DECEMBER 17, 1987
The December 17, 1987, Prior Lake Planning Commission meeting was called to
order at 7:30 P.M. by Chairman Roseth. Present were Camnissioners Arnold,
Loftus, Wells, and Assistant City Planner Garross. Commissioner Kedrowski
arrived at 7:35 P.M.
At this time a 3 minute recess was called. The meeting resumed at 7:35 P.M.
MOTION BY ARNOLD, SEODND BY WELLS TO APPROVE THE DECEMBER r
COMMISSION MINUTES AS PRESENTED.
Upon a vote taken, ayes by Arnold, Loftus, Roseth, Wells; the motion passed
unanimously.
ITEM II - VARIANCE RE(XTE.ST BY TERRY AND BONNIE B2L M
Mr. s Mrs. Benham, 5871 150th Street SE, stated that they would like to sell
their property with the concept that it could be a hobby farm. They are
requesting a variance to allow horses only with a yearly review. The buildings
are already there and set back from the road, therefore causing no disturbance.
Assistant City Planner Garross commented per mend dated December 17, 1987.
The Planning Camnissioners had concerns over future area developnent, neighbors
response, limiting to horses only, trails for riding, and a time established for
review.
MO'T'ION BY WELLS TO APPROVE THE REQUEST TO KEEP UP TO FIVE HORSES WITH AN ANNUAL
REVIEW OR SOONER IF THERE'S A OOMPLAINT REGALING THE HORSES AT 5871 150TH
STREET S.E. SINCE THE SITE HAS TWO EXISTING BARNS LOCATE: IN AN UNDEVELOPED
AREA OF THE COMMUNITY AND A PRECEDENT HAS ALREADY BEEN SET, SECONDED BY ARNOLD.

ITEM III - VARIANCE REQUEST BY STEVE B RAM3E'Y
Joe and John Knoblauch, K s S Development and representative, stated that plans
were submitted for a house on a corner lot, which is Lot 6, Block 3, Willows 6th
Addition, but since there was a county road the setback could not be met.
Therefore, the developer moved the house to the next lot, which is Lot 5, Block
3, Willows 6th Addition, but omitted the deck plans and thus a sliding glass
door was left on the plans to the side lot line. The developer built the deck
onto the house but ::hen. the Inspector cane out the setbacks could not be met and
a Certificate of Occupancy could not be issued, thus the deck was removed to
acquire the Certificate of Occupancy. Therefore, they are requesting a 2 foot
side yard variance to construct a 4 X 12 foot deck or the sliding glass doors
will have to be replaced elsewhere on the house.
Assistant City planner Deb Garross commented per memo dated December 17, 1987.
The Planning Commissioners discussed the request with regard to setting a
precedent, hardship of the developer not City, and enforcing the code.
MOTION BY KEDROWSKI, SEODND By ARNOLD TO DENY THE VARIANCE REQUEST FOR LOT 5,
BLACK 3, WILLOWS 6TH ADDITION SINCE THERE IC NO HARDSHIP, NOT A SUBSTANDARD LOT
AND IN ACCORDANCE WITH THE CITY CODE.
Upon a vote taken, ayes by Arnold, Kedrowski, Wells; nay by Loftus, Roseth; the
motion passed.
MOTION BY KEDROWSKI, SEODND BY WELLS TO ADLTOURN THE DECEMBER 17, 1987 PRIOR LAKE
PLANNING COMMISSION MEETING.

The December 3, 1987 Prior Lake Planning Commission meeting was called to order
at 7:30 P.M. by Chairman Roseth. Present were Commissioners Arnold, Kedrowski,
Loftus, Wells, City Planner Graser and Assistant City Planner Garross.
ITEM I - REVIEW OF MINUTES OF PREVIOUS MEETING

ITEM II - PAUL CHAVES VARIANCE REDDEST
Paul Chaves, 16145 Northwood Road - Lot 82 Northwood, commented on the request
for a variance to build a house on his 50 to 60 foot wide lot and tear down an
existing cabin. Due to the utility lines and road easement running through the
lot he needs a 5 foot side yard variance to place the house.
City Planner Graser commented per memo dated 12/3/87.
The Planning Commissioners discussed this variance request.
MOTION BY AIMID, SECOND BY KEDRCWSKI TO APPROVE THE 5 FOOT SIDE YARD VARIANCE
FOR 16145 NOMMWOCD ROAD, LOT 82 NORTHWOOD, TO CONSTRUCT A SINGLE FAMILY HOME
SINCE THE VARIANCE IS NOT DETRIMENTAL TO THE GENERAL HEALTH AND WELFARE OF THE
PUBLIC.
Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.
ITEM TIT KAY SCHMUDLACH UPDATE OF HIGHWAY 13 TASK FORCE
Kay Schmudlach discussed the Highway 13 Task Force with regard to their duties
and what they are trying to accomplish. She will come back to update the
Commissioners in a couple of weeks.

The Planning Ccmmnissioners discussed the amendment, landscaping and berm of the
proposed car wash.

