Those present were Commissioners Loftus, Arnold, Kedrowski, Wells, Roseth, Assistant City Planner Deb Garross, and Secretary Rita Schewe. ITEM I - REVIEW MINUTES OF PREVIOUS MEETING MOTION BY KEDROWSKI, SECOND BY LOFTUS TO APPROVE THE MINUTES AS WRITTEN. vote taken signified aves by Kedrowski, Loftus, Arnold, Wells, and Roseth. MOTION CARRi D. ITEM II - GREG SCHRADER - VARIANCE Greg Schrader, 5308 Candy Cove Trail, stated he is requesting a 23 foot front yard variance and a 8.5 foot side yard variance to construct a 24 X 24 foot detached double garage. He purposes to remove the existing garage and utilize the foundation to lessen the cost of construction. He also stated there were underground utility lines in front of the existing garage. Deb Garross presented the information as per memo of June 6, 1991. The lot is a substandard lot and was built under another government jurisdiction. The garage is located at a legal non - conforming setback from the front and side property. The Zoning Code requires compliance when legal non - conforming uses are removed or destroyed, in that new structures must meet current setback standards. Fire safety is a concern also. Statistics were presented showing that since 1983, 250 variances have been granted. Of those, the ones pertaining to side yard variances, there have been twelve granted that are greater than 5 feet. Normally the Planning Commission does not grant beyond 50% of the required setback or the 5 foot variance. In eleven of the twelve, the variance greater than 5 feet was due to the existence of a legal non - conforming structure. A precedent could be set if this variance as requested is granted. Staff recommendation is to approve the 23 foot front yard variance and a 5 foot side yard variance. This would allow the applicant to have a garage and maintain a degree of building separation that the Zonincy Ordinance is designed to achieve. The hardship in this case is due to the substandard lot and development practices of a former government and is not the result of actions of the applicant or the City of Prior Lake. 4629 Dakota St. S.E., Prior Lake, Minnesota 55372 / Ph. Consensus was to table the application. MOTION BY KEDROWSKI, SECOND BY WELLS, TO TABLE THE VARIANCE APPLICATION FOR 5308 CANDY COVE TRAIL UNTIL APPLICANT CAN INVESTIGATE OTHER OPTIONS. Vote taken signified apes by Kedrowski, Wells, Rose:.h, Arnold and Loftus. MOTION CARRIED. Discussion followed on an alternate date for the July 4th meeting. It is tentatively set for July 11th. A date for a walking tour of the Mahoney /Giles annexation site was set for June 19, 1991, at 6:30 P.M. MOTION BY KEDROWSKI, SECOND BY WELLS, TO ADJOURN MEETING. The purpose of the meeting is to tour the proposed subdivision site of Wood Ridge Estates First Addition. A walking tour of the site will take place on June 19th. Anyone interested in attending this meeting /tour should meet at the south entrance of City Hall by 6:30 p.m. on June 19, 1991. Those present were Commissioners Loftus, Arnold, Roseth, Director of Planning Horst Graser, Assistant City Planner Deb Garross, Associate Planner Sam Lucast, Director of Parks Bill Mangan, City Engineer Larry Anderson, and Secretary Rita Schewe. Vote taken signified ayes by Loftus, Arnold, and Roseth. MOTION CARRIED. ITEM II - PUBLIC HEARING Public Hearing for Comprehensive Plan, Rezoning, Preliminary Plat of Wood Ridge Estates First Addition, and Variance were called to order at 7:32 P.M. The public was in attendance. Joe Mahoney representing New Century Construction stated they are requesting the Comprehensive Plan Amendment, Rezoning, Preliminary Plat and Variance for the Wood Ridge Estates First Addition in order that they can began construction of 155 houses in the development. Horst Graser presented the information as per memo of June 20, 1991. The applicants, Joe Mahoney and Mike Giles of New Century Construction Company, are contract purchasers of 70 acres recently annexed into the City They are seeking all necessary approvals to permit the installation of the first phase of improvements before winter. The requested action by the developers is to amend the 1981 comprehensive Plan by expanding the urban service area to include the subject site and to establish land use as low density residential In anticipation of the annexation, Staff has included the subject parcel in the proposed 2010 urban service area. When property was annexed into the City it was zoned as A -1 Agricultural. A description of the areas features and planned amenities were presented. Although detail is missing In some areas, this opportunity can be taken to discuss and hopefully settle the final design of the site. Larry Anderson, City Engineer, gave a brief summary of the Engineering Department's memo. The grading plan needs to be revised to save the existing trees as much as possible. Erosion control is essential adjacent to the pond. All issues are resolvable and the developer is in the process of addressing concerns of the Engineering Department. Bill Mangan, Director of Parks, stated that the proposal is close to being acceptable. There are some lots that should be realigned. A neighborhood park is very essential in this area. The park land dedication requirement would be approximately 7.13 acres which would satisfy the requirement for Wood Ridge Estates. Mike Giles, Lakeville, had comments on the grading plan, trees lost and Mushtown Road. Larry Anderson stated that these plans were what the Development's Engineer presented. A recess was called at 8:45 P.M. The meeting reconvened at 8:50 P.M. All Commissioners were in concurrence with the comprehensive Plan Amendment. MOTION BY LOFTUS, SECOND BY KEDROWSKI, TO RECOMMEND TO THE CITY COUNCIL THAT THE SUBDIVISION WOOD RIDGE ESTATES BE INCORPORATED IN THE URBAN SERVICE DISTRICT. Vote taken signified ayes by Loftus, Kedrowski, Arnold, and Roseth. MOTION CARRIED. MOTION BY KEDROWSKI, SECOND BY ROSETH, TO DESIGNATE THE AREA AS LOW DENSITY RESIDENTIAL FOR THE PURPOSES OF THE COMPREHENSIVE PLAN. Vote taken signified ayes by Kedrowski, Roseth, Arnold and Loftus. MOTION CARRIED. The Commissioners were in concurrence with the Rezoning Application. MOTION BY ROSETH, SECOND BY KEDROWSKI, TO RECOMMEND TO THE CITY COUNCIL TO REZONE THE SUBJECT PROPERTY FROM A -1 AGRICULTURAL TO R -1 SINGLE FAMILY RESIDENTIAL. Vote taken signified ayes by Roseth, Kedrowski, Loftus, and Arnold. MOTION CARRIED. Vote taken signified ayes by Kedrowski, Loftus, Roseth, and Arnold. MOTION CARRIED. Public Hearing closed at 8:55 P.M. Discussion followed on the Preliminary Plat of Wood Ridge Estates. Comments were on park area lots realignment, trees lost, slopes, berms or natural foliage on 170th Street, lots on Mushtown Road be 150' in depth, bike path trail, and regrading. MOTION BY KEDROWSKI, SECOND BY LOFTUS, TO TABLE THE PRELIMINARY PLAT FOR WOOD RIDGE ESTATES TO INCORPORATE STAFF'S Vote taken signified ayes by Kedrowski, Loftus, Arnold, and Roseth. MOTION CARRIED. MOTION BY KEDROWSKI, SECOND BY LOFTUS, TO TABLE THE VARIANCE FOR WOOD RIDGE ESTATES. Vote taken signified ayes by Kedrowski, Loftus, Roseth, and Arnold. MOTION CARRIED. ITEM III - GREG SCHRADER - VARIANCE (CONTINUED) Greg Schrader, 5308 Candy Cove Trail, stated that he has revised his building plan and the only variance needed is a 18.5 foot front yard variance. He will construct a 9 X 22 foot addition to the existing garage. Deb Garross presented the information as per memo of June 20, 1991. The application has been revised from the 23 foot front yard and 8.5 foot side yard variance that was before the Planning Commission on June 6, 1991. After conferring with the Director of Planning and the Building Official, the applicant revised his plan. Part of the legal non - conforming structure will be retained and an addition of 9 X 22 feet will be added to the westerly part of the garage. This proposal eliminates the need for a side yard variance due to the grandfathered satback established by the existing garage. Recommendation from Staff is to approve the 18.5 front yard variance. Hardship is due to the substandard lot size and development practices of a former government and is not the result of the applicant or the City of Prior Lake. A letter from Dick Lewin was read into the minutes, stating he had no objections to the construction. Comments from the Commissioners were on closeness of buildings, drainage, site line, and installation of gutters. PLANNING COMMISSION MEETING MINUTES JUNE 20, 1991 PAGE 4 MOTION BY KEDROWSKI, SECOND BY ROSETH, TO APPROVE THE 18.5 FOOT FRONT YARD VARIANCE TO CONSTRUCT A GARAGE AT 5308 CANDY COVE TRAIL. RATIONALE BEING THAT HARDSHIP IS CAUSED BY THE LOT BEING A SUBSTANDARD LOT AND THE DEVELOPMENT PRACTICES OF A FORMER GOVERNMENT. GUTTERS FOR DRAINAGE CONTROL SHALL BE INSTALLED ON THE GARAGE AS REQUESTED BY THE BUILDING OFFICIAL. Vote taken signified ayes by Kedrowski, Roseth, Arnold, and Loftus. MOTION CARRIED.
