The July 31, 1986 Prior Lake Planning Commission meeting was called to order by
Chairman Larson at 7:32 P.M. Present were Commissioners Loftus, Arnold, City
Planner Graser and Assistant Planner Garross. Absent were Commissioners Wells
and Roseth.
MOTION BY ARNOLD TO APPROVE THE JULY 17, 1986 PLANNING ODM41SSION MINUTES AS
PRESENTED, SECONDED BY LOFIUS. UPON A VOTE TN M, THE MOTION WAS DULY PASSED.
Item I, Public Hearing to consider a rezoning request for Willows 6th Addition
was called to order.
Greg Balling, Engineer for K s S Development was present to answer questions.
Mr. Balling camnented briefly on the request.
City Planner Graser commented per memo dated July 28, 1986.
Ton Schneider, 16840 Elm Street, questioned the procedure involved with regard
to the timing and sequence of events for rezoning and coaprehensive plan
amendments.
William Brasted, Inguadona Beach, had questions with regard to C -1, Conservation
Districts and Inguadona Beach Circle.
The Planning Commissioners discussed the proposed density of development,
traffic flow, and the proximity of the holding pond to the C -1 District.
Concern was also expressed regarding the proposed future development of the
property located directly to the east of the Willows 6th Plat.
MOTION BY LOPTUS TO APPROVE THE RHQUEST'ED REZCNINGS AS PUBLISHED, FOR THE
PiELIMnVW PLAT OF WILLOWS 6TH ADDITION. THE REZONINGS WERE GRANTED ON THE
BASIS THAT THEY ARE SUBSTANTIALLY CONSISTENT WITH THE ODMFRNHENEIVE PLAN ADD
THAT THE PROPOSED CHANGES WOULD NOT HAVE A DETRIMENTAL AFFECT ON THE CITY'S
UTILITY SYSTEM. SECONDED BY ATMD, UPON A VOTE TAKEN, THE MOTION WAS DULY
PASSED.
MOTION BY ARIM TO CLOSE THE PUBLIC HEARING FOR REZONING OF THE WILLOWS 6TH
ADDITION, SECONDED BY LOFIUS. UPON A VOTE TARN, THE MOTION WAS DULY PASSED.

The July 17, 1986 Prior Lake Planning Commission meeting was called to order by
Vice Chairman Loftus at 7:40 P.M. Present were Commissioners Rosette, Wells,
City Planner Graser and Planning Assistant Garross. Absent were Commissioners
Arnold and Larson.

Item II, Staff Discussion and Update. City Planner Graser commented on the
special Planning Commission meeting scheduled for July 31, progress regarding
the proposed Health Care Center for Prior Lake, MBewakanton Sioux Comprehensive
Plan, scheduling of the Planning Commission retreat, shoreland management
ordinance and progress achieved on the Bob Brawn P.O.D.
At this time a 10 minute recess was called.
The meeting resumed at 8:00 P.M.
Item III, Public Hearing continuation to consider an amendment to the
Comprehensive Plan for Raspberry Ridge, was called to order.
Bob Walsh, developer, Greg Kopischke, Westwood Planning, Leonard Brooks, owner,
Mike Olson, Attorney and John Gerten were present to answer questions.
City Planner Graser cemented per memo dated 7/17 /86 which addressed the
concerns raised in "Manitou Drive Citizens' Response to Raspberry Ridge ".
Norbert Traxler, attorney for the area residents opposed to Raspberry Ridge,
commented that any Public Hearing to consider rewording the Camp Plan and Storm
Water Management Plan should be held prior to granting a Camp Plan amendment for
the plat of Raspberry Ridge.
Noreen Baillif, 14897 Manitou Road, cemented that the Planning Omnission felt
it important that the Mdewakanton Indian Cammuity develop a comprehensive plan.
She questioned why a comp plan was important for the Indians but did not appear
to be important with regard to Raspberry Ridge.
Kathleen Jobst, 15110 Martinson Island, questioned whether wetlands could be
built upon.

Kathy Abrams, 14 877 Manitou Road, stated that a copy of the Raspberry Ride
proposal had been submitted to the Metro Council. She further commented that
the response from the Met Council was that they would not recommend FBA
financing because the conservation areas were not being preserved as indicated
in the City Comp Plan.
Norbert Traxler, Attorney, felt the public should be notified of the policy
changes being recommended by staff with regards to the Camp Plan, Storm Water
Management Plan and Zoning Ordinance.
The Planning Camnissioners discussed procedure and the appropriate steps that
should be taken in order to amend the Capp Plan and Storm Water Management
Plan.
Mary Gilbert, Chatonka Beach, CCMmented that because the City did not follow
proper procedure in the past, she is currently involved in a litigation case.
Greg Kopischke, Westwood Planning, commented that the developer was seeking
approval from the Planning Commission to grant the necessary Capp Plan
amendments. He further stated that the requests of the City Council, Planning
Commission and Staff had been complied with in regards to the Raspberry Ridge
Plat.

