BOX 359 PRIOR LAKE, MINNESOTA 55372 F 9, a PLANNING GDM IISSION MINUTES DECEMBER 17, 1987 The December 17, 1987, Prior Lake Planning Commission meeting was called to order at 7:30 P.M. by Chairman Roseth. Present were Camnissioners Arnold, Loftus, Wells, and Assistant City Planner Garross. Commissioner Kedrowski arrived at 7:35 P.M. At this time a 3 minute recess was called. The meeting resumed at 7:35 P.M. MOTION BY ARNOLD, SEODND BY WELLS TO APPROVE THE DECEMBER r COMMISSION MINUTES AS PRESENTED. Upon a vote taken, ayes by Arnold, Loftus, Roseth, Wells; the motion passed unanimously. ITEM II - VARIANCE RE(XTE.ST BY TERRY AND BONNIE B2L M Mr. s Mrs. Benham, 5871 150th Street SE, stated that they would like to sell their property with the concept that it could be a hobby farm. They are requesting a variance to allow horses only with a yearly review. The buildings are already there and set back from the road, therefore causing no disturbance. Assistant City Planner Garross commented per mend dated December 17, 1987. The Planning Camnissioners had concerns over future area developnent, neighbors response, limiting to horses only, trails for riding, and a time established for review. MO'T'ION BY WELLS TO APPROVE THE REQUEST TO KEEP UP TO FIVE HORSES WITH AN ANNUAL REVIEW OR SOONER IF THERE'S A OOMPLAINT REGALING THE HORSES AT 5871 150TH STREET S.E. SINCE THE SITE HAS TWO EXISTING BARNS LOCATE: IN AN UNDEVELOPED AREA OF THE COMMUNITY AND A PRECEDENT HAS ALREADY BEEN SET, SECONDED BY ARNOLD. BOX 359 PRIOR LAKE, MINNESOTA 55372 ITEM III - VARIANCE REQUEST BY STEVE B RAM3E'Y Joe and John Knoblauch, K s S Development and representative, stated that plans were submitted for a house on a corner lot, which is Lot 6, Block 3, Willows 6th Addition, but since there was a county road the setback could not be met. Therefore, the developer moved the house to the next lot, which is Lot 5, Block 3, Willows 6th Addition, but omitted the deck plans and thus a sliding glass door was left on the plans to the side lot line. The developer built the deck onto the house but ::hen. the Inspector cane out the setbacks could not be met and a Certificate of Occupancy could not be issued, thus the deck was removed to acquire the Certificate of Occupancy. Therefore, they are requesting a 2 foot side yard variance to construct a 4 X 12 foot deck or the sliding glass doors will have to be replaced elsewhere on the house. Assistant City planner Deb Garross commented per memo dated December 17, 1987. The Planning Commissioners discussed the request with regard to setting a precedent, hardship of the developer not City, and enforcing the code. MOTION BY KEDROWSKI, SEODND By ARNOLD TO DENY THE VARIANCE REQUEST FOR LOT 5, BLACK 3, WILLOWS 6TH ADDITION SINCE THERE IC NO HARDSHIP, NOT A SUBSTANDARD LOT AND IN ACCORDANCE WITH THE CITY CODE. Upon a vote taken, ayes by Arnold, Kedrowski, Wells; nay by Loftus, Roseth; the motion passed. MOTION BY KEDROWSKI, SEODND BY WELLS TO ADLTOURN THE DECEMBER 17, 1987 PRIOR LAKE PLANNING COMMISSION MEETING. Present were Commissioners Arnold, Kedrowski, Loftus, Wells, City Planner Graser and Assistant City Planner Garross. ITEM I - REVIEW OF MINUTES OF PREVIOUS MEETING MOTION By WELLS, SECOND By LOFTUS TO APPROVE THE NOVEMBER 14AWISSION MINUTES AS PRESENTED. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion passed unanimously. ITEM II - PAUL CHAVES VARIANCE REDDEST Paul Chaves, 16145 Northwood Road - Lot 82 Northwood, commented on the request for a variance to build a house on his 50 to 60 foot wide lot and tear down an existing cabin. Due to the utility lines and road easement running through the lot he needs a 5 foot side yard variance to place the house. City Planner Graser commented per memo dated 12/3/87. The Planning Commissioners discussed this variance request. MOTION BY AIMID, SECOND BY KEDRCWSKI TO APPROVE THE 5 FOOT SIDE YARD VARIANCE FOR 16145 NOMMWOCD ROAD, LOT 82 NORTHWOOD, TO CONSTRUCT A SINGLE FAMILY HOME SINCE THE VARIANCE IS NOT DETRIMENTAL TO THE GENERAL HEALTH AND WELFARE OF THE PUBLIC. