CaII to Order: Chairman Phelan called the February 4, 2013 Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Blahnik, Phelan, Roszak, Spieler, Community and Economic Development Director Dan Rogness, and City Engineer Larry Poppler. 2. Approval of Agenda: MOTION BY PHELAN, SECONDED BY SPIELER TO APPROVE THE FEBRUARY 4, 2013 MEETING AGENDA AS PRESENTED. VOTE: Ayes, Blahnik, Phelan, Roszak and Spieler. The Motion carried. 3. Consider Approval of January 22, 2013 Meeting Minutes: MOTION BY SPIELER, SECONDED BY BLAHNIK TO APPROVE THE JANUARY 22, 2012 MEETING MINUTES. VOTE: Ayes, Blahnik, Phelan, Roszak and Spieler. The Motion carried. 4. Public Hearings: A. EP# 12 -127 Maple Glen 5th Addition Preliminary Plat. D.R. Horton Inc. is proposing a residential subdivision consisting of 26 single family Tots. The subject property is located in the southwest corner of the City of Prior Lake, south of Highway 13 on Sunray Boulevard, and north of 180th Street. Director Rogness presented that DR Horton Inc. has submitted a request for approval of a Preliminary Plat to be known as Maple Glen 5 Addition. The property is located on a 12.78 acre site, south of Trunk Highway 13, north of 180 Street, and west of Wedgewood Lane. The development plan calls for a residential development consisting of 26 single family homes. The property was originally platted under Maple Glen 4 Addition. The developer decided to split up the phasing of Maple Glen 4 to address safety and grading concerns of Sunray's intersection with 180 Street. The preliminary plat now adjusts Sunray Blvd to better align with 180 Street. Engineer Poppler reviewed the infrastructure of the project. The amount of traffic using 180 street is minimal, but it is crucial to allow another access to the Maple Glen development, which allows emergency vehicles to access the site easily. Applicant Mike Suel of D.R. Horton Homes stated that they are both the developer and builder for Maple Glen and Hickory Shores, and they are here for any questions or comments on the development. 1 Commissioner Comments: Spieler asked about water runoff in the back yards; what has been done to address this? Applicant Suel responded that they have eliminated as much runoff as possible; their plans reduced overall runoff from 5 acres to 1 acre. Spieler expressed concern about the safety of Sunray Blvd connecting to 180 Street. Applicant Suel stated that they have moved the connection closer to the high point on 180 Street, dropping the high point about 2 feet. Blahnik asked whether they have addressed any additional runoff leaving the site? Applicant Suel responded that all of the models put together have not shown any additional runoff leaving the site; it will be treated on site. MOTION BY PHELAN SECOND BY SPIELER TO OPEN THE PUBLIC HEARING AT 6:21 PM VOTE: Ayes, Blahnik, Phelan, Roszak and Spieler Nate Evans (3372 Reed Way) asked whether there any plans for parks? Since Maple Glen is almost complete, there has not been any talk of parks. Is Turner Street going to connect to Sunray Blvd? Engineer Poppler responded that the space between Turner Drive and Sunray Blvd is the key to getting the park in place and finally connecting the streets. That piece has not developed yet which puts both those projects on hold at this time. Phelan asked about timelines for these projects? Engineer Poppler stated that they are dependent on when development takes place in that area. Nate Evans reiterated that the park should happen soon; the neighborhood has been waiting a long time with many kids in the area. Jerry Magnin stated that he lives south of 180 on Yorkshire; he asked how the lowering of 180 affects Yorkshire? Engineer Poppler responded that with 180 coming down in grade, Yorkshire will also be brought down; it will still have a nice grade for a road though. Kelly Lenard (3435 Reed Way) stated that their house was shaking with the previous excavation; what are the procedures to address these concerns? Phelan said to contact staff with any of those issues. 2 Wade Waddell (18301 Country Squares Cir) stated that each time it rains, a pond is formed south of 180 and the southeast portion of his property. Over time, that pond continues to grow, so he is concerned with the additional water feeding into the low area. The culvert under 180 Street is becoming washed out and not allowing the water to drain properly. Engineer Poppler stated that the property is within Spring Lake Township, and it is under a county road. Phelan stated the Commission will take note and comment on the concerns of the additional storm water; however, since the property is outside city limits, discussion should occur with the township. Sean Schemmel (3321 Griggs St.) presented concerns of the neighborhood, the timing of the trails and the park. If the connection to 180 could go in first, that would help with the construction traffic on Sunray. Tim Kvidera (17776 Wedgewood Lane) stated that he lives along the east side of Sunray Blvd. He appreciated the trees to be planted between his property and asked when the landscaping plan will be established and implemented? Barbra Johnson (3450 180 St.) asked about the strip of land about 10 feet wide along the east side of