SOX 359 PRIOR LAKE, MINNESOTA SSSM CITY OF PRIOR LAKE PLANNING ODMMISSION MINUrE4 OCPOBER 15, 1987 The Planning Commission was called to order on October 15, 1987 at 5:30 P.M. to tour various development projects in the City of Prior Lake and finishing the tour at City Ball for the regular scheduled meeting at 7 :30 P.M. Present was Commissioner Kedrowski, City Planner Graser, and Assistant City Planner Garross. Absent were Commissioners Arnold, Loftus, Roseth and Fells. The regular scheduled October 15, 1987 Prior Lake Planning Co®ission meeting was called to order at 7:35 P.M. by Chairman Roseth. Upon a vote taken, ayes by Arnold, Kedrowaki, Loftus, Roseth, wells; the motion passed unanimously. At this time, Commissioner Fells stepped down from the Commission due to association with the following item. ITE4 II - y/L imm AMEDAw RB3UESf BY JERRY YODN^, Jerry Young, watersedge Marina owner, commented that the initial variance was for sailboat retail business only. However, due to economics the sailboat business is in a slump. Therefore, due to this hardship, he is requesting that the stipulation on the type of boats to enter and dock in Boldins Manor Bay be charged to include power boats. This year the low water in the bay and channel have caused some problems and power boats help create movement of the water for sailboats to move. SOX 359 PRIOR LAKE, MINNESOTA 56972 MINUTES OF THE PRIOR LAKE PLANNING ODMMISSION OCTOBER 15, 1987 Area residents commented on the shallow water in the bay, weed problems for boats, docking of additional boats, cluttering the bay with boats, maintenance of the approach to the marina, lighting in the area, security, control of the gate, and liability on part arced by condominium. Mr. Young commented that he would be willing to work with the people on concerns. The Planning Commissioners discussed the concerns and comments. MOTION BY LOFTUS, SECOND BY KEDROWSKI TO APPROVE THE VARIANCE AMENDMENT REQUEST FOR 6885 BODDIN STREET, BY JERRY YOUNG TO ELIMIMTE FROM THE ORGINIAL VARIANCE "ITEM i 4. POWER BOAT USE SHALL BE LIMITED TO A UTILITY BOAT AND ONE SHERIFF'S BOAT. ", SINCE THE AMENDED MOTION DOES NOT EFFECT THE GENERAL HEALTH AND WELFARE OF THE COMMUNITY. Upon a vote taken, four ayes by Arnold, Loftus, Kedrowski, Roseth, one abstention (Mlls)s the motion carried. At this time Camissioner Wells returned to the Commission. ITEM III - PUBLIC ME= CDNTIMNAMOM - THE TRESS" SUBDIVISION City Planner Graser commenter] that he had not received an amended preliminary plat therefore the item should be tabled. Upon a vote taken, ayes by Arnold, Kedrewski, Loftus, Roseth, We11si the motion passed unanimously. ITEM IV - VARIANCE REQUEST BY CHA14M BALL Mr. Hall egmoented that he needs a lakeside variance to build an addition onto his V shaped hose at 3486 Sycamore Trail. City Planner Graser commented per memo dated October 15, 1987. Gene White, 3371 Sycamore Trail, was in favor of the variance request. The Planning Commission discussed the request. MOTION BY WELLS, SECOND BY KEDROWSKI TO APPROVE A 10 FOOT LAREB M VARIANCE FOR 3486 SYCAMORE TRAM S.W. FOR AN ADDITION SDKE IT WILL ONLY EMM THREE FEET CLOSER TO THE LAKE THAN THE EXISTING HOME AND WILL NOT DIMnaEH PROPERTY VALUES IN THE NEIGHHOFBOCD NOR BE DETRIMWAL TO THE GENERAL BBALTH AND WELFARE OF THE COMMUNITY. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth, Me1181 the motion passed unanimously. At this time a 15 minute recess was called. The meeting resumed at 9:00 P.M. 2 MINUTES OF THE PRIOR LAKE PLANNING COMMISSION OCTOBER 15, 1987 ITEM V - VARIANCE RBDLM BY AL 0205 Al Otos camnented that due to the old county right of way property lines the lot is unbuildable unless granted a variance and this is a lot of record. Assistant City Planner Garross cam anted per memo dated October 15, 1987. The Planning Cmmnissioners commented whether the county had responded to this request and if the area residents were notified. Assistant City Planner Garross camented that the County had not responded when notified 2 weeks ago and that the area residents were notified. MOTION BY IEDROWSKI TO APPROVE A 33 FOOr VARIANCE FROM COUNTY ROAD 21 RIGHT OF WAY FOR 16111 LAKESIDE AVENUE SINCE THE HARDSHIP IS DUE TO THE IRIIEGU AR SHAPE OF THE LOT AND EaSTIID SETBACK REQUIREMENTS WHICH SEVERMY LIMIT THE BUILDING AREA AVAILABLE FOR THIS SITE AND THE VARIANCE WOULD NOT ALTER THE CHARACTER OF THE NEIGHBOE40M NOR BE DETRIMENTAL TO THE HEALTH, WELFARE AND PROPERTY VALUES OF THE AREA, SEOONDED BY ARNOLD. Upon a vote taken, ayes by Arnold, Kedrwski, Loftus, Roseth, Wells; the motion passed unanimously. At this time a 15 minute recess was called. The meeting resumed at 9:30 P.M. City Planner Graser consented