The September 2, 1993, Planning Commission Meeting was called to order by Chairman Arnold
at 7:30 P.M. Those present were Commissioners Amold, Greenfield, Loftus, and Secretary Rita
Schewe. Commissioner Roseth arrived at 7:35 P.M. Director of Planning Horst Graser and
Associate Planner Gina Mitchell arrived at 7:42 P.M.
ITEM I - REVIEW MINUTES OF PREVIOUS MEETWG
MOTION BY LOFTUS, SECOND BY GREENFIELD, TO APPROVE THE MINUTES AS
WRITTEN.
Vote taken signified ayes by Loftus, Greenfield, and Arnold. MOTION CARRIED.
A recess was called at 7:32 P.M. and reconvened at 7:35 P.M., at which time the next agenda
item was scheduled.
ITEM H - GERALD SONNENRERG - VARIANCE
Gerald Sonnenberg -14870 Maple Trail, is requesting a 4 foot setback variance from die 50 foot
setback from Highway 13 in order to construct a three- season porch over an existing deck. When
the house was built in 1977, the setback requirement was 25 feet and the deck was legal when
built. When the City changed the setback requirement to 50 feet in 1983, a variance is needed to
do any alterations.
As the Director of Planning Horst Graser and Associate Planter Gina Mitchell were not present,
Chairman Arnold begin reading the Planning Report of September 2, 1993, until the arrival of
Mr. Graser at 7:42 P.M.
Mr. Graser continued the presentation. The subject site is 88 X 135 feet and the dock has a legal
non - conforming setback of 46 feet from the right-of-way line of State Think Highway 13. The
proposed construction would not encroach further into the setback, would improve the
appearance of the property, and will not affect the neighborhood. The haniship is trot the result
of the applicant but in a code change by the City of Prior Lake. Recommendation by Staff is to
approve the variance as requested.
Chairman Arnold read into the record the responses from the following: phone Calls from Barb
Elliott -6757 Rustic Road and Ron Noonan -14867 Maple Trail, in favor of the variance. A letter
was received from Ron Evans -14888 Maple Trail, also suppporting the variance.
Comments from the Commissioners were: on the structure already built, headship is caused by
change in code, and all were in consensus of approval.