LAM COUNCIL MINUTES WHICH IS "THE APPROVAL ALSO To BE PREDICATED ON THE

Duwade Harris, 15220 Howard Lake Road, conmented on the request to increase the
agricultural density of 4 units per quarter /quarter section by one unit. Mr.
Harris stated that due to the wooded area and a misunderstanding on his part
when the platting was done in 1978 the property can't be used or sold unless it
could be divided.
City Planner Graser commented per memo dated November 19, 1987.
The Planning Commissioners discussed the request with regard to circumstances at
the platting in 1978, area density, lots of record, and hardship.

At this time discussion followed regarding retreat dates and places for the 1988
Planning Commission Retreat.

ITEM II - HEARING OF BROORSVIIM HILLS 8TH ADDITION FINAL PLAT APHUM
Mary Eggum, 15708 Judicial Road, Burnsville, developer, commented that he is
seeking an amendment to the Preliminary Plat with regard to 9 lots reduced to 5
lots fronting on County Road 21, grading, filling, demolition and clean up,
riprap drainage instead of storm sewer, and utilities.
Assistant City Planner Garross commented per memos dated November 5, 1987 from
Planning, Engineering, Parks and County.
There was no audience to draw input from.
The Planning Ccmmnissioners had comments on drainage, lot size, driveways onto
County Road 21 and road system, and park dedication.
MOTION BY WELLS, SECOND BY KEDROWSKI TO APPROVE THE FINAL PLAT OF BROOKSVILLE
HILLS 8TH ADDITION SUBJECT TO THE FOLLOWING CONDITIONS:
1. AMEND CONDITION #7 TO ALLOW AN ALTERNATIVE D RAINAGE SYSTEM FOR THE
PLAT, WITH SPECIFICATIONS SUBJECT TO APPROVAL BY THE CITY ENGINEER.

OCTOBER 15, 1987
The Planning Commission mission was called to order on October 15, 1987 at 5:30 P.M. to
tour various development projects in the City of Prior Lake and finishing the
tour at City Hall for the regular scheduled meeting at 7:30 P.M. Present was
Commissioner Kedrowski, City Planner Graser, and Assistant City Planner Garross.
Absent were Commissioners Arnold, Loftus, Roseth and Wells.
The regular scheduled October 15, 1987 Prior Take Planning Commission meeting
was called to order at 7:35 P.M. by Chairman Roseth. Present were Commissioners
Arnold, Kedrowski, Loftus, Wells, City Planner Graser and Assistant City Planner
Garross.

Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion
passed unanimously.
At this time, Commissioner Wells stepped down from the Commission due to
association with the following item.
ITEEaT TI - VARIANCE AMENDMENT REDUFST BY JERRY
Jerry Young, Watersedge Marina owner, commented that the initial variance was
for sailboat retail business only. However, due to economics the sailboat
business is in a slump. Therefore, due to this hardship, he is requesting that
the stipulation on the type of boats to enter and dock in Boudins Manor Bay be
changed to include power boats. This year the low water in the bay and channel
have caused some problems and power boats help create movement of the water for
sailboats to move.
City Planner Graser commented per memo dated October 13, 1987.

Area residents commented on the shallow water in the bay, weed problems for
boats, docking of additional boats, cluttering the bay with boats, maintenance
of the approach to the marina, lighting in the area, security, control of the
gate, and liability on part awned by condominium.
Mr. Young commented that he would be willing to work with the people on
concerns.
The Planning Oon¢nissioners discussed the concerns and comments.

FOR 5885 BOUDIN STREET, BY JERRY YOUNG TO ELIMINATE FROM THE ORGINIAL VARIANCE

Denny Fitzgerald, 15060 Fish Point Road, developer commented on the plat with
regard to down sizing the lots from 10 to 9, a pond on the lot donated to the
city, a trail path on the 10th lot, and due to taxes the developer cannot afford
to keep the lots and requests preliminary plat approval.
City Planner Graser commented per mew dated September 29, 1987, and also stated
that City Parks Director, Bill Mangan rejected the park fee of the pond donation
since this is not the type of pond for a park. In this case, cash in lieu of
lazed for this plat would be required. City Planner Graser presented a plan
utilizing Omega Trail for lot plans.
At this time audience input was called for.
The area residents had concerns over the high density causing traffic problems
and safety, steep grades off lots on Fish Point Road for drainage and driveways,
preserving the natural area, compatibility of the proposed homes to the area,
and development cost of Omega Trail.