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion passed unanimously. ITEM TIT KAY SCHMUDLACH UPDATE OF HIGHWAY 13 TASK FORCE Kay Schmudlach discussed the Highway 13 Task Force with regard to their duties and what they are trying to accomplish. City Planner Graser commented per memo dated November 19, 1987. The Planning Ccmmnissioners discussed the amendment, landscaping and berm of the proposed car wash. MOTION BY WELLS, SECOND BY ARNCE,D TO APPROVE THE CONDITIONAL USE AMENDMENT FOR SAS SUPER SPRAY CAR WASH FOR A B-1 DISTRICT ON LOT 1, BIACK 1 JAMES 1ST ADDITION TO REVERT BACK To THE ORIGINAL PLAN TO EXCLUDE ITEM #3 OF THE MAY 4, 1987 PRIOR LAM COUNCIL MINUTES WHICH IS "THE APPROVAL ALSO To BE PREDICATED ON THE FORTHCOMING ANALYSIS BY THE METROPOLITAN WASTE CONTROL COMMISSION APPROVING THE RECLAMATION SYSTEM AND VERIFICATION OF ONE SAC UNIT CHARGE." BOX 359 PRIOR LAKE, MINNESOTA 55372 MINUTES OF THE PRIOR LAZE PLANNING CDD4,ISSION w7EMEP 19, 1987 ITEM I II = D UWADE H ARP-IS VARIANCE_ Duwade Harris, 15220 Howard Lake Road, conmented on the request to increase the agricultural density of 4 units per quarter /quarter section by one unit. Mr. Harris stated that due to the wooded area and a misunderstanding on his part when the platting was done in 1978 the property can't be used or sold unless it could be divided. City Planner Graser commented per memo dated November 19, 1987. The Planning Commissioners discussed the request with regard to circumstances at the platting in 1978, area density, lots of record, and hardship. ITEM II - HEARING OF BROORSVIIM HILLS 8TH ADDITION FINAL PLAT APHUM Mary Eggum, 15708 Judicial Road, Burnsville, developer, commented that he is seeking an amendment to the Preliminary Plat with regard to 9 lots reduced to 5 lots fronting on County Road 21, grading, filling, demolition and clean up, riprap drainage instead of storm sewer, and utilities. Assistant City Planner Garross commented per memos dated November 5, 1987 from Planning, Engineering, Parks and County. There was no audience to draw input from. The Planning Ccmmnissioners had comments on drainage, lot size, driveways onto County Road 21 and road system, and park dedication. MOTION BY WELLS, SECOND BY KEDROWSKI TO APPROVE THE FINAL PLAT OF BROOKSVILLE HILLS 8TH ADDITION SUBJECT TO THE FOLLOWING CONDITIONS: 1. AMEND CONDITION #7 TO ALLOW AN ALTERNATIVE D RAINAGE SYSTEM FOR THE PLAT, WITH SPECIFICATIONS SUBJECT TO APPROVAL BY THE CITY ENGINEER. 2. BOX 359 PRIOR LAKE, MINNESOTA 55372 • . &0 0 a A PLANNING ODMMISSION MINUTES OCTOBER 15, 1987 The Planning Commission mission was called to order on October 15, 1987 at 5:30 P.M. to tour various development projects in the City of Prior Lake and finishing the tour at City Hall for the regular scheduled meeting at 7:30 P.M. Present was Commissioner Kedrowski, City Planner Graser, and Assistant City Planner Garross. Absent were Commissioners Arnold, Loftus, Roseth and Wells. The regular scheduled October 15, 1987 Prior Take Planning Commission meeting was called to order at 7:35 P.M. by Chairman Roseth. Present were Commissioners Arnold, Kedrowski, Loftus, Wells, City Planner Graser and Assistant City Planner Garross. ITEM I - REVIEW OF MITAIT S OF PREVIOUS MEETING AMEND OCTOBER 1, 1987 MINUTES AS FOLLOWS: PAGE 3, 7TH PARAGRAPH DE 'LOFTUS' ADD "ONE ABSTENTION, LOFTUS. PAGE 3, 10TH PARAGRAPH DELETE "LOFTUS" MOTION BY LOFTUS, SECOND BY ARMQ,D TO APPROVE THE OCTOBER 1, 1987 PLANNING COMMISSION MINUTES AS AMENDED. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion passed unanimously. At this time, Commissioner Wells stepped down from the Commission due to association with the following item. ITEEaT TI - VARIANCE AMENDMENT REDUFST BY JERRY Jerry Young, Watersedge Marina owner, commented that the initial variance was for sailboat retail business only. However, due to economics the sailboat business is in a slump. Therefore, due to this hardship, he is requesting that the stipulation on the type of boats to enter and dock in Boudins Manor Bay be changed to include power boats. This year the low water in the bay and channel have caused some problems and power boats help create movement of the water for sailboats to move. BOX 359 PRIOR LAKE, MINNESOTA 66372 MINWES OF THE rPRIOR LAKE PLANNING COMMISSION OCTOBER 15, 1987 Area residents commented on the shallow water in the bay, weed problems for boats, docking of additional boats, cluttering the bay with boats, maintenance of the approach to the marina, lighting in the area, security, control of the gate, and liability on part awned by condominium. Mr. Young commented that he would be willing to work with the people on concerns. The Planning Oon¢nissioners discussed the concerns and comments. MOTION BY LOFTUS, SECOND BY KEDROWSKI TO APPROVE THE VARIANCE AMENDMENT REQUEST FOR 5885 BOUDIN STREET, BY JERRY YOUNG TO ELIMINATE FROM THE ORGINIAL