Item IV, Variance request for Dean and Marie Jansen. The application requested
that Lot 84 Northwood Addition, be split into 2 equal halves. Dean Jansen,
owner and James Patrick Leavitt, attorney, were present to answer questions.
Attorney Leavitt commented that the applicant owns a deep lot with an easement
road which bisects the parcel near the center of the lot. The lakeward portion
of the lot is flat and in his opinion is suitable for a second building site.
City Planner Graser commented per memo dated 7/17/86.
Andy Pelecis, abutting neighbor to the north favored the lot split however he
would be opposed to the construction of a through road.
John Sweeney, Lot 87 owner, had no objection to the lot split.
Jerry Holden, owner of lot to south, had no objection to the lot split. He
would object to through traffic being allowed into the area.
The Planning Commissioners were concerned over setting a precedent to allow
substandard lots to be split, and the problem of inadequate access to the
lakeward portion of the property.

The July 2, 1986 Prior Lake Planning Camnission meeting was called to order by
Chairman Larson at 7:30 P.M. Present were Camaissioners Arnold, Loftus, Rosh,
Wells, City Attorney Glenn Kessel, City Planner Graser and Planning Intern Deb
Garross.

MOTION BY LARSON TO DENY THE REQUEST FOR 6 FOOT MW YARD VARIANCE FOR
14173 COMMERCE AVENUE N.E. DUE TO LACK OF A DEMONSTRATED HARDSHIP AND THAT
LIGHTING MAY ILLUMINATE WMRD INTO THE BMW AND OTHER PROFOMES,
SECONDED BY AIMD. UPON A VOTE TARN, 2 AYES (IARSON & ARNOLD), 3 NAYS
(LCFRUS, WELLS, ROSETH) THE MOTION DID NOT PASS.
Item II, Comprehensive Plan Amendment Hearing was called to order. The purpose
of the hearing was to consider a petition by the Miewakanton Sioux Community
(MSC) to amend the Prior Lake Comprehensive Plan. Bill Block, Consulting
Engineer, and Ron Robinette were present to answer questions.
Mr. Block cemented that the MSC was requesting that the City of Prior Lake
extend sewer and water service to the Reservation.
City Planner Graser cmmented per memo dated June 26, 1986.
Mark Svensky, resident of Prior Lake inquired about capacity of the serer main,
proposed location for the installation of the utilities with respect to County
Road 83, future improvements planned for County Road 83, and possible
development trends projected for the land area located adjacent to the trunk
sewer and watenmain.
Barb Sennes cammented that County Road 83 would be upgraded but not blacktopped.
Barb Kohout, County Road 83 resident, questioned whether residents would be
allowed to receive sewer and water service from the T:- nposed extension.