The Planning Commissioners discussed the prorvsal and felt the concerns over the

Mr. Rygajlo commented that the plot plan has changed with regard to setback of
the house 16' from the neighbor property, straight driveway with turnaround and
retaining wall reconstructed by him.
City Planner Graser commented per memo dated September 29, 1987, and also
presented a map showing drainage and setbacks.
The area residents reviewed the map and showed concern over the drainage and
runoff from another structure on this block.
The Planning Commissioners discussed the variance request and felt the
resident's concerns should be addressed to the City Engineer.
City Planner Graser stated he would draft a memo to Engineering and the City
Manager regarding drainage concerns of residents on Green Oaks Trail.
MOTION BY ARNOLD Ta APPROVE A 25 FOOT FRONT YARD VARIANCE FROM HIGHWAY 13 FOR
15230 GREEN OARS TRAIL TO CONSTRUCT A NEW HOME BASED ON THE FACT THE APPLICANT
MET CR ITERIA OF STAFF AND COMMISSION, SECONDED BY KEDROWSKI.

ITEM IV - SAS CONDITIONAL USE PERMIT AMENDMENT
Dave Darrell, representative, stateu mat due to financial economics the
automatic car wash bay is not feasible at this time and they would like to
change from 4 self service and 1 automatic bays to 6 self service car wash bays.
Steve Towle, owner, asked if a lighting plan for the entire area could be
coordinated with T.F. James Company and then for consistency.
City Planner Graser commented per memo dated September 25, 1987 and also stated
that he would coordinate the lighting plan.

Gene Sinpkins, developer, commented that there was a misunderstanding under the
original approval regarding the Developer's Agreement and platting the entire
property. The Developer's Agreement would require $40,000 before the lots were
sold, therefore causing a hardship. At this time they are requesting that 11
lots go into Outlots A, B, and C when Fisher Avenue goes in.
City Planner Graser commented per memo dated October 1, 1987.
MOTION BY KEDROWSKI, SECOND BY ARNOLD TO APPROVE THE NORTH SHORE OAKS 5TH
ADDITION HARDSHELL AMENDMENT SUBJECT TO:

Mr. Rygajlo c moented that, in 1979 the lot was divided into two parcels and at
that time there was only a 25 setback requirement from Highway 13 whereas; now,
there is a 50 setback requirement. UUnfortunately, in 1979, he could not afford
to build nor could the abutting property owners afford to purchase the other
lot. Due to the pie shape and elevations of the lot, a variance is needed to
build a home.

Bob Larson owner of abutting lot had concerns over the drainage from the lot
towards his property.

Mr. Jim Filippi, representative, cammented that the applicant is requesting a
Zoning Code Amendment and Conditional Use Permit to develop a convenience store,
gas station,and car wash in a B-2 District on the property now called the Union
76 station. Also,they would like to expand the property line with the purchase
of the Travel /Insurance Agency next door, route traffic from Highway 13 through
Walker Avenue and south, after acquiring the right of way and getting a 7 foot
variance. The alley west of the building should be widened to 24 feet, but
needs an easement granted, for access to the clinic on Walker Avenue. They will
be adding new pumps with canopy, parking spaces, landscape and berm, and redo
the outside facia with Amoco colors.
City Planner Graser commented per metro dated September 3, 1987. Also commenting
that Consulting City Planner Tooker would review the landscape plan on September
4, 1987.

7:30 P.M. by Chairman Loftus. Present were Commissioners Arnold, Kedrowski,

Bob Bailey cxmmented on the Home Occupation request regarding a lawn service
canpany out of his residence. Since the application, Mr. Bailey has made same
charges such as only billing and phone calls will be at the house and only one
person c=wtes from the house to the place where the trailers and equipment are
stored.
City Planner Graser ccmented per memo 5- 21-87, and asked the Cammission to take
into consideration the changes made since the memo.
The area residents bad concerns on early morning noise, dust, sparks, additional
parked cars trucks and trailers on the street, .returning crew on rainy days and
hulling arou:ad. The residents did not have are,r objections to a Hane Occupation
within the covenants of the subdivision and an automatic review.
The Planning c^.aomissioners discussed the concerns of the residents and Mr.
Bailey's effort to work out a solution to the situation with the residents.

ITEM III - VARIANCE REQUEST' BY PRIOR LAKE PUBLIC SCHOOLS
Greg Mead representative for the School District commented that the Task Force
recommended additional classrooms for the school space need. The variance will
be needed on the side adjacent to Memorial Park to place portable classrooms on
the site. This could be a short term solution depending on the bond issue.
City Planner Graser commented per memo dated 6/18/87.
The Planning Commission commented on the variance request with regard to parking
facilities being deleted, delivery trucks access, bond issue with no interest so
far, and any alternative sites for portables.

requesting the number of people who can use the boat slips not the number of
slips to increase since Outlot A was always expressed for backlot access.

The area residents had concerns over increase of traffic on the small bay
causing accidents, shallowness of the bay creating mud and erosion, wildlife
being disturbed, concrete trucks cleaning out rigs in bay and bringing mud onto
streets, construction noise starting at 5:30 A.M., and Outlot A property title.