VARIANCE "ITEM # d. POWER BOAT USE SHALL BE LIMITED TO A UTILITY BOAT AND ONE SHERIFF'S BOAT. ", SINCE THE &YENDED MOTION DOES NOT EFFECT THE GENERAL HEALTH AND WELFARE OF THE COMMUNITY. Upon a vote taken, four ayes by Arnold, Loftus, Kedrowski, Roseth, one abstention (Wells); the motion carried. At this time Camnissioner Wells returned to the Commission. ITEM III - PUBLIC HEARING C MMNUATION wTHEF TREES" SUBDIVISI (Rd City Planner Graser commented that he had not received an amended preliminary plat therefore the item should be tabled. MOTION BY KEDROWSKI, SECOND BY ARN(LD M TABLE THE PUBLIC HEARING FOR "THE TREES" SUBDIVISION SINCE STAFF HAS NOT RECEIVED AN AMENDED PRELIMINARY PLAT. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Wells; the motion passed unanimously. ITEM IV - VARIANCE BB2UW $Y ZM&5 gAr.r. The variance will be needed on the side adjacent to Memorial Park to place portable classrooms on the site. This could be a short term solution depending on the bond issue. City Planner Graser commented per memo dated 6/18/87. The Planning Commission commented on the variance request with regard to parking facilities being deleted, delivery trucks access, bond issue with no interest so far, and any alternative sites for portables. ITEM VI - VARIANCE REQUEST BY STEVE UCMELD Steve McDonald, representative for William McDonald, commented that the request is for a 36.5 foot front yard variance for 4377 Quincy Street S.E. to construct a 1500 square foot single family hone. Due to the County taking Tract B of the parcel there is not sufficient roan to build without a variance. City Planner Graser cemented per memo dated 4-2 -87 regarding the 36.5 foot front yard variance next to County Road 21. The applicant is eligible for one building permit for the entire 2.5 acre parcel. The building envelope on the south side of Quincy Street is too restrictive for a hone to be built without variance. There is sufficient property available north of Quincy to build a hane. 3 C.L T'^"'- OF THE PRIOR LAKE YLANN11W, ODMMISSiON APRIL 2, 1987 Residents were opposed to the variance for the following reasons: due to safety factors along County Road 21, location of the hone south of Quincy Street, obstruction of view, setting a variance precedent, and because the structure would be out of alignment with other homes along County Road 21. The Planning Commissioners felt the application should reflect the entire parcel not just the land available south of Quincy Street since the entire parcel is eligible for only one permit. The Commissioners felt that an adequate building envelope was available on the site north of Quincy Street and therefore, there is no justification for a variance. Jack Engberg spoke on behalf of the applicant. He felt the hardship was that the applicant had invested in the property and can no longer build on the parcel without variance due to the taking of land by Scott County. The introduction of sewer and water to the area has prompted the owners to submit development plans. City Planner Graser discussed the Conceptual Plat for North Shore Oaks This plat would came under the old Subdivision Ordinance and Conceptual Plat approval was given by Eagle Creek Township prior to its annexation to Prior Lake. Mr. Graser further carom rated on sewer utilities planned for the area, tree plantings, width of Carriage Hill Road, and the proposed park land. The area designated for park is low land and may not satisfy City park dedication requirements. The developer should give thought to retaining the parcel as a natural wildlife area. Staff recamnends conceptual plat approval. The Planning Comtissioners commented on the grading and filling to be done, the size possibility of creating lots to acccnmodate concerned that many of the proposed lots adjacent subdivisions. AMENDMENT BY TOM STEFFENS WAS CALLED TO ORDE Previous to the meeting at 5:30 P.M. a tour of the proxy_ -rty for this hearing was taken by Staff, Planning Commission, developer, dnd area residents. Greg Halling, Engineer for Rehder Wenzel, and representative for the developer was present to answer questions. City Planner Graser reviewed past action of Priorwood P.U.D. with regard to the history of t.. P.U.D. and original proposal to develop 106 multi family units in a 17.4 acre parcel. The concerns of 5 years ago are similar to todays concerns. They consist of natural limitations of the site, garage space, another need for a plan with detail and good