per memo dated October 15, 1987. The Planning Counissioners had no problem with the request. Present were Commissioners Arnold, Kedrwski, Loftus, City Planner Grazer and Assistant City Planner Garross. Absent was Commissioner wells. FOR •THE 1REF5" PRI7.iMIIARY PLAT FAS CALL® YO QimER Denny Fitzgerald, 15060 Fish Point Road, developer commented on the plat with regard to down sizing the lots from 10 to 9, a pond on the lot donated to the city, a trail path on the 10th lot, and due to taxes the developer cannot afford to keep the lots and requests preliminary plat approval. City Planner Grazer co mented per memo dated September 29, 1987, and also stated that City Parks Director, Bill Mangan rejected the park fee of the pad donation since this is not the type of pad for a park. In this case, cash in lieu of land for this plat would be required. City Planner Grazer presented a plan utilizing Omega Trail for lot plans. At this time audience input was called for. The area residents had concerns over the high density causing traffic problems and safety, steep grades off lots on Fish Point Road for drainage and driveways, preserving the natural area, compatibility of the proposed hones to the area, and development cost of Omega Trail. BOK 359 PRIOR LAKE, MINNESOTA 55372 MINUTES OF THE PRIOR LAKE PLANNING COMMISSION OCTOBER 1, 1987 The Planning Commissioners discussed the proposal and felt the concerns over the density, grading, traffic, park dedication, lot size, and access should be discussed by the developer and City Planner Graser. MX70N BY ARNOLD TO OOHTINOE THE PUBLIC HEARING FOR "THE TREES" PRELIMINARY PLAT TO OCTOBER 15, 1987 AT 8:00 P.M., SECONDED BY KEDRCWSKI. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus, Roseth; the motion passed unanimously. *The tape of this public hearing will be kept on file in the office of the City Planner as official record. A two minute recess was called at this time. The meeting resumed at 8:34 P.M. At this time, Chairman Roseth stepped dawn from the chair due to personal association with the parties involved in the next item. Mr. Rygajlo commented that the plot plan has changed with regard to setback of the house 16' fran the neighbor property, straight driveway with turnaround and retaining wall reconstructed by him. City Planner Graser commented per memo dated September 29, 1987, and also presented a map showing drainage and setbacks. The area residents reviewed the map and shamed concern over the drainage and runoff from another structure on this block. The Planning Commissioners discussed the variance request and felt the resident's concerns should be addressed to the City Engineer. City Planner Graser stated he would draft a memo to Engineering and the City Manager regarding drainage concerns of residents on Green Oaks Trail. MOTION BY ARNOLD TO APPROVE A 25 Poor FROM YARD VARIANCE FROM HIGHNAY 13 FOR 15230 GREEN OAKS TRAIL TO CONSTRUCT' A NW HOME BUSSED ON THE FACT THE APPLICANT NOT CRITERIA OF STAFF ARID ammssim sB4omm BY EBDRacm. Upon a vote taken, ayes by Arnold, Kedrowski, Loftus: one abstention Roseth; the motion carried. Chairmen Roseth returned to the chair at 9:15 P.M. ITEM IV - HAS C1TNQr IONAL USE PERRQT AMF290 Dave Darrell, representative, stated that due to financial epics the automatic car wash bay is not feasible at this time and they would like to charge from 4 self service and 1 automatic bays to 6 self service car wash bays. Steve Towle, owner, asked if a lighting plan for the entire area could be coordinated with T.F. James Company and them for consistency. City Planner Graser commented per memo dated September 25, 1987 and also stated that he would coordinate the lighting plan. 2 MINU OF THE PRIOR LAKE PLANNING COMMISSION OCTOBER 1, 1987 MOTION BY KEDRUASKI, SECOND BY ARNOLD TO APPROVE THE SAS CONDITIONAL USE PERMIT AMENDMENT CONTINGENT UPON THE FOLLOWING: 1. Commissioner Loftus excused himself from the Commission at 9:35 P.M. due to an early morning conflict. ITEM y - NOR'19 SH(Lar OARS 5TH ADDITIQ7 HARffiBH.L AM@11m�1P Gene Simpkins, developer, commented that there was a misunderstanding under the original approval regarding the Developer's Agreement and platting the entire property. The Developer's Agreement would require $40,000 before the lots were sold, therefore causing a hardship. At this time they are requesting that 11 lots go into Outlots A, B, and C when Fisher Avenue goes in. City Planner Graser cemented per memo dated October 1, 1987. Upon a vote taken, ayes by Arnold, 6edrowski, Loftus, Roseth; the motion passed unanimously. At this time the Commissioners discussed the idea of an early meeting October 15th to tour the development projects in Prior rake.
