Present were Commissioners Arnold, Larson, Roseth, Wells, City Planner Graser and Assistant City Planner Garross. (ARN(ID, LARSON, IDFRhIS, R0SERH, WELLS) Item I, Southdale Y.N.C.A. withdrew their request for a Conditional Use Permit. At this time City Planner Graser gave a brief update of forthcoming item the Commission will be handling. A 5 minute recess was called. The meeting resumed at 9:45 P.M. Item II, Amp and Meter Service request for a 9 foot south side yard variance for the Tao Thumb gas and convenience store located at 4995 160th Street. Dave Dichtelmiller of Pump 6 Meter Service and Lee Nokies, owner of Tom Rhumb were present to answer questions. Assistant City Planner Garross commented per memo dated 9- 15-86. NOTION BY WELLS TO APPROVE A 9 FOOT SO= SIDE YARD VARIANCE FOR THE ROM THUM GAS AND CONVENIENCE STORE LOCATED AT 4995 160TH STREET ON THE BASIS THAT IT IS CONISISTENT WITH PREVIOUS rd=STS AND WOULD NOT BE DETRINWAL TO THE GENERAL HEALTH, SAM OR WELFARE OF THE COMMUNITY, SEOONDED BY ROSEIH. BOX 359 PRIOR LAKE, MINNESOTA 55372 Item III, Paul Joachim request for a 5.8 foot north side yard variance for a garage addition for 16018 Cambridge Circle. Mr. & Mrs. Joachim were present to answer questions. Paul Joachim cammented that he is converting his tuck under garage to living space and adding an attached garage on the north side and needs the variance. City Planner Graser cammented per memo dated 9/18/86. The Planning Commissioners had concern over setting a precedent, hardship and development in the area. SOX 369 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PIANNING COMMISSION MINUTES SEPEilMR, 4, 1986 Due to a lack of Quorum at 7:30 P.M. the Planning Commission meeting was not called to order until 8:40 P.M. by Chairman Loftus. Present were Commissioners Larson, Arnold, City Planner Graser and Assistant Planner Garross. Commissioner Roseth arrived at 8:58 P.M. Absent was Commissioner Wells. Due to the hour, review of the minutes was moved to the foot of the Agenda. Item III, Conditional Use Permit Application for Pat McGinnis. The applicant was seeking a conditional use permit in order to operate a nursery school in the Minnesota Valley Community Church located at 5995 Timber Trail. Pat McGinnis commented on the operation, expected traffic volume, number of children: expected for enrollment, and session times. City Planner Graser commented per memo 9/4/86. At this time audience input was called for. Charlie Furhman, 5915 Timber Trail, was concerned about the volume of traffic that would be introduced into the neighborhood due to the nursery school. He expressed concern regarding safety of children and also increased noise due to heavy traffic from the church dined with traffic from the school. Lois Phillips, 6683 Rustic Road, commented that she lives one home away from the Rustic Road Nara:ary School which is currently operated by Pat McGinnis. -She further commented that she has never noticed a problem regarding noise from the children or traffic safety. 'Pat runs a controlled school and parents seem to be very cautious when driving to and from the school." Judy Furhman, 5915 Timber Trail, and owner of Franklin Trail Day Care cemented that a traffic problem exists because the church is located in a cul- da-sac and not a through residential street. She explained that parents late for sessions tend to rush and she was concerned about safety of children and pedestrians in the neighborhood. She further cammented that there should be another access to the church other than the cube -sac. Jim Walter, 5931 Timber Trail, felt increased traffic coupled with the problems associated with the cul- de-sac would lead to an increase in accidents in the neighborhood. BOX 359 PRIOR LAKE, MINNESOTA 55372 Gail Lind commented that she has known Pat McGinnis for 6 years and she has not witnessed traffic problems associated with the school. She further commented that Pat runs an excellent school and she is well organized and controlled. She felt that the nursery school should not be jeopardized just because question exists as to whether traffic is a problem or not. Pastor Paul Olson of the Minnesota Valley Community Church commented on several items: 1. The church has had an irregular schedule of traffic in the recent past however, the church has made arrangements which will cut dawn on the use of the facility which should in turn, lessen the amount of traffic through the neighborhood. 2. The church wishes to maintain a goad relationship with the neighborhood. 3. There are no plans to further expand the facility because the size of the church is restricted by the amount of land arced. The church is also restricted in terms of the number of people and programs which can be supported. 5. Church serviixs other than the school would bring perhaps 10-15 people in a day. Fran Eurkowski, 5918 Timber Trail, lives next to the church and was concerned about traffic because she has already witnessed people using her driveway on several occasions. She was also concerned about noise associated with the children playing outside of the church. The Planning Cammissionners discussed several issues related to noise and traffic levels, safety, possible locations for the play area, whether the area would be fenced, teacher to student ratio, and state requirements for nursery schools. MOTION BY LARSON TO RECOMMEND TO THE CITY COUNCIL THAT THE CONDITIONAL USE PERMIT FOR PAT MoGINIIS BE APPROVED. THE PERMIT WOULD ALLaR FOR THE OPERATION OF A NURSERY SCHOOL. IN THE MINNESOTA VALLEY COMMUNITY CHURCH LOCATED AT 5995 TIMBER TRAIL. THE CONDITIONAL USE PERMIT IS CONTINGENT UPON THE PULLMING: 1. ALL NSCESSARY STATE PERMITS MOST BE AOQUIRED. 2. THAT THE STUDENT POPULM70H BE LIMITED TO 20 STUDENTS PER SESSION. 3. THE HOURS OF OPERATION: MONDAY TH1mUCP3 THURSOAY - 9:00 AM TO 11:15 PM, AND TUESDAY AND THURSDAY: 12:30 PM TO 2:45 PM, SEPTEMBER THROUGH MAY. IN THE EVENT THE SCHOOL. FINDS IT NECESSARY TO CHANGE THE HAIRS OF OPERATION OR THE NORM CH STUDENTS, THE CONDITIONAL USE PERMIT SHALL BE REVIEWED BY THE PLANNING COMlIISSION FOR ANI DNW. SECONDED