Present were Commissioners Arnold, Loseth, Wells, and Planning Intern Deb Garross. Commissioner Larson and City Planner Graser were absent. MOTION BY RCBETH TO APPRME THE MINUTES AS AMENDED: PAGE 1, BEFORE THE LAST PARAGRAPH ADD: NOTION BY LARSON TO DENY THE RHDUEST FOR 6 FOOT FRONT YARD VARIANCE FOR 14173 COMMERCE AVENUE N.E. DUE TO LACK OF A D04MTRATED HARDSHIP AND THAT LIGHTING MY 11"R BATE OUTWARD INTO THE STREET AND OTHER PROPERTIES, SECONDED BY ROHNER. UPON A VOTE TAKEN, 2 AYES (LARSON Q ROSETH), 3 NAYS (LOMS, WELLS, ARNOLD) THE NOTION DID NOT PASS. SECONDED BY WELLS. UPON A VOTE TAIOFE, THE MOTION MRS DULY PASSED. Item II, variance continuation for Thomas McGregor. The application requested a 48 foot lakeshore variance for 15357 Breezy Point Road. Mr. McGregor dented that his request was for a 48 foot lakeshore variance so that he could construct a screened porch addition to his home. Planning Intern Garross commented per memo dated 5/30/86. Staff had no objection concerning the variance for the porch addition. NOTION BY ARNOLD TO APPROVE A 48 FOOT LAS VARIANCE FOR 15357 BREEZY POINT ROAD. VARIANCE WAS JUSTIFIED ON THE BASIS THAT IT IS CONSISTENT WITH DEVELOPNIM IN THE IMMEDIATE NEIGHBOIRFIOCD AND AS S 1M IT WOULD NOT BE DETRIMENTAL TO THE GENERAL HEALTH, WELFARE OR PROPERTY VALUES OF THE ODMMUNITY, SECONDED BY WELLS. The application requested a 38 foot lakeshore variance for 15365 Breezy Point Road. Mr. and Mrs. Doebel and George Kazika, Contractor, were present to answer questions. George Kazika commented that a 38 foot lakeshore variance had been granted for this property in 1980 in order to construct a 12 font deck. Due to an oversight the deck constructed was only 10 feet wide. In order for the owners to build their 12 foot porch addition, a 38 foot lakeshore variance was requested. Planning Intern Garross commented per memo dated June 12, 1986. MOTION BY ROSElH TO APPROVE A 38 FOOT LAKESHORE VARIANCE FOR 15365 BREEZY POINT ROAD SINCE IT IS CONSISTENT WITH THE CHARACTER OF THE NEIGHBORHOOD AND NOT DETRIMENTAL TO THE WELFARE, PROPERTY VALUES OR GENERAL HEALTH OF THE COMMUNITY, SECONDED BY ARNOLD. UPON A VOTE TAKEN, THE MOTION WAS DULY PASSED. At this time a 20 minute recess was called. The meeting resumed at 8:12 P.M. Item IV, Variance request for Jerry Mahoney. The application requested a 15 foot front yard variance for 14720 Glendale Avenue. Jerry Mahoney was present to answer questions. Mr. Mahoney commented that he chase to locate the garage 10 feet from Oakland Beach Avenue in order to save existing trees and so that neighboring site lines would not be obstructed. Mr. Mahoney presented a letter "Exhibit A" from neighbors Judy and John Huck who were in support of the proposed construction. The Planning Commissioners expressed concern that placement of the garage at the location recommended by staff would obstruct site lines from neighboring properties. Discussion continued regarding the size of the garage, the alternate site locations and the possible future precedent that would be set were the variance to be granted. Mr. James Fitzsimmons, neighbor to the North, stated that his site line would be impaired if the garage were moved per staff's recommendation. MOTION BY AEN<d,D TO CONi1TNUE THE REDDEST FOR A 15 FOOD FROM YARD VARIANCE FOR 14720 GLENDALE AVENUE TO A PUTURE DATE AGREEABLE TO STAFF AND THE APPLICANT. THE ITEM WAS OONITNUED DUE TO LACK OF INFORMATION RBGR DING PUTURE IMPROVERM FOR OAKLAND BEACH AVENUE AND