Steve Nelson commented on the variance request fcr 15279 Fairbanks Trail with
regard to expansion of an old cabin for living quarters. Mr. Nelson commented
that the 20 X 2a' addition is a living roan, dinning room and bedroom for his
graving family. Mr. Nelson also felt a concern for the adjacent property owners
in blocking their sunlight and view since this is an A frame structure.
City Planner Graser commented per memo dated June 4, 1987.
At this time audience input was called for.
Manny Russo, owner of Lot 11 Maple Park Shore Acres, was concerned over the A
frame structure blocking sunlight and view and how it would fit into the area.
The Planning Commissioners discussed the variance request with regard to roof
height, need for additional variances, neighbors concerns over blocking view and
sunlight, and development on a substandard lot. However, they felt this request
is consistent with previous requests in this area.

Jim McCarty commented on the variance request for 14806 Estate Avenue S.E. He
felt there was confusion on the recommendation being detrimental to the general
health and welfare of the community when be spent a great deal of money in
making his property a viewing place for the boaters on the lake. Since there
are dense mature trees shielding the abutting property owners he felt his
request was not disturbing anyone.

around for years called "The Trees ". Mr. Graser commented that sewer stubs need
to be put in which would be the developer's cost, a lot of grading is needed in
one area and a grading plan needs to be submitted, the lots are very deep, the
lots need to be aligned paraallel, the topography is unique with a pond, lots of
open space, and several lard trees. The driveway to the existing house would
need an easement, park dedication area could be a concern without road access,
storm water management easement would have to be given, the natural features
should be considered as to what happens, each lot should have a building pad,
and there is a question of the buildability of Lot 1.
The Planning Camnissioners discussed the Concept Plan with regard to parallel
alignment of lots, topography, utilities, easements needed, park land, ponding,
and felt the larger lots on the new plan were an improvement.

ITEM III - VARIANCE REQUEST BY MICHAEL MAR EK
Michael Martinek cammented on the variance request for 15408 Red Oaks Road. Due
to a large tree on the west side of the garage the applicant would like to build
closer to the road requesting a I foot front yard variance. Because of the 50
foot lot, the appplicant is requesting a 4 foot side yard variance to rebuild
the deteriorating garage which is constructed on cement block that is caving
in.
City Planner Graser commented per memo dated 5/7/87.
The Planning Comnissioners commented on the request and felt that one foot of
additional front yard setback isn't a hardship in this case.

serving on the Commission.
City Planner Graser stated that 2 Planning Commissioners terms were up July 1,
1987, that of Chuck Arnold, and Ton Loftus. If they wish to reapply a letter to
Dave Urmacht to present to the City Council would be procedure.

Scott Lindholm, owner, commented on the request for a Conditional Use Permit in
the B-1 Limited Business District for a car wash. Mr. Lindholm also camnented
on the concerns of staff and Commissioners from the previous meeting on March 5,
1987. Such concerns were the site plan entrance and exit maneuvering, parking
on site, vacuum cleaner location, plantings, sodding instead of seeding, berm
around site, exterior construction material, lighting inside the building and
outside, operational hours, and type of system used. The applicant has and
would be more than willing to work with staff on any item.
City Planner Craser camnented per memo 4 -4 -87 and discussed the continuous berm
along Highway 13 and continuous lighting along Commerce Avenue. T.F. James
Company was contacted and they are having a consultant draw up a plan.
The Planning Cawdssioners discussed the car wash proposal and previous concerns
with architectural style, neighbors privacy, landscape plan, parking and radii
of driveways, elevations, berming, noise and pollution, reclamation system and
impact on the sewer system, lighting in the building and along Commerce Avenue.
The general consensus of the Ccmmiission was that the applicant has worked well
with staff to accaoplish the changes incorporated in the site plan.

Mary Fggum, developer, commented on the request to develop the Farnum farm which
is 7 acres zoned R-1 into 8 lots with 90 to 100 foot widths. Mr. Eggum further
commented on the extensive grading and filling required, City Staff has been
consulted with regard to utilities and d-ainage, the existing buildings will be
turned over to the fire department for training if desired, and due to the
extension of County Road 21 and the selling of all his lots, a time element
here is important for Mr. Eggum.
Assistant City Planner Garross commented with regard to the concept plat on lot
size, berms, hills throughout, Stone Water Management Plan for 100 year flood
elevations, saving of a few Oak trees, extensive grading and filling, utilities,
easements needed, driveway access and setbacks depending on County Roa9 21
alignment, time frame and future access south from abutting subdivision.
The Planning Commissioners discussed the concept plan with regard to Outlot A
donated to the City, road access from County Road 21 or a frontage road, grading
and filling, erosion to pond, Storm Water Management Plan 100 year study taken
into account, cul-de -sac done properly, and any concerns of area residents.

Greg Hailing representative for Ton Steffens, discussed the proposed framework
as it relates to zoning and design. The property is zoned R-3 and B-3 but due to
the market forces today they would like to rezone the property to fit single
family and multiple homes but leave the B-3 district. Mr. Hailing also
commented on the ponding, little grading of the flat land, and connecting
streets.

of the rezoning from R-3 to R-1 for single family homes. However they had
conczrns over the row of lots next to the business district, the inclusion of
multiple units in the northern edge of the site, the intersection of Spring Lake
Road and Highway 13 to the Willows, interconnecting of neighborhoods, and a
walkway to Five Hawks School.

