PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PLANNING COMMISSION MINUTES MARCH 16, 1989 The March 16, 1989, Prior Lake Planning Commission was called to order at 7:30 P.M. by Tom Kedrowski, Acting Chairman. Present were Commissioners Loftus, Roseth, Arnold, Kedrowski and Director of Planning, Horst Graser. ITEM I - REVIEW MINUTES OF PREVIOUS MEETING MOTION BY ROSETH, SECOND BY ARNOLD, TO APPROVE THE MARCH 2, 1989 MINUTES AS PRESENTED. Vote taken signified ayes. NOTION CARRIED. ITEM II HEARING - LAKESHORE VARIANCE - JOHN MEYER John M. Meyer, 8300 Ewing Road, Bloomington, NN 55431, stated he would like to add a deck, 16 X.38. ft. on a newly constructed cabin on Twin Isles for the purpose of enjoying the lake and surroundings. Mr. Graser's presentation indicated that Twin Isle late were platted in 1925 which now do not meet the existing zoning requirements. The required setback is 100' from the 904 contour line. Guidelines have been established not to exceed a variance over half of the setback. Therefore, the recommendation for this application is that the variance be granted for no more than a 12 foot deck to be built instead of 16 feet. The Proposed deck location is the logical site. Commissioner Kedrowski read a letter from Mike Mueller of the OWN indicating the rejection of the variance. Mr. Meyer commented he was under the impression that the deck had been included in the original building permit. Comments from the Commissioners were that they felt a variance over the 50' would not be feasible. MOTION BY LOFTUS, SECOND BY ROSETH, TO GRANT A 50 FOOT LAKESHORE VARIANCE FOR THE PURPOSE OF CONSTRUCTING A 12 X 38 FOOT DECK ON THE LAKE SIDE OF THE PROPERTY, ON LOTS 43, 44, AND 45, TWIN ISLES. Vote taken signified ayes. MOTION CARRIED. (512) 447.4230 4820 DAKOTA STREET S.E. PRIOR LAKE, MINNESOTA 65372 ITEM III - RICHARD MUELLER - LAKESHORE VARIANCE Richard Mueller, 4508 Vandervore, Edina, MN, stated that he bought the house as a retirement home and would like to remodel and bring it up to code standards. Horst Graser stated that the area where this home is built, houses were built at an angle to face the lake rather than in line with lot lines, thereby causing the variance application. The deck requires a 4' sideyard south, 6.4' sideyard north and 26' rear variance. The improvements would increase the property value. Question from Paul S Jan Geis, 17226 Sunset Trail, was on space for parking. Mr. Mueller assured them that there would be space for parking cars on his property. Commissioners were concerned on the variances but due to the construction pattern of the houses in the area felt it was not the fault of the applicant. Also questions were raised concerning possibility of construction of a future private road to serve the subject site and and adjacent lots for parking and access purposes. Mr. Graser pointed out that Lot 3 is owned by the City and is proposed to be kept as open space so construction on the lot is unlikely at this time. MOTION BY LOFTUS, SECOND BY ROSETH, THAT A VARIANCE OF 4 NORTH SIDE; 6.4 SOUTH SIDE YARD; 26 REAR YARD SETBACK VARIANCES BE GRANTED FOR LOT 2, SUNSET SHORES, FOR PURPOSES OF MAKING ADDITIONS AS SUBMITTED TO THE STRUCTURE. 1. JUSTIFICATION BEING THAT THE EXISTING STRUCTURE WAS BUILT PRIOR TO ANY FORMAL ZONING CODE OR ORDINANCES AND THAT NEW CONSTRUCTION IS CONSISTENT AND IN LINE WITH THE EXISTING STRUCTURE. 