EXISTING DECK IS A LEGAL NON - CONFORMING STRUCTURE, THE PROPOSED
CONSTRUCTION WOULD NOT ENCROACH ANY FURTHER INTO THE CURRENT
SETBACK, THE HARDSHIP WAS CAUSED BY A CHANGE IN THE CODE BY THE CITY
OF PRIOR LAKE AND NOT THE APPLICANT, AND IT WOULD NOT BE DETRIMENTAL
TO THE HEALTH AND WELFARE OF THE COMMUNITY.
Vote taken signified ayes by Loftus, Greenfield, Roseth, and Amold. MOTION CARRIED.
A recess was called at 7:50 P.M. as the next scheduled item was for 8.:00 P.M., at which time the
meeting was reconvened.
ITEM HI -.JOHN BEAUPRE- VARIANCE
John Beaupre-5504 Candy Cove Trail stated he has a purchase agreement on property located at
15271 Fairbanks Trail and as there is not a garage on the site now, is requesting a 5 foot variance
in order to build. The sale is contingent on the approval of a variance.
Horst Graser presented the information as per memo of September 2, 1993. The request is for a
5 foot west sideyard setback variance from the 10 foot sideyard setback requirement Previous
variances granted to the subject site were for a 5 foot east sideyard variance for a house addition
in 1984 and a 5 foot east sideyard variance for a porch and deck in 1991. The subject site is fat
near the building pad and slopes sharply down to the rear and is approximately 50 X 150 feet
There has been precedence set of variances granted in the neighborhood. The proposed
construction goes beyond any previously established variance perimeters. The Planning
Commission has never issued two 5 foot sideyard variances. The maximum sideytud variances
have been 5 feet and 3 feet The neighborhood is in a period of transition and development. Mr.
Graser suggested a change in the garage design and a 3 foot variance be granted instead of the 5
foot as requested.
John Beaupre stated the change suggested would of be practical or aesthetically pleasing to the
existing construction.
Comments from the Commissioners were: Commissioners Greenfield read the hardship findings
into the record and with that interpretation, does not approve of the variance. Commissioners
Roseth voiced concerns on stating a precedence if a double variance was granted for the
property. Commissioner Loftus stated the lot is substandard. felt if a variance is granted it should
be as the applicant requested, rather than reducing the request to 3 feet Conimisdoner Arnold
stated that granting a variance would set a precedence.
MOTION BY GREENFIELD. SECOND BY ROSETTE, TO DENY THE REQUESTED
VARIANCE FOR 15271 FAIRBANKS TRAIL, CITING THAT THE APPLICANT HAS NOT
PROVEN HARDSHIP FINDINGS 1 TO 4 AS OUTLINED IN THE STAFF REPORT AND
THE APPLICANT'S PROPOSAL OF AN AESTHETICALLY PLEASING DESIGN Is NOT
RECOGNIZED AS CRITERIA FOR GRANTING A VARIANCE.
Vote taken signified ayes by Greenfield, Roseth, and Arnohi Nay by Loftus. MOTION
CARRIED. Variance was denied
ITEM IV - JERRY YOVAG--YARIADEL
Jerry Young -5465 Shore Trail, stated he wishes to construct a dock over an existing patio and is
requesting a rear yard and east sideyard variance.
. \,w�iate Planner Gina Mitchell, presented information as per planning report of September 2,
1 The application as submitted was for a 20 X 12 foot deck over an existing patio. The
variance requested is a 38 foot rearyard variance from the Shoreland District setback requitement
and a 5 foot east sideyard variance from the 10 foot sideyard setback requitement. After review
of the survey and existing conditions, Staff determined that a 10 X 20 deck is the maximum
depth allowed in accordance with the variance notification. The subject site is 50 X 286 and is in
a well established single family neighborhood that has been granted variances. The side and rear
yard hardships are not the result of the applicant nor the City of Prior Lake, but the result of
actions of a previous governing body. Comments from the DNR stated they are opposed to the
variance and the utility shed located on the property by the lakeshote should be removed prior to
construction. Comments from Ed McCorkel of 5475 Shore Trail were in support of the variance
and a letter from Linda Weicher of 5455 Shore Trail also supported the request A phone call
from Jeannie Robbins was of the same opinion as the DNR in regards to removing the shed.
Comments from the Commissioners were on: site line of deck, and the existing slab and shed
should be removed.
Mr. Young stated he plans to remove the slab but cannot do so because of the cost at this time
and the utility shed is needed for their life style.

VARIANCE FROM THE 75 FOOT SHORELAND DISTRICT SETBACK REQUIREMENT
AND 5 FOOT EAST SIDEYARD VARIANCE FROM THE 10 FOOT SIDEYARD
REQUIREMENT REQUIREMENT, CONTINGENT UPON THE REMOVAL OF THE
EXISTING SLAB BEFORE CONSTRUCTION. RATIONAL BEING t rIMRAL
ENFORCEMENT OF THE ORDINANCE WOULD BRING ABOUT A HARDSHIP
PRECEDENCE HAS BEEN SET, AND THE SUBJECT SITE WAS MAA77M UNDER THE

After discussion on the contingency, a friendly amendment was made as follows: THE SLAB
SHALL BE REMOVED BY SEPTEMBER 1, 1994. This was agreeable with the applicant.

ITEM V - PUBLIC HEARING . THE WELDS PUD . REZO NINC
The Public Hearing was called to order at 9:02 P.M. by Chairman Arnod. The public was in
attendance and a sign -up sheet was circulated.
Mr. Graser presented the information as per memorandum of September 2, 1993. The objective
of this hearing is to consolidate the commercial district of The Wilds Planned Unit Development
under one PUD Zoning. Prior Lake Developmmnt L.P. has consented to the consolidation of the
entire 580.4 acres under one PUD. Only under a PUD concept can a City deviate hem sundords
of the Zoning and Subdivision Ordinance. Robert Hoffman, Counsel Consultant, suggamd an
amendment to the PUD section of the Zoning Ordinance.
John O'Loughlin. 2988 Valley View Road, Shakopee, MN - stated he is pleased with The Wilds
development and what has been done.
Discussion by the Commissioners followed on the issue and what procedure to follow on the:

Associate Planner Gina Mitchell presented information an a policy that would give Staff clearer
directions on enforcing Section 6-4-2. This policy would be used in the interim until a tree
preservation ordinance is in place.
A motion was forced to adopt the policy as stated and was withdrawn when the Comttistionas
indicated they wished to discuss the item further.