ITEM VI - VARIANCE REQUEST BY STEVE UCMELD
Steve McDonald, representative for William McDonald, commented that the request
is for a 36.5 foot front yard variance for 4377 Quincy Street S.E. to construct
a 1500 square foot single family hone. Due to the County taking Tract B of the
parcel there is not sufficient roan to build without a variance.
City Planner Graser cemented per memo dated 4-2 -87 regarding the 36.5 foot
front yard variance next to County Road 21. The applicant is eligible for one
building permit for the entire 2.5 acre parcel. The building envelope on the
south side of Quincy Street is too restrictive for a hone to be built without
variance. There is sufficient property available north of Quincy to build a
hane.

Residents were opposed to the variance for the following reasons: due to safety
factors along County Road 21, location of the hone south of Quincy Street,
obstruction of view, setting a variance precedent, and because the structure
would be out of alignment with other homes along County Road 21.
The Planning Commissioners felt the application should reflect the entire parcel
not just the land available south of Quincy Street since the entire parcel is
eligible for only one permit. The Commissioners felt that an adequate building
envelope was available on the site north of Quincy Street and therefore, there
is no justification for a variance.
Jack Engberg spoke on behalf of the applicant. He felt the hardship was that
the applicant had invested in the property and can no longer build on the
parcel without variance due to the taking of land by Scott County.
MOTION BY ARNOLD TO DENY THE 36.5 FOOT FRONT YARD VARIANCE FOR 4377 QUINCY
STREET S.E. TO CONSTRUCT A SINGLE FAMILY HOME. THERE IS PROPERTY NORTH OF
QUINCY STREET WHERE A HOUSE CAN BE CONSTRUCTED WITHOUT VARIANCE THEREFORE THERE
IS NO HARDSHIP, SECONDED BY LOFTUS.

The Planning Commissioners felt when the applicant bought the hone from the
developer they should have checked for setbacks, codes, restrictions and
covenants.

Gene Simpkins and Doug Farrell, property owners, commented that they are seeking
concept approval for a small subdivision consisting of 13 lots which is located
adjacent to Carriage Hill Road. The introduction of sewer and water to the area
has prompted the owners to submit development plans.
City Planner Graser discussed the Conceptual Plat for North Shore Oaks This plat
would came under the old Subdivision Ordinance and Conceptual Plat approval was
given by Eagle Creek Township prior to its annexation to Prior Lake. Mr. Graser
further carom rated on sewer utilities planned for the area, tree plantings, width
of Carriage Hill Road, and the proposed park land. The area designated for park
is low land and may not satisfy City park dedication requirements. The
developer should give thought to retaining the parcel as a natural wildlife
area. Staff recamnends conceptual plat approval.

ITEM III - PUBLIC HEARING CONTINUATION FOR CONCEPT SITE PLAN - PRIORWOOD P.U.D.
AMENDMENT BY TOM STEFFENS WAS CALLED TO ORDE
Previous to the meeting at 5:30 P.M. a tour of the proxy_ -rty for this hearing was
taken by Staff, Planning Commission, developer, dnd area residents. Greg
Halling, Engineer for Rehder Wenzel, and representative for the developer was
present to answer questions.
City Planner Graser reviewed past action of Priorwood P.U.D. with regard to the
history of t.. P.U.D. and original proposal to develop 106 multi family units in
a 17.4 acre parcel. The concerns of 5 years ago are similar to todays concerns.
They consist of natural limitations of the site, garage space, another need for
a plan with detail and good architectural design. Five years ago the Prior lake
market favored apartments and condominiums while today's market is for single
family hares. Mr. Graser further commented on drainage and creek flowage, the
integration of the P.U.D. development with adjacent developed neighborhoods, tot
lot area, road design and collector system for safety, grading and filling
destruction, flood plain and orientation of units on the property.
At this time audience input was called for.
The area residents were opposed to the increased density proposed, destruction
of natural features, de- valuation of their property, impact of development on
the environmentally sensitive area, transition area between single family hones
and condos or apartments with a buffer, increased heavy traffic in area if Cates
and Five Hawks are connected, erosion and water flaw, and tot lot location a
concern for safety.
The Planning Commissioners had concerns over the increased density, haw changes
from the first P.U.D. request to this amendment affect the density bonuses
given, density bonuses should be re- evaluated, tot lot location, destruction of
slopes and natural features, developers lack of concern for the environment,
amount of buildable area, trails /walkways, aesthetic design, roadway circulation
for safety, drainage and water flow, owner occupied or rental, engineering and
parks concerns. The Commissioners were concerned that the density the developer
is attempting to achieve is in direct conflict with the goals of P.U.D.
development as specified in Section 6.11 of the Zoning Ordinance.
MOTION BY WELLS TO DENY THE PRIORWOOD P.U.D. APPLICATION AS PRESENTED BASED ON:
1. THE P.U.D. DOES NOT MEET THE REQUIROOM ESTABLISHED IN THE ZONING
ORDINANCE.
2. UNITS TO NORTH IN THE P.U.D. ARE TOO (LASE TO THE PROPERTY LINE, A 15'