2. VARIANCE IS NOT DETRIMENTAL TO THE GENERAL WELFARE OR HEALTH OF THE COMMUNITY AND DUE TO THE ALIGNMENT OF THE EXISTING PROPERTIES IN THE NEIGHBORHOOD, IT SEEMS TO BE IN CHARACTER WITH THEM. THE HARDSHIP IS NOT THE FAULT OF THE APPLICANT. vote taken signified ayes. MOTION CARRIED. MOTION BY ARNOLD, SECOND BY ROSETH, TO ADJOURN. Vote taken signified ayes. Motion carried. Present were Commissioners Arnold, Kedrowski, Poseth and Wells, Director of PLanning Horst Graser, Assistant City Planner Deb Garross and City Intern Gary Schmitz. Commissioner Loftus arrived at 8:27 P.M. ITEM I - REVIEW THE MINUTES OF PREVIOUS MEETING !:OTION BY KEDROWSKI, SECOND BY ROSETH, TO APPROVE THE JANUARY 19, 1989, MINUTES AS PRESENTED. Vote taken signified ayes. MOTION CARRIED. commissioner Roseth commended the Staff on providing an excellent retreat for the Commissioners. ITEM II PUBLIC HEARING - AMEND ZONING CODE SECTION 4.1L 'SETT BACK REQUIREMENTS COU Y ROA Mr. Graser gave a demonstrati and illustrations on the language of the Amendment. Scott County Highway Department has requested the change. Questions raised by the Commissioners were on the present homeowners affected by the amended changes and if non - conforming houses would result if roads are widened. MOTION BY ARNOLD, SECONDED BY KEDROWSKI, TO APPROVE THE PROPOSED AMENDMENT AS WRITTEN. That the proposed amendment is better suited for planning and construction, that it will reduce possibilities of non - conforming structures and it will delineate adequate setback requirements. Leo Virling, 4730 - 140th St. N.E., stated: that he is a property owner adjacent to the area in question. He felt that if the 97 acres is taken out of industrial, his should also be rezozned. Also, Mr. Virling felt conservation was needed and he did not feel industry is suited for the land.' Dorothy Brandt, 16503 Franklin Trail, owner of 40 acres on Pike Lake Trail, was unaware that her land was zoned industrial she felt this was a hardship for her to have this zoned industrial. Bob Cavill, 14909 Manitou Road, felt this area should be looked at very carefully and that conservation areas need protection. Don Abrams, 14877 Manitou Road, felt it should be kept industrial and that the conservation area must be protected. Comments from the Commissioners were: If this area is changed from industry to residential then another area needs to be designated. The area should be looked at with respect to all property owners and the entire parcel should be considered in any rezoning application. Applicant did not show substantial reasons for change to be made. Study is needed on the land use and the possibility of designating industrial land in some other area of the community. MOTION BY WELLS, SECOND BY LOFTUS, RECOMMENDATION THAT THE PLANNING COMMISSION RECOMMEND TO THE CITY COUNCIL THAT THIS ISSUE BE BROUGHT FORTH TO THE CITY COUNCIL, TABLED AT THIS TIME UNTIL A STUDY CAN BE COMPLETED BY THE CITY STAFF IN CONJUNCTION WITH THE ECONOMIC DEVELOPMENT COMMITTEE, PLANNING COMMISSION IF NECESSARY, AND OTHER APPROPRIATE AGENCIES AND PEOPLE :THAT WOULD EXAMINE THE NEEDS OF INDUSTRIAL ZONES, THE CHANGES IN THE COMPREHENSIVE PLAN, OTHER RELATED ISSUES, AND THAT THE RECOMMENDATION. BE FORWARDED WITH THE COMMENTS FROM THE PLANNING COMMISSION, THAT THERE IS CONCERN REGARDING TAKING INDUSTRIAL LAND OUT OF THE CITY WITHOUT A REPLACEMENT AND AT THE SAME TIME RECOGNIZING THE NEEDS OF THE OWNERS OF THIS PROPERTY AND THE TOPOGRAPHICAL CONDITION OF THE LAND. Discussion followed indicated concern on what would replace the area if this land was taken out of:= industrial. MOTION WITHDRAWN BY WELLS. MOTION BY LOFTUS,SECOND BY ROSETH,:::TO DENY THE COMPREHENSIVE PLAN AMENDMENT BASED ON THE FOLLOWING FINDINGS;',. THERE IS INCOMPLETE INFORMATION; FURTHER STUDY IS NEEDED TO DETERMINE WHAT ''OPTIONS EXIST FOR INDUSTRIAL DEVELOPMENT IP THIS SITE IS REZONED; IT IS INAPPROPRIATE TO REZONE WITHOUT LOOKING AT THE ADJOINING PARCELS THAT MAKE THE ENTIRE 280 ACRE INDUSTRIAL PARK. Vote taken signified ayes, MOTION CARRIED., MOTION BY LOFTUS, SECOND BY ROSETH., TO DENY THE REZONING APPLICATION. Vote taken signified ayes, MOTION CARRIED.. MOTION BY KEDROWSKI, SECOND BY.. MOTION BY ROSETH, SECOND BY ARNOLD, RECOMMENDING FURTHER STUDY BY CITY STAFF OF THE COMPREHENSIVE PLAN TO STUDY THE NEED AND APPROPRIATE LOCATION FOR INDUSTRIAL SITES. Vote taken signified ayes, MOTION CARRIED. Comment was made that the Comprehensive Plan should be reviewed sometime in the future. MOTION BY KEDROWSKI, SECOND BY ARNOLD, TO ADJOURN.