Mr. Cemensky caimiented that no rules exist for governing development on the
Reservation.
Pat Paul, Metro Council Representative, commented that the Planning Commission
should view this issue as a unique situation and circumstance. She also
commented on the other agencies involved with this matter. She stated that
approval from the Planning Commission was required at this time in order to
allow the MSC to meet their deadlines.
Barb Sennes, Metro Planning, commented that the Metro Council Staff felt that
plans submitted by the MSC contained sufficient information concerning the
development proposed for the Reservation.
City Attorney Kessel, commented that proper permits must be signed by
authoritative groups.
The Planning Commissioners had concerns regarding maintenance of the utilities,
the impacts that the amendment would have on the City of Prior lake, whether
proper permits had been acquired and the precedent that might be set by
approving the amendment without more detailed documentation and information from
the petitioner.
MOTION BY LARSON TO TABLE THIS ITEM FOR 2 WEEKS OR TO A DATE AGREEABLE BY STAFF
AMID APPLICANT. THE PURPOSE FOR CONTINUATION WOAD BE TO ALLOW THE MSC TIME TO
PREPARE MORE DETAILED DOCN?22MION SUCH AS:
1. CAPITOL, IMPROVEIEDS PLAN
2. COMPREHENSIVE PLAN FOR ENTIRE RESERVATION (INCLUDE ZONING, INDUSTRIAL &
COMMERCIAL, AND LAND USE SCHEME).
3. CONTRACTUAL AGREE MW BETWEEN CITY AND ALL GOVERNMENT AGENCIES (INDIAN
AFFAIRS, NEW COUNCIL, ETC.).
4. A FIRM STATEMENT PROM THE METRO COUNCIL REGAIDING SEWER ALLOCATION AMID
HOW THE CITY AND THE PIWERVATION WOULD BE APFECEID BY THE AMEDM4M.
5. DOCUMENTATION THAT NECESSARY PERMITS HAVE BEEN APPROVED
SEOOMDID BY ATMD. UPON A VOTE TAKEN, 2 AYES (LARSON & ARNOLD), 3 NAYS
(LOFTUS, WELLS, ROSETH). THE MOTION DID NOT PASS.
MOTION BY LOFTUS TO GIVE APPROVAL FOR AN AMENDMENT TO PAGE 10 OF THE
COMPREHENSIVE PLAN WHICH WOULD INCORPORATE THE POLLOWIN3 POINTS:
EXTENDING TRUNK SEWER AND WATER M THE RESERVATION FOR THE 120 ACRES AS
PER ATTACHED MAP. ANY ADDITIONAL RESERVATION IAN) RBCEIVING SERVICE
WILL REQUIRE AN AMENDMENT HEARING.
2. THAT SUCH UTILITY SERVICE WILL BE IN THE BEST IlNTEREST OF THE MSC BY
PROVIDING FOR ADDITIONAL DOMMENT OPPORTUNITIES, MORE AND BETTER
HOUSING AND INCREASE THE GENERAL QUALITY OF LIFE ON THE RESERVATION.
3. THAT 120 ACRES (PER EXHIBIT "A") BE RECOGNIZED AS TRIBUTARY TO THE
TRUNK SEWER WITH NO OVERSIZING RBQUIRBD.
4. THE MMWO.ITAN CNUWIL RECOGNIZE THE RESERVATION FLOW AS A SEPARATE
ITEM WITH A SEPARATE ALLOCATION WITH METERING.
A MAINTENANCE AGREEMENT ESTABLISHED AND PRIOR LAKE ACCEPT BOTH TRUNKS
ONCE INSTALLED AND MAINTAIN THE SYSTEM. ALL UNUSED SEWER CAPACITY
SHALL BELONG TO PRIOR LAKE UNLESS A COMPREHENSIVE PLAN IS SOBMITTFA
IDENTIFYING FUTURE LAND USE.
THE MSC DEVELOP A 5 YEAR CAPITAL IMPROVEMENT PROGRAM AND A LONG RANGE
DEVELOPMENT GUIDE FRAME TO HEAD OFF ANY FUTURE POTENTIAL CONFLICTS WITH
RESPECT TO LAND USE AND URBAN SERVICES ACCEPTABLE TO STAFF.
RECOMMENDATION TO CITY ODUNCM OF PRIOR LAKE TO ENTER INTO A CONTRACT
AS TO WHO HAS WHAT RESPONSIBILITY WITH RESPECT TO ANY FEES FOR
UTILITIES, INSPECTIONS AND ACCESS CHARGES.
APPROVAL OF THE AMENDMENT IS GRANTED ON THE BASIS THAT THIS IS A UNIQUE
SITUATION AND CIRCUMSTANCE. MOTION SECONDED BY ROSETH. UPON A VOTE TAKEN, 4
AYE (LOFTUS, ROISETH, WELLS, ARNOLD), 1 NAY (LARSON) LACK OF SUFFICIENT
INFORMATION ON WHICH TO BASE A DECISION. THE MUTTON CARRIED.

SECONDED BY ARNOLD. UPON A VOTE TAKEN, THE MOTION WAS DULY PASSED.

Item III, Public Hearing in order to consider a Omprehensive Plan Ame anent for
Raspberry Ridge Subdivision was called to order. Bob Walsh, developer, was
present to answer questions.
City Planner Graser commented per memo dated June 30, 1986.
Norbert Traxler, Attorney, presented a document 'Manitou Drive Citizen's
Response to Raspberry Ridge Development Plan and Rezoning ', Exhibit W. The
document outlined several concerns about the procedural process involved with
the preliminary plat approval for Raspberry Ridge.
Norene Mae, 14957 Manitou Road, explained that a State Archaeologist would
investigate the 5 Indian Mounds locate] along Mamtou Road and that the lard
should not be disturbed until the archaeological review has been cowleted.
Bob Walsh camented that his Archaeologist felt there were no Indian
Mounds however he would check back with the archaeologist.
The Planning Commissioners had concern over the points raised by the residents
in document "Exhibit A.' They also expressed desire to continue this matter to
a future date in order to allow adequate time to review the docu ent.
MOTION BY ROSERH TO CONTINUE THE PUBLIC HEARING FOR RASPBERRY RIDGE TO JULY 17,
1986 AT 8:00 P.M. THE ITEM WAS CONTINUED IN ORDER TO ALLOW THE COMMISSION AND
STAFF TIME TO RMM AND COMM ON THE INPM TICK PRESENTED. SECONDED BY
ARNOLD. UPON A VOTE TAKEN, THE M71'ION WAS DULY PASSED.