architectural design. Five years ago the Prior lake market favored apartments and condominiums while today's market is for single family hares. Mr. Graser further commented on drainage and creek flowage, the integration of the P.U.D. development with adjacent developed neighborhoods, tot lot area, road design and collector system for safety, grading and filling destruction, flood plain and orientation of units on the property. At this time audience input was called for. The area residents were opposed to the increased density proposed, destruction of natural features, de- valuation of their property, impact of development on the environmentally sensitive area, transition area between single family hones and condos or apartments with a buffer, increased heavy traffic in area if Cates and Five Hawks are connected, erosion and water flaw, and tot lot location a concern for safety. The Planning Commissioners had concerns over the increased density, haw changes from the first P.U.D. request to this amendment affect the density bonuses given, density bonuses should be re- evaluated, tot lot location, destruction of slopes and natural features, developers lack of concern for the environment, amount of buildable area, trails /walkways, aesthetic design, roadway circulation for safety, drainage and water flow, owner occupied or rental, engineering and parks concerns. The Commissioners were concerned that the density the developer is attempting to achieve is in direct conflict with the goals of P.U.D. development as specified in Section 6.11 of the Zoning Ordinance. Assistant City Planner Garross commented per memo dated 3/5/87 with regard to safety onto County Road 81. Also stating that a call from Brad Larson, Scott County Highway Engineer was received. The County would be opposed to this variance request due to the creation of another access point onto County Road 81. Staff was concerned that a safe intersection could not be achieved due to existing topography on the site. The Planning Commissioners commented on the topography of the lot with concern over the steep slope and limited landing space at County Road 81. The Commissioners were concerned that the intersection of the driveway and County Road 81 would cause an unsafe situation for the homeowner and traffic on the County Road. The proposed development framework consists of 2 single family homes which would be located off Roanoke Street, one 12 unit building and six 6 unit buildings on 13 acres in Holly Court for a total density of 50 units. Mr. Balling presented pictures of the building knoll showing the disturbed land and trees already dead from grading. Also the pictures showed the type and style of units in Burnsville which will be incorporated here. Mr. Balling also commented on sidewalk along Five Hawks, additional parking stalls, trash handled by resident, location of development with respect to the 10 year flood plain, and the biggest concern of the tot lot on 1 1/2 acre site. City Planner Graser commented per memo dated 3/3/87 with regard to memo's presented by City Engineer, Larry Anderson and Parks Director, Bill Mangan. Also concern aver the guidelines of a P.U.D. being upheld such as steep slopes, design of units, density, 100 year flood plain, every portion of the development made to be the best place to live, elevations, natural features, mature trees, meeting setbacks, non - buildable low area, and tot lot consideration. At that time it was discovered that the subject site contained less than the 2.5 acres required for a P.U.D.. The applicant is now requesting that the P.U.D. be rezoned to its underlying zoning classification of R-2 Urban Residential. It is his opinion that R-2 zoning would be more marketable and feasible at this time. City Planner Graser commented per memo dated 2/16/87 with regard to rezoning the P.U.D., past action on the rezoning of the site from R-2 to P.U.D. and the building site envelope. A AMM Mr. Alberts commented on his request for an 8' side yard and 4' front yard variance for 14704 Cove Avenue SE. The variance is requested for a garage to be added on the side of the house adjacent to the existing double garage. However, the orientation of the house on the lot makes entrance to the existing garage a hardship for turning. The lot next door bas a timbered retaining wall which is on the property line. The applicant expresses concern that a car may back off of the driveway and cause damage to the adjacent hone. Mr. Robert