ITEM IV - CONTINUED VARIANCE REQUEST BY GREG EIDE
Greg Eide commented that the request is for a 24 garage to the south side
of his house.
Assistant City Planner Garross commented per memo dated 3/5/87 with regard to
safety onto County Road 81. Also stating that a call from Brad Larson, Scott
County Highway Engineer was received. The County would be opposed to this
variance request due to the creation of another access point onto County Road
81. Staff was concerned that a safe intersection could not be achieved due to
existing topography on the site.
The Planning Commissioners commented on the topography of the lot with concern
over the steep slope and limited landing space at County Road 81. The
Commissioners were concerned that the intersection of the driveway and County
Road 81 would cause an unsafe situation for the homeowner and traffic on the
County Road.
MOTION BY ARNOLD TO DENY THIS REQUEST FOR A 34 FOOT FRONT YARD VARIANCE FROM THE
SOUTHEAST PROPERTY LINE FOR 3013 FAIRVIEW ROAD SINCE THE SLOPE PRESENTS AN

Don Alberts commented on the request for an 8' frontyard and 4 south side
yard variance to build a garage. Mr. Alberts presented two letters from
abutting property owners, Ardis Bergh north side property owner and Mr. & Mrs.
Michael Wagner south side property owners, not opposed to the variance request.
Also Mr. Alberts presented pictures showing lot lines and house which he bought
as such.
Assistant City Planner Garross cammented per memo dated 3/19/87 with regard that
the lot exceeds minimum lot size requirements, the applicant purchased the home
with full knowledge of the garage and driveway situation, and lack of hardship
as specified in Section 7.6 of the City zoning Ordinance.
The Planning Commissioners discussed the variance and understood the situation.
However there was concern over setting an irreversible precedent.

residential development. The Commissioners were concerned with architectural

visual, noise and pollution, outside storage, reclamation system and impact on

Commission was that if designed properly, a car wash facility could be

Greg Halling, Engineer for Rebder. Wenzel, and representative for the developer,
commented on the request to increase the density of the P.U.D. to 118 units with
the annexation of Holly Court. The proposed development framework consists of 2
single family homes which would be located off Roanoke Street, one 12 unit
building and six 6 unit buildings on 13 acres in Holly Court for a total density
of 50 units. Mr. Balling presented pictures of the building knoll showing the
disturbed land and trees already dead from grading. Also the pictures showed
the type and style of units in Burnsville which will be incorporated here. Mr.
Balling also commented on sidewalk along Five Hawks, additional parking stalls,
trash handled by resident, location of development with respect to the 10 year
flood plain, and the biggest concern of the tot lot on 1 1/2 acre site.
City Planner Graser commented per memo dated 3/3/87 with regard to memo's
presented by City Engineer, Larry Anderson and Parks Director, Bill Mangan.
Also concern aver the guidelines of a P.U.D. being upheld such as steep slopes,
design of units, density, 100 year flood plain, every portion of the development
made to be the best place to live, elevations, natural features, mature trees,
meeting setbacks, non - buildable low area, and tot lot consideration.

Steve McDonald, son of William, representative commented on the request to
rezone about 2.5 acres from P.U.D. to R-2. The development framework for the
P.U.D. consists of one 18 unit condaninian or apartment building. The applicant
sought to amend the P.U.D. to a townhouse development in 1985. At that time it
was discovered that the subject site contained less than the 2.5 acres required
for a P.U.D.. The applicant is now requesting that the P.U.D. be rezoned to its
underlying zoning classification of R-2 Urban Residential. It is his opinion
that R-2 zoning would be more marketable and feasible at this time.
City Planner Graser commented per memo dated 2/16/87 with regard to rezoning the
P.U.D., past action on the rezoning of the site from R-2 to P.U.D. and the
building site envelope.
At this time audience input was called for.
The area residents were not opposed to the rezoning of this property fran P.U.D.
to R-2 single family. They were concerned over existing and increased traffic
conditions and obstruction of view to the lake. Also there was great concern
over the future plans of this site, such as size of building and kind, if
rezoned to R-2. There was concern over the jutting peninsula off Bass Street
into Prior Lake and what could develop there.

ITEM III - MARIA= REQUEST BY DONALD V. A AMM
Mr. Alberts commented on his request for an 8' side yard and 4' front yard
variance for 14704 Cove Avenue SE. The variance is requested for a garage to be
added on the side of the house adjacent to the existing double garage. However,
the orientation of the house on the lot makes entrance to the existing garage a
hardship for turning. The lot next door bas a timbered retaining wall which is
on the property line. The applicant expresses concern that a car may back off
of the driveway and cause damage to the adjacent hone.
Mr. Robert Hillique cc mwnted that his mother -in -law (Mrs. Bergh) owns the lot
north of the subject lot and has no objections to the proposed variance. He
further commented that the people did not put the house on the subject lot and
perhaps the Commissioners could find a fair alternative to the situation even
though ordinance is specific with regard to the conditions that must be present
in order to justify granting a variance.
The Planning Commissioners discussed the variance and were concerned over the
setting of an irreversible precedent even though they understood the situation.
The Commissioers discussed the possibility of redesigning the existing garage
entrance to allow better access. Their suggestion to the applicant was to work
out an alternative plan and resubmit the proposal to the Commission at a later
date.