SO THAT THE CITY PLANNER COULD BE PRESENT TO ANSWER QUESTIONS REGARDING THE STAFF RECOMWFBWOWTION. SECONDED BY WELLS. UPON A VOTE TAKEN, THE MOTION WAS DULY PASSED. Item V, Variance Request for Prior Lake Machine, Inc. The application requested an 85 foot height variance for 16801 Industrial Circle SE. Archie Pavek, owner, commented that the 2 towers with wind generators were needed in order for him to expand his business. He further stated his desire to keep the business in Prior Lake. He felt that because his business was located in an industrial area, there should not be a problem obtaining a variance for the construction of the towers. Planning Intern Garross commented per mew dated June 12, 1986 and rioted that a tower and antenna ordinance is currently in the process of being adopted by the City. Jerry Grendahl, area property owner, expressed concern about the possibility of the towers toppling into abutting properties. Greg Benson, area property owner, had no objection to the variance request. The Planning Commissioners expressed concern that the proposed distance of the towers to the property line was inadequate. MUTTON BY ROSETH TO APPROVE THE 85 FOOT HEIGHT VARIANCE FOR PRIOR LAKE MINE, INC. LOCATED AT 16801 IPLOCTSTRIAL CIRCLE S.E. PROVIDED THE TOWERS ARE LOCATED 60 FEET FROM ANY PROPERTY LINE. THE CITY ENICOUMES THE USE OF ALTERNATIVE ENERGY SOURCES SUCH AS WIND GENERATORS AND BECAUSE THE SITE IS LOCATED IN AN AREA ZONED FOR INDUSTRY, ERECTION OF THE TOWERS WOULD NOT BE DETRIMENTAL TO THE HEALTH, GENERAL WELFARE OR PROPERTY VALUES OF THE COMMUNITY, SECONDED BY AMU. UPON A VOTE TAKEN, 3 AYES (AIMM, WELLS, ROSETH), 1 ABSTENTION (LOFTVS CONCERNED OVER ANTI CLIMB DEVICES SHOULD BE ON 7HE TOM) THE NOTION CARRIED. Item VI, Variance request for Terry Hurni. The application requested a 2 foot side yard variance for 16921 Monroe Avenue. Terry Hurni was present to answer questions. Mr. Hurni, property owner, counted that the building inspector had measured his property and found that the hcae was not located where the original survey for the lot had indicated. He further commented that no alternative location existed for the proposed addition, therefore, a 2 foot side yard variance was requested. Planning Intern Garross cumennted per memo dated June 12, 1986. MOTION BY WELLS TO APPROVE A 2 FOOT SIDE YARD VARIANCE POR 16921 MONROE AVENUE. THE HAIDSHIF WAS CAUSED BY THE BUILDER AND IS NOT THE FAULT OF THE HOMEOWNER. VARIANCE WAS GRANTED BECAUSE IT WOULD NOT BE DETRIIGMX TO THE CHARACTER, HEALTH, PROPERTY VALUES CR GENERAL WELFARE OF THE COMMUNITY. SBA BY ROSETH. Present were Commissioners Roseth, wells, City Planner Graser and City Planning Intern Deb Garross. Commissioner Arnold arrived at 7:51 P.M. and Commissioner Larson arrived at 8:09 P.M. MOTION BY ROSETH TO APPROVE THE MAY 15, 1986 MINUTES AS PRESENTED, SEGO DED BY WELLS. UPON A VOTE TAM, THE MOTION WAS DULY PASSED. Item I, CC,r Properties Subdivision was called to order. City Planner Graser stated that OGT Properties requested to be put on the Agenda later this year. City Planner Graser cammented per mono dated May 15, 1986. The Planning Commissioners expressed concern that lighting not illuminate outward into the street or other properties. NOTION BY IARSON TO APPROVE A 6 FOOT FRONT YARD VARIANCE FOR 14173 COMMERCE AVENUE N.E. THE VARIANCE WAS GRANTED ON THE BASIS THAT LAIR OF A CANOPY RESULTS IN A HARDSHIP FOR THE GENERAL PUBLIC DURING INCLEMENT WEATHER, SECONDED BY ROSETH.