Hillique cc mwnted that his mother -in -law (Mrs. Bergh) owns the lot north of the subject lot and has no objections to the proposed variance. He further commented that the people did not put the house on the subject lot and perhaps the Commissioners could find a fair alternative to the situation even though ordinance is specific with regard to the conditions that must be present in order to justify granting a variance. The Planning Commissioners discussed the variance and were concerned over the setting of an irreversible precedent even though they understood the situation. The Commissioers discussed the possibility of redesigning the existing garage entrance to allow better access. Greg Halling, Civil Engineer with Rehder Wenzel, 10100 Morgan Avenue South, Bloomington commented that the request is for an amendment to Priorview P.U.D. to include additional density with the annexation of 1.7 acres of Holly Court, therefore creating a total of 148 units. The proposal is to construct rental units with single car garages and 1 outside parking spot. In Greg Halling's opinion, the P.U.D. -could be built in the 100 year flood plain provided contours be trimmed down and drainage work be under taken. The wetland area could be controlled with a dam and pipes such as a 42" culvert. The developer has met with area neighbors and will respect their requests for a privacy fence north of Five Hawks. Access onto Highway 13 will be improved with the completion of Five Hawks with access thru Holly Court. City Planner Graser commented per memo dated 2 /4/87 with regard to the history of the Priorview P.U.D. Staff felt that annexation of Holly Court would make good planning and economic sense. However, the developer has not demonstrated goad reason to change the Zoning or Comp Plan. The slope and hillside would require a great deal of grading and filling. The northerly unit is almost 1008 in the 100 year flood elevation. The topographical data is not accurate and the tot lot as sham in the flood plain is 12 feet lower than the road. The density clearly exceeds the carrying capacity of this node. The creek bed would most likely be disturbed if construction activity was done. The site cannot, in staff's opinnicn, accommodate an R-3 density in its current state. The proposed architectural style of the buildings are much more pleasant than larger apartment type construction and they would relate munch better to smaller adjacent homes. The residents were opposed to the Amendment to increase the density of the P.U.D.. They were also concerned with emniromental issues associated with the site such as- 1.) The cite being able to handle a 100 year flood. 2.) A part of the wand area being a state conservation area. 3.) Questions whether the appropriate authorities such as DNR had been notified of the proposed Amendment. 4.) The wetland area holds wildlife habitat that should be preserved. Residents were also concerned that higher density development would increase traffic flow by the elementary school which would result in safety concerns for children walking. Residents felt that increased density coupled with rental units would lead to an increase of crime, debris, trash, and carelessness of transit people in their neighborhood. Chairman Loftus read a letter from Mr. & Mrs. Gene Erickson, area residents opposing the request, Exhibit "A ". He also felt that density credits should be given for dam work which is expensive to the developer. The new design for the units is an asset to the area. The minimum lot size requirement in this district is 15,000 square feet. Lot 15 is approximately 13,000 square feet therefore a variance would be needed in order to build the well house. The well house has been designed by staff to assimilate into the single family neighborhood. Maintenance staff would visit the well house to check the Pump on a daily basis. Lawn care would be provided by a lawn care service or by contracting with neighbors. The Planning Commissioners discussed several aspects of the proposal including the exterior siding and roofing materials to be used, number of windows in the well house, need for a skylight, site location and public notification of the proposal. The Commissioners were concerned about possible vandalism to the structure and discussed options such as reduction of the number of windows, use of a metal entrance door rather than a door with a window and incorporation of security locks and lighting into the design plan.