ITEM IV - DISCUSSION ON RETREAT FOR THE COMMISSIONERS
City Planner Graser asked the cc umissioners for their input on location, time,
topics and speakers for the annual retreat.
The Camnissioners discussed the retreat and tentatively decided on April 11,
1987. Perhaps a Friday, April 10 and Saturday, April 11, 1987 could be worked
out. The proposed retreat location would be The Hilton. Topics discussed were;
County Road 42 and north side of Highway 13 type of growth and canmunity access.
Speakers requested were Planning Staff; Tooker, Graser, Garross.
City Planner Graser camnented that he would see what could be worked out and
will get back to the Cmuissioners.

The February 5, 1987 Prior Lake Planning C mdssion meeting was called to order
at 7:30 P.M. by Chairman Loftus. Present were Commissioners Arnold, Roseth,
Wells, City Planner Graser and Assistant City Planner Garross.

At this time new Planning Commissioner Tom Kedrowski took the Oath of Office
given by City Planner Graser.
Linda Fisher representative for A1mac Inc. requested Preliminary Plat approval
for Island View 5th Addition. Ms. Fisher explained that the 18 acre subdivision
would consist of 31 single family lots. Lots 2, 3 & 4, Block 2 are shallow lots
and the developer is requesting that 20' lakeshore variances be granted for all
3 lots. A conditional use permit is also being requested in order that Outlot A
provide backlot access for 21 lots. The applicant has met with city staff
regarding parks and engineering concerns and is in agreement with all items
except for the staff proposal to eliminate Lot 1, Block 5. Almac Inc. will
continue to work with engineering staff regarding the extension of utilities to
*.he plat. Furthermore, the developer agrees to pay for the installation of
sanitary sewer from the north edge of the plat to County Road 83. In addition
to Preliminary Plat approval the developer is also requesting that the site be
rezoned from C -1 Conservation to R-1 urban Residential. The requested rezoning
would be consistent with the City Comprehensive Plan.
City Planner Graser commented per memo dated 2/2/87 with regard to rezoning,
Comprehensive Plan consideration, past actions affecting the site, creek
protection, variance and conditional use permit requests and road circulation.
At this time audience input was called for.
Ronan Kohut, 3600 154th Street NW, presented a letter from his attorney, Philip
Crass, regarding the dust problem of County Road 83 as a detrimental health and
safety hazard.
City Planner Graser read the letter Exhibit "A" for the record.

MINUTES OF THE PRIOR LAKE PLANNING CO MISSION FEBRUARY 5, 1987
The area residents discussed existing traffic and dust problems along County
Road 83 and were concerned about additional problems associated with the
addition of this subdivision. Also there was concern of when and if they could
hook up to the sanitary sewer pipe being put in by the Sioux Community along
County Road 83.
The Planning Commissioners were not opposed to the rezoning of Island View 5th
Addition. The proposed R-1 zoning would be consistent with the Comp Plan. Lot
1 Block 5 should be eliminated because of the low land situation. Fremont
Avenue to C.R. 83 shald be kept a consistent width of 36' and the creek should
be protected at all costs. Furthermore, the developer should have the
understanding that sewer hookup to the north is not guaranteed by the City.
County Road 83 from Fremont Avenue to County load 21 should be paved prior to
building.