Commission Greenfield began a discussion on how so handle apparent violations that surface
when applications are reviewed, and on conditions and contingencies placed on variances. Mc
Graser suggested a workshop with the City Attorney could possibly be arranged is she frame to
clarify the Commissioners position and what legal procedures to follow.

The September 16, 1993, Planning Commission Meeting was called to order by Chairman
Arnold at 6:30 P.M. Those present were Commissioners Arnold, Greenfield, Director of
Planning Horst Grasa, Associate Planner Gina Mischell, Consultant Blau Tremem, and
Secretary Rita Schewe. As these was not a quorum present, the minutes were moved to a later
time in the agenda Commissioner Roseth arrived at 7:30 P.M. Commissioner Loftus arrived at
8:13 P.M.
The final meeting of the neighborhood districts which mchxW the entire city was called to order
by Chairman Arnold He then introduced Horst Grater, Director of Planting, who gave a brief
summary of the reason for initiating the neighborhood meetings and what was hoped to be
accomplished. The input from the citizens will be part of the Comptehetaive Plat 2010 outlining
the goals and objectives for the City of Prier Labe. Blair 7tremem was retained as a cousuluot to
the City to prepare a draft of this input to the eve plat.
E.K. Whiting -14897 MaWwu Road, stated that the taxes are high, the tax base seeds to be
increased, and industry is not the panacea it scars to be. Mc Whiting made the comment that
building smaller less valuable bermes genially take mere our of the system then %ey put is. Far
a house less than $135, 000.00, the goods and services provided for that home are generally mere
expensive than the taxes that it generates. Higber priced houses would produce mare taxes and
there could be fewer children, which would help the educational system. We are at a junction of
where we can go with the smaller homes and struggle with the tax brae, a have a uppedarieWle

to a wide variety of price ranges and types of people Does not believe Prior Lake shoud or an
set themselves apart to be " attained ". Anyone who ante to Prior lake 10 yeas ago beasts of
the country feeling did not have a guarantee the open space would always be there format To
have the open space people should purchase property outside the city limits when Wit h the
standard, to buy inside the city limits and expect die spaciouaiess to remain fool euly
themselves We are a lakeshom cwmmu uily, and a bedroom community, which is not a bad thing
to be and we should capitalize on the fact this is a nice phoe to live. '[late is a Bleat majority of
people who feel the same way. We Dad to be market drivan. Taxes ate out the bws but whack
are the issue. Parks and tails are nice but need to be maintained and cause a problem if an the
property. We should not put fences around Prior Lake.
Commissioner Greenfield quoted from Staff's report on The Wilds project to die Memopolitau
Council of 65% of housing in Prior Lake is below $120AO0.00 and almost 3% is above
$200,000.00.

If there are more children, this in turn will increase classrooms, teachers and more money is
needed for the school systems.
Jim Riccioli-4290 Grainwood Circle, believes there should be a mixture of housing. He felt
larger lots should be considered in the Jeffers Pond area In the older neighborhoods, the owners
have a difficult time to improve their property because of the ordinances that are in effect today.
The City should make sun; the lots platted now we large enough if the owners wish to improve
in the future. Potential businesses should be planned for rather than shut out and a second
industrial park planned Trails and sidewalks are a public facility and are used.
John O'Loughlin -2988 Valley View Road, Shakopee, wanted to know how he can have his land
rezoned for commercial and what he has to do.
Mr. Graser explained the procedures and what has to take place for this to happen. A discussion
followed on how to incorporate the Sioux community into the Comprehensive Plan. Mr. Tremere
gave a short summary on the procedures and that it is a political and policy issue.
Marianne Whiting -14897 Manitou Road, stated that when people are out on the trails and
sidewalks, they are aware of the community. We should have stores for people from adjoining
towns to be able to shop here. The question was asked if a walkway would connect the Wagon
Bridge to Wind Song area and location of the corridor from 35W to bypass Burnsville area
Mrs. Whiting thanked the Commissioners for having the neighborhood meetings.
A request from the audience asking for a continuance of the format after the regularly scheduled
meetings. The was agreed on by the Commissioners.
A recess was called at 7:57 P.M. and reconvened at 8:00 P.M.
The Meeting was called to order at 8:00 P.M. by Chairman Arnold.