Sunray Blvd.; who will own and maintain that property? Director Rogness responded that it is part of the public right -of -way of Sunray Blvd. Typically, adjacent property owners maintain this type of landscaped area, but the adjacent property is within the township. Barbra Johnson stated her other concerns were with 180 being cut down, and how that will affect her driveway. She also asked how the township feels about increased construction traffic on 180 Street? She asked whether the city owns to the middle of 180 Street? Director Rogness responded that the city's jurisdiction goes to the middle of the road as a result of annexation. MOTION BY PHELAN, SECONDED BY SPIELER TO CLOSE THE PUBLIC HEARING AT 6:44 PM. VOTE: Ayes, Blahnik, Spieler, Roszak and Phelan. Commissioner Questions and Comments: Roszak asked who owns and maintains the right -of -way? Engineering Poppler responded that typically the adjacent property owner maintains the right -of -way. Since that piece along Sunray is adjacent to property not in the city, it may be planted with a short prairie grass. Spieler wondered whether the HOA in the area could maintain that piece of land? 3 Rogness responded that is an option that the city could evaluate, but ultimately, the city is in charge of maintaining the property. Phelan asked about the section across from James Court; will there be a curb cut there for a future connection? Engineer Poppler responded that there is not a current development plan for that area. During staff's initial review, it made sense for the cut to be in that location as a future connection to Wedgewood Lane. Spieler asked about the landscaping along 180 for visibility; he also thinks it is odd that there are five phases to this development, still without a developed park. Engineer Poppler responded that the park has not been developed since the best location for a playground was previously identified in the undeveloped "Golden Pond" property. Since development slowed in 2007, the park has been delayed. Phelan asked whether park funds were escrowed for previous Maple Glen phases? Rogness summarized the city's requirement that 10 percent of the net land area is set aside for park; if the 10 percent is not fully allocated, then funds are set aside. Phelan asked why there cannot be at least a start to a park if funds have been set aside? It does not appear to be fair to the homeowners of the first additions to have to wait or at least not know when the park is planned. Blahnik asked about trails in the area? Engineer Poppler responded that sidewalks and trails are now on both sides of Sunray Blvd; there is also a sidewalk on Turner that will eventually Zink through the adjacent Golden Pond property to Hickory Shores. Blahnik asked staff to address the comment on the timing of connecting 180 to Sunray? Engineer Poppler believes that will be done all at once, but staff will work on further details during the final plat process. Phelan asked who will bear the cost of replacing the driveways and culverts located in the township with the grading of 180 Street? Director Rogness responded that there is an agreement between the township and D.R. Horton on the payments for the incurred costs to be paid by the developer. Phelan asked about the city's policy for handling homeowner impacts from construction activity. Engineer Poppler responded that the contractor and developer have insurance to cover any necessary damages. 4 Phelan asked whether there has been a traffic study on 180 Street. Engineer Poppler did not have a copy of a previous traffic study, but a recent traffic count revealed about 153 cars per day. Phelan asked about reducing speeds on 180 Director Rogness responded that the township has decided not to post reduced speeds in that area due to the lower density of housing. Phelan stated his support for the project, but he wanted clarification on how the strip of right - of -way will be maintained, as well as attention to develop the park space. He also wanted to reiterate that the storm water plan must be finalized before final plat. Spieler said overall, the project looks good; it flows well with the Fourth Addition, and the connection to 180 looks good. The issues that were discussed tonight should be resolved before final plat. Blahnik stated his support for the project, although he would like to see a park completed sooner than later. Roszak stated support for the project; the developer has addressed the major concerns, and it is consistent with the goals and objectives of the Comprehensive Plan. Phelan proposed an amendment to the motion that the city will have maintenance of the strip of land within the right -of -way of Sunray, and that all storm water issues be resolved prior to the final plat. MOTION BY PHELAN, SECONDED BY BLAHNIK TO RECOMMEND APPROVAL OF THE PRELIMINARY PLAT TO BE KNOWN AS MAPLE GLEN 5 ADDITION WITH CONDITIONS THAT THE STORMWATER ISSUES BE RESOLVED AND THAT THE CITY WILL BE RESPONSIBLE TO MAINTAIN THE STRIP OF LAND ALONG SUNRAY BLVD AT THE SOUTHEAST PORTION OF THE PROPERTY. Hovnanian Homes and on a piece of property the City is acquiring for 5 the Welcome Avenue public improvement project, both from the January 28 City Council meeting. 8.