ITEM III - PUBLIC HEARING FOR PRIOWIEW (TOM STEFFENS): P.U.D. AMENDMENT: ZONING

John Knoblauch, Tam Steffens, applicant, and Greg Halling, were present to
answer questions. Greg Halling, Civil Engineer with Rehder Wenzel, 10100
Morgan Avenue South, Bloomington commented that the request is for an amendment
to Priorview P.U.D. to include additional density with the annexation of 1.7
acres of Holly Court, therefore creating a total of 148 units. The proposal is
to construct rental units with single car garages and 1 outside parking spot.
In Greg Halling's opinion, the P.U.D. -could be built in the 100 year flood
plain provided contours be trimmed down and drainage work be under taken. The
wetland area could be controlled with a dam and pipes such as a 42" culvert.
The developer has met with area neighbors and will respect their requests for a
privacy fence north of Five Hawks. Access onto Highway 13 will be improved with
the completion of Five Hawks with access thru Holly Court.
City Planner Graser commented per memo dated 2 /4/87 with regard to the history
of the Priorview P.U.D. Staff felt that annexation of Holly Court would make
good planning and economic sense. However, the developer has not demonstrated
goad reason to change the Zoning or Comp Plan. The slope and hillside would
require a great deal of grading and filling. The northerly unit is almost 1008
in the 100 year flood elevation. The topographical data is not accurate and the
tot lot as sham in the flood plain is 12 feet lower than the road. The density
clearly exceeds the carrying capacity of this node. The creek bed would most
likely be disturbed if construction activity was done. The site cannot, in
staff's opinnicn, accommodate an R-3 density in its current state. The proposed
architectural style of the buildings are much more pleasant than larger
apartment type construction and they would relate munch better to smaller
adjacent homes.
The residents were opposed to the Amendment to increase the density of the
P.U.D.. They were also concerned with emniromental issues associated with the
site such as- 1.) The cite being able to handle a 100 year flood. 2.) A part of
the wand area being a state conservation area. 3.) Questions whether the
appropriate authorities such as DNR had been notified of the proposed Amendment.
4.) The wetland area holds wildlife habitat that should be preserved. Residents
were also concerned that higher density development would increase traffic flow
by the elementary school which would result in safety concerns for children
walking. Residents felt that increased density coupled with rental units would
lead to an increase of crime, debris, trash, and carelessness of transit people
in their neighborhood. Chairman Loftus read a letter from Mr. & Mrs. Gene
Erickson, area residents opposing the request, Exhibit "A ".

The Planning Commissioners had concerns and concurred with staff on topography,
vegetation, erosion, flooding, water storage and retentions issues. They did
agree that annexation of Holly Court would be feasibly good.
Ted Schweich commented that Holly Court annexation would be for the health,
safety and welfare of the area due to better fire and rescue access. He also
felt that density credits should be given for dam work which is expensive to the
developer. The new design for the units is an asset to the area.
NOTION BY ARNOLD TO DENY THE REZONING OF PRIORVIEN P.U.D. FROM R-2 TO R-3 SINCE
THE PROPOSAL DOES NOT WARRANT AN INCREASE IN DENSITY, DUE TO SECTION 6.11 OF THE
ZONING ORDINANCE PAGE 25, 12.E PRESERVING NATURAL AREA; AND THIS IS NCT IN THE
BEST INTEREST OF THE GENERAL HEALTH AND WELFARE OF THE COMMUNITY, SECONDED BY
WELLS.

ITEM IV - VARIANCE REQUEST BY MARK HYIAND
Mark Hyland commented on his request for a 7.82 foot front yard and a 5 foot
south side yard variance for 14399 Watersedge Trail NE. The variance is
requested in order to construct a greenhouse addition to his hone. He discussed
his plans with neighbors and received no objection to his proposal.
Assistant Planner Garross commented per memo dated 2/5/87. The applicant had ben
granted a variance in 1985 but never utilized it. This proposal would be
consistent with existing development in the neighborhood.
The abutting neighbors were in attendance and supported the proposal and felt it
would enhance the neighborhood. They stated that Mr. Hyland has already put in
a lot of time and money to improve his property.
The Planning Commissioners discussed the variance request and proposed addition.

City Planner Graser commented that Preliminary Plat approval was on 8 -21 -86 and
the City approved the final plat subject to a Park Dedication fee of $840 being
paid.

The January 15, 1987 Prior Lake Planning Commission meeting was called to order
at 7:30 P.M. by Chairman Loftus. Present were Commissioners Arnold, Roseth,
wells, City Planner Graser and Assistant City Planner Garross.

ITEM II - CONDITIONAL. USE AND VARIANCE REQUEST FOR THE CITY OF PRIOR LAKE:
Deb Garross, Assistant City Planner, commented that the City is requesting a
Conditional Use and Variance to construct a public utility building in an R-1
Urban Residential District. The minimum lot size requirement in this district
is 15,000 square feet. Lot 15 is approximately 13,000 square feet therefore a
variance would be needed in order to build the well house. The well house has
been designed by staff to assimilate into the single family neighborhood.
Maintenance staff would visit the well house to check the Pump on a daily basis.
Lawn care would be provided by a lawn care service or by contracting with
neighbors.
The Planning Commissioners discussed several aspects of the proposal including
the exterior siding and roofing materials to be used, number of windows in the
well house, need for a skylight, site location and public notification of the
proposal. The Commissioners were concerned about possible vandalism to the
structure and discussed options such as reduction of the number of windows, use
of a metal entrance door rather than a door with a window and incorporation of
security locks and lighting into the design plan. The Camnission also specified
that there should be no outside storage.

MOTION BY ROSETH TO APPROVE THE CONDITIONAL USE PERMIT, AND VARIANCE TO
CONSTRUCT A WELL HOUSE IN AN R -1 DISTRICT. THE WELL HOUSE IS NEEDED AND THE
PROPOSAL WOULD NOT BE DETRIMENTAL TO THE GENERAL HEALTH AND WELFARE OF THE
NEIGHBORHOOD. APPROIAL IS CONTINGENT UPON:
I. THE WELL HOUSE DESIGN MUST CONFORM WITH THE NEIGHBORHOOD. SUBMIT STAFF
