Present were Commissioners Arnold, Kedrowski, Wells, City Planner Graser and Assistant City Planner Garross. Absent was Commissioner Hoseth. ITEM I - REVIEW MIND OF PREVIOL MEETING Page 2, Item No. 2. should read as follows: 2. THE HEIGHT OF THE BERM BE INCREASED TO 4 OR 5 FEET IF RBDUIRM TO BE CONTINUOOS ALONG THE NORTHERN TERMINUS. MOTION BY ARNOLD, SBORD BY RO7AMM TO APPROVE THE APRIL 16, 1987 PLAt1h M COMMISSION MINUTES AS AMENDED. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Wells; the motion passed unanimously. ITEM II - QON=MM PEAT HEARING FOR nR.wMP rrrmUrnnrn Denny Fitzgerald, owner, presented the Commissioners with a new plan and c•.ammented on the property once called "The Trees" which is about 9.04 acres north of the High School. The new plan has one lot omitted in the front and one lot added in the back making the front lots larger. There is a large pod area which is non - buildable in the plat but ideal for City park land and the applicant would like to dedicate this to the City. The existing house on Lot 10 has a log driveway at an angle with a retaining wail which would need an easement. City Planner Graser commented with regard to the concept plat which has been around for years called "The Trees". Mr. Graser commented that sewer stubs need to be put in which would be the developer's cost, a lot of grading is needed in one area and a grading plan needs to be submitted, the lots are very deep, the lots need to be aligned parrallel, the topography is unique with a pond, lots of open space, and several large trees. The driveway to the existing house would need an easement, park dedication area could be a concern without road access, storm water management easement would have to be given, the natural features should be considered as to what happens, each lot should have a building pad, and there is a question of the buildability of Lot 1. The Planning Commissioners discussed the Concept Plan with regard to parallel alignment of lots, topography, utilities, easements needed, park lard, poling, and felt the larger lots on the new plan were an improvement. Due to a large tree on the west side of the garage the applicant would like to build closer to the road requesting a 1 foot front yard variance. Because of the 50 foot lot, the appplicant is requesting a 4 foot aide yard variance to rebuild the deteriorating garage which is constructed on cement block that is caving in. City Planner Graser commented per memo dated 5/7/87. The Planning Commissioners commented on the request and felt that one foot of additional front yard setback isn't a hardship in this case. Mr. [kaacht thanked the O®issioners for dedication in serving on the Commission. City Planar Graser stated that 2 Planning Comissioners tens were up July 1, 1987, that of Chuck Arnold, and Tam Loftus. If they wish to reapply a letter to Dave Clmacht to present to the City Council would be procedure. Mary Nggwm, developer, commented on the Preliminary Plat request located on County Road 21 which is about 7.3 acres zoned R-1. There are some old buildings and debris which will be removed and the site graded. A variance will be requested for 25 foopptt����rpnt yards on lots 1, 2, 7 and B. Assistant City Planner Garross coamented per Planning memo dated 5/21/87, Engine? � memo dated 5/14/87 and two Scott County letters dated 4/23/87 and At this time audience input was called for. Ron Ceminsky, 5239 Brooks Circle, was concerned over the hill, trees and grading on the backside of his lot abutting the proposed subdivision and how will the area blend. At this time a 3 minute recess was called. The meeting reamed at 8816 P.N. Jim McCarty caa ented on the variance request for 14806 Estate Avenue S.B. B e felt there was confusion on the rec®oendation being detrimental to the general health and welfare of the comounity when he spent a greet deal of money making his property a viewing place for the boaters on the lake. since there are dense mature trees shielding the abutting property owners he felt his request was not disturbing anyone. City Planner Graser oamoented per memo dated 5/21/87 At this time audience input was given. 2 MINIJMS OF THE PRIOR LAKE PLANNING COMISSION MAY 21, 1987 The abutting property owners felt the dense mature trees concealed any type of view from them. The Planning Commissioners discussed the variance and felt empathy for the applicant however, their concern was for setting a precedent for future applicant's and there is an alternative here.