ITEM H - ANDY VALDMANIS _ VARIANCE
Mr. Andy Valdmanis of 5237 - 46th Ave. South, Minneapolis, stated he has a lot at 5405 Shore
Trail and had received a variance for the property in August, 1992, but due to die length of time
taken by the surveyor, when he brought in the plans for a building penrdL his variance had
expired. The variances are requested to construct a house and garage and tine has been some
minor changes made.
Gina Mitchell, Associate Planner, presented the information as per pig repast of September
16, 1993. A 5 foot east sideyard setback from the 10 foot sideyard setback requirement and a 5%
impervious surface variance from the 30% impervious surface requitement is being requested.
The lot is 50 : 280 which results in a lot of substandard width. The area was platted under
Eagle Creek Township. The survey has been revised since the previous variance was granted
and shows the home located 35 fat further from the lakeshore. A 15' X 35' detached garage has
been added in addition to the garage attached to the house. This revision try have changed the
impervious surface coverage of the lot.

impervious surface variance as hardship is caused by the design created by the applicanL A
condition in the previous variance was that the existing cabin be removed during the winter to
allow the applicant to remove the debris over the ice rather than up the steep bank on the
property. Staff recommends this condition be included in the motion again.
Comments from the Commissioners were on; reasons for two garages on properly, removal of
old cabin, type of surface on driveway, design of sunictwe, and reduction of the impervious
coverage. Commissioner Loftus abstained from comments as he had just arrived.
Mr. Valcimanis stated he would have no problem in reducing the width of the driveway to meet
the code requirement.
MOTION BY ROSETH, SECOND BY G REENFIELD , TO APPROVE A FIVE (5) FOOT
EAST SIDEYARD SETBACK FROM THE TEN (10) FOOT SIDEYARD SETBACK
REQUIREMENT FOR 5405 SHORE TRAIL, AS THE LOT IS SUBSTANDARD IN WIDTH,
THE VARIANCE IS SIMILAR TO THE VARIANCE GRANTED IN AUGUST OF 1992,
PRECEDENCE HAS NOT BEEN SET, AND HARDSHIP WAS CREATED BY A PREVIOUS
GOVERNING BODY, AND TO DENY THE FIVE (5)% IMPERVIOUS SURFACE
VARIANCE FROM THE 30% IMPERVIOUS SURFACE REQUIREMENT OF THE
SHORELAND DISTRICT AS THE HARDSHIP WAS CREATED BY THE APPLICANT AND
NOT BY ANY ORDINANCE OR MUNICIPALITY. THE CABIN IS TO BE REMOVED
PRIOR TO AN OCCUPANCY PERMIT FOR THE NEW HOME.

George Lambrou -3124 Fairview Road, stated be is proposing to construct a 24' X 26' attached
garage. The elevation of the garage and driveway will be 5 fed higher than the house and Use&
the variances to allow the water to drain to the mad.
Associate Planner Gibs Mitchell presented the information as per the planning report of
September 16, 1993. The variances requested are, a 315 foot setback variance from the 85 foot
County Road setback requirement, a 9 foot front yard variance for the 25 foot front yard setback
requirement, aid a 4 foot east sideyard variance o om the 10 foot sideyard setback requiretnemt
The existing home was built 6.5' from the east property line and the proposed page will mot
encroach further into the sideyard. The neighborhood is undergaing conversion of cabins to
single family homes. This property was platted and developed under Spring Lake Township.
A letter from Brad Larson, Scott County Highway Engineer, was entered into the mead stating
that Scott County does not object to the request, but would defer its position to be the straw as die
City's position due to the future potential jurisdiction of County Rod 18 being assumed by Print
Lake.
Recommendation from Staff is to approve the variances requested as the criteria of the four
hardship standards of the Toning Ordinance have been met

At this time the Neighborhood Meeting was recalled to continue the discussion
Greg Matz, 15510 Breezy Point Road, Rated he has been involved with development and the
realty business approximately 20 years. He I= been involved in the smsauoding conisnuaides
when they were going through their "growing pains". One of ths iraes that wre up that
W. Matz took exception to was the larger lots and limiting the value of barren to built. Anyone
who wishes to live here should be able to do so and not be limited or have 10 wait to "attain" the