WELLS. UPON A VOTE TAKEN, THE MOTION WAS DULY PASSED.
Item IV, Variance Request for Beverly Mechtel. The application requested a 17
foot lakeshore variance for 16558 Inguadona Beach Circle SW. Betty Mechtel was
present to answer questions.
City Planning Intern Deb Garross commented per memo dated June 27, 1986. At
this time a letter from abutting property owners, Ken & Evelyn Falkum, 16568
Lnguadona Beach Circle, was presented to the Commission. Also, a phone call from
Joy Meyer, 16548 Inguadona Beach Circle, was eceived by Garross. Both the
letter and phone call expressed no objection :.o the variance request.
MOTION BY ARNOLD TO APPROVE A 17 FOOT LAKESHORE VARIANCE FOR 16558 INGLA(DONA
BEACH CIRCLE SW, SINCE IT IS CONSISTENT WITH EXISTING DEVELOPMENT AND NOT
OONTRARY TO THE PUBLIC INTEREST OR DETRIMENTAL TO THE HEALTH AND WELFARE OR
PROPERTY VALUES OF THE GOM4LNITY, SECONDED BY WELLS. UPON A VOTE TAKEN, THE
MOTION WAS DULY PASSED.
Item V, Variance Continuation for Jerry Mahoney. The application requested a 15
foot front yard variance for 14270 Glendale Avenue.
Jerry Mahoney commented that he was willing to reduce the size of the garage
from 20 to 15 feet in order to increase the distance between Oakland Beach
Avenue and the garage. The applicant is not willing to move the garage per
staff's recommendation because a tree would be lost and the view from the
neighboring properties would be impaired.
Planning Intern Garross commented on the request per memo dated June 19, 1986
and stated for the record that she had received a phone call from Betty Weiland
in support of the Mahoney proposal. Letters from Judith and John Huck, Pat
Bergren and Betty Reemes who were all in support of the Mahoney variance were
also submitted to the Commission.
The Planning Camnissioners felt that a hardship was involved in this case
however they were concerned that if the variance were to be approved a precedent
would be set which would allow development into the front yard setback. A
precedent such as this would be contrary to the public interest.
MOTION BY LOFTUS TO GRANT A 9 FOOT VARIANCE POE 14720 GLENDALE AVENUE. A
VARIANCE WOULD NOT BE DETRIMENTAL TO THE NEIGH MUM SINCE FEW HOUSES WOULD BE
DEVELOPED ALONG THE DEAD END STREET OR IN 'IDE C-1 DISTRICT LOCATED TO THE WEST
OF THE SUBJECT PROPERTY. THE MOTION FAILED DOE TO LMT( OF A SECOND.
MOTION BY ARNOLD TO DENY A 9 FOOT VARIANCE FOR 14720 GLENDALE AVENUE PER AMENDED
RMUEST BECAUSE OF THE PRECEDENT THAT WOULD BE SET, SECONDED BY LARSON. UPON A

The Planning Ccumiissioners discussed procedure and the appropriate steps that
should be taken in order to amend the Camp Plan and Storm Water Management
Plan.
Mary Gilbert, Chatonka Beach, commented that because the City did not follow
proper procedure in the past, she is currently involved in a litigation case.
Greg Kopischke, Westwood Pla =wingt commented that the developer was seeking
approval from the Planning Commission to grant the necessary Comp Plan
amendments. He further stated that the requests of the City Council, Planning
Commission and Staff had been complied with in regards to the Raspberry Ridge
Plat.

Item IV, Variance request for Dean and Marie Jansen. The application requeuted
that Lot 84 Northwood Addition, be split into 2 equal halves. Dean Jansen,
owner and James Patrick Leavitt, attorney, were present to answer questions.
At- tornev Leavitt ccr=ented that the applicant owns a deep lot with an easement
road which bisects the parcel near the center of the lot. The lakeward portion
of the lot is flat and in his opinion is suitable for a second building site.
City Planner Graser concerted per mono date] 7/17/86.
Andy Pelecis, abutting neighbor to the north favored the lot split however he
would be opposed to the construction of a through road.
John Sweeney, Lot 87 owner, had no objection to the lot split.
Jerry Hoiden, owner of lot to south, had no objection to the lot split. He
would object to through traffic being allowed into the area.
The Planning Cmeissionere were concerned over setting a precedent to allow
substandard lots to be split, and the problem of inadequate access to the
lakeward portion of the property.
