The September 3, 1987 Prior Lake Planning Commission meeting was called to order
at 7:30 P.M. by Chairman Loftus. Present were Commissioners Arnold, Kedrowski,
Roseth, Wells, City Planner Graser and Assistant City Planner Garross.

Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.
Mr. Jim Pilippi, representative, comewrted that the applicant is requesting a
Zoning Code Amendment and Conditional Use Permit to develop a convenience store,
gas station,and car wash in a B-2 District on the property now called the Union
76 station. Also,they would like to expand the property line with the purchase
of the Travel /Insurance Agency next door, route traffic from Highway 13 through
Walker Avenue and south, after acquiring the right of way and getting a 7 foot
variance. The alley west of the building should be widened to 24 feet, but
needs an easement granted, for access to the clinic on Walker Avenue. They will
be adding new pumps with canopy, parking spaces, landscape and berm, and redo
the outside facia with Pa x= colors.
City Planner Graser commented per mend dated September 3, 1987. Also commenting
that Consulting City Planner Tooker would review the landscape plan on September
4, 1987.
At this time audience input was called for.
Jim Haug, owner of used car lot across the street, was in favor of the proposal.
Ben Bear, Prior Lake resident, was concerned with Main Street and Dakota Street

Jim Keenan, owner of the Travel /Insurance Agency, was concerned over the selling
of the agency and the traffic route to the abutting clinic which he proposes to
buy

The Planning Commissioners discussed the proposal and questioned the feasibility
of another convenience store and gas station in Prior Lake, safety of traffic
off Highway 13, service hours, comber of parking spaces, viability of the alley
to a 24 foot roadway, Walker Avenue as a frontage road or traffic circulation
route, purchase of the single family home by the City, meeting setbacks from all
property lines and signage.
MOTION BY ROSETH TO APPROVE:
1. A ZONING ORDINANCE AMENDMENT TO INCLUDE AS CONDITIONAL USE A CAR WASH
IN A B-2 DISTRICT, AND THE SUBMISSION OF THE AMOCO STATION REPLACING
UNION 76 STATION.
SECONDED BY LOBRUS.
Upon a vote taken, ayes by Arnold, Kedrowski, Lotus, Rosetb, Wells; the motion
passed unanimously.
MOTION BY RIISETH TO APPROVE:
2. THE 7 FOOT FROND' YARD VARIANCE FROM S.T.H. 13.
A. VACATE WALKER AVENUE FROM DAKOTA STREET TO THE SOUTHERN TERMINUS
OF THE SITE.
B. CRAMP THE CITY A 14 FOOT ROAD EASEMENT OVER THE WESTERLY 14' OF
THE SITE.
C. GRANT THE CITY A 24' RDAD EASEMENT THROUGH THE PARKING LOT AS
SHCNN ON THE SITE PLAN.
3. PRIOR LAKE PURCHASE THE SINGLE FAMILY HOME, REMOVE IT AND SELL THE
PROPERTY TO THE APPLICANT OR WHATEVER THEY SEE FIT TO DO.
4. PRIM LAKE DEVELOP AND IMPLEMENT PLANS TO EPTED THE 24 FOOT ALLEY
SOUTH TO CREDIT RIVER ROAD FROM DAKOTA..
5. APPROVE THE COMITIONAL USE PERMIT SUBJECT TO:
A. THE ETERICR FINISH OF THE BUILDING BE A UNIFOI1M BRICK AS
DESCRIBED IN THE ALAN.
B. THE PROPANE TANK BE MOVED TO A LEGS VISIBLE DANGEROUS SPOT AND
APPROPRIATELY LANDSCAPED.
C. THE LANDSCAPE PLAN BE ACCEPTABLE TO STAFF.
D. THE APPLICANT REMOVE ALL RESIDUE BLACKTOP BETWEEN THE SITE AND
S .T.H. 13.
E. ALL TANKS AND PIPING BE REMOVED.

MOTION BY ROSETH TO CLOSE THE PUBLIC HEARING FOR ZONIN13 ORDINANCE AMENDMENT,
NNDITIONAL USE PERMIT, AND VARIANCE FOR PETER T. FLINK, SECONDED BY WELLS.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.
*The tape of this public hearing will be kept on file in the office of the City
Planner as official record.
At this time a 5 minute recess was called. The meeting resumed at 8:50 P.M.
ITEM III — HBARING ON FINAL PLAT APPROVAL THE H&E= 74H ADDITION
City Planner Graser commented per memo dated September 3, 1987.
MOTION BY A =LD TO GIVE FINAL PLAT APPROVAL TO THE HARBOR 7TH ADDITION,
SINCE IT IS IN SOBSTANTIAL ODMPLLNXE TO THE CODE, SECONDED BY KEOROTSKI.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
lased unanimously.
ITEM N — H114R10 ON FINAL PLAT -- SHORE OAKS 5TH AUDITION
City Planner Graser commented that Preliminary Plat approval was given by both
the Council and Planning Commission with the contingency that the park
dedication as shown, hammerhead driveways for lots abutting Carriage Hill Road
and the 100 year flood level in the ponding area be successfully completed,
which has been done.
Mr. Graser read the legal description for the record:

The September 17, 1987, Prior Lake Planning Camnission meeting was called to
order at 7:33 P.M. by Chairman Roseth. Present were Commissioners Arnold,
Kedrowski, Loftus, Wells, City Planner Grazer, and Assistant City Planner
Garross.

At this time, Chairman Roseth stepped dawn from the (Stair due to personal
association with the parties involved in the next item.
ZMK II - VARIANCE REOUESP BY I2YDDR RYCWW
Mr. Rygajlo commented that, in 1979, the lot was divided into two parcels and at
that time there was only a 25' setback requirement from Highway 13 whereas; now,
there is a 50' setback requirement. Unfortunately, in 1979, he could not afford
to build nor could the abutting property avers afford to purchase the other
lot. Due to the pie shape and elevations of the lot, a variance is needed to
build a home.
City Planner Grazer commented per memo dated 9- 17 -87.
At this time audience input was called for.
Bob Larson owner of abutting lot had concerns over the drainage from the lot
towards his property.
Mrs. Larson questioned whether the hou.9e plan could be moved on the lot.
Lloyd Lucht, 5968 Plandrau Circle, had concerns over the turning lane off
Highway 13 to the lot and the conformance of a house to fit into the
neighborhood.

The planning Ccmmisaionera had concerns over the elevations, setbacks, design
criteria of home, retaining wall, drainage, and planting plan. They felt more
information was needed to make a decision.

At this time Chairman Roseth returned to the Chair.

City Planner Grazer commented that due to unforeseeable conflicts the applicant
did not purchase the lot therefore withdrawing his application.

Discussion followed regardlg a meeting nighty however, the consensus was to
keep the nights that arc daheduled now which is the first and third Thursdays.
City Planer Grazer meted that the new Reference Manual the Camissioners
received required many hays of labor by Dab Garross in order to put it
together.
