FOOF VARIANCE BE GRANTED FOR LOTS 2, 3, i 4, BLOCK 2.

Scott Lindholm, owner, commented on the request for a Conditional Use Permit in
the B-1 Limited Business District for a car wash. Mr. Lindholm also commented
on the concerns of staff and Commissioners from the previous meeting on March 5,
1987. Such concerns were the site plan entrance and exit maneuvering, parking
on site, vacuum cleaner location, plantings, sodding instead of seeding, berm
around site, exterior construction material, lighting inside the building and
outside, operational hours, and type of system used. The applicant has and
would be more than willing to work with staff on any item.
City Planner Graser commented per memo 4 -4 -87 and discussed the continuous berm
along Highway 13 and continuous lighting slag Commerce Avenue. T.P. James
CompatW was contacted and they are having a consultant draw up a plan.
The Planning Commissioners discussed the car wash proposal and previous concerns
with architectural style, neighbors privacy, landscape plan, parking and radii
of driveways, elevations, beaming, noise and pollution, reclamation system and
impact on the sewer system, lighting in the building and along Commerce Avenue.
The general consensus of the Commission was that the applicant has worked well
with staff to accomplish the changes incorporated in the site plan.

REQUEST FOR SAS DEVELOPMENT FOR A CAR WASH IN A B-1 LIMITED BUSINESS DISTRICT IN
LOT 1, BLOCK 1 JAMES 1ST ADDITION SUBJECT TO:
1. THE LANDSCAPE PLAN BE APPROVED BY CITY STAFF.
2. THE HEIGHT OF THE BERM BE INCREASED TO 4 OR 5 FEET AND IF CONTINUOUS
REQUIRED, IT BE INCORPORATED.
3. THE BRICK "E)(HIBIT" BE MADE PART OF THE RECORD AND USED THROUGHOUT THE
STRUCTURE AND FORWARDED TO CITY COUNCIL FOR APPROVAL.

Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.

At this time a 2 minute recess v„ called. The meeting resumed at 8:40 P.M.
Mary Eggum, developer, commented on the request to develop the Farnum farm which
is 7 acres zoned R-1 into 8 lots with 90 to 100 foot widths. Mr. Eggum further
commented on the extensive grading and filling required, City Staff has been
consulted with regard to utilities and drainage, the existing buildings will be
turned over to the fire department for training if desired, and due to the
extension of County Road 21 and the selling of all his lots, a time element
here is important for Mr. Eggum.
Assistant City Planner Garross commented with regard to the concept plat on lot
size, berme, hills throughout, Storm Water Management Plan for 100 year flood
elevations, saving of a few Oak trees, extensive grading and filling, utilities,
easements needed, driveway access and setbacks depending on County Road 21
alignment, time frame and future access south from abutting subdivision.
The Planning Commissioners discussed the concept plan with regard to Outlot A
donated to the City, road access from County Road 21 or a frontage road, grading
and filling, erosion to pod, Storm Water Management Plan 100 year study taken
into account, cul-de -sac done properly, and any concerns of area residents.

Greg Halling representative for Tom Steffens, discussed the proposed framework
as it relates to zoning and design. The property is zoned R-3 and B-3 but due to
the market forces today they would like to rezone the property to fit single
family and multiple homes but leave the B-3 district. Mr. Balling also
commented on the ponding, little grading of the flat land, and connecting
streets.

City Planner Graser commented per memo dated 4- 14-87.
The Planning Commissioners discussed the Willows 7th Addition and were in favor
of the rezoning from R-3 to R-1 for single family homes. However they had
concerns over :he row of lots next to the business district, the inclusion of
multiple units in the northern edge of the site, the intersection of Spring Lake
Road and Highway 13 to the Willows, interconnecting of neighborhoods, and a
walkway to Five Hawks School.
ITEM V - Pau= HHARIR: NCH OF ZONING ORDINANCE
City Planner Graser commented that the Public Hearing should be continued due to
a change in City Manager's as of May 1, 1987 and new City Manager Dave Cmacht
would like to have the opportunity to review and discuss the ordinance with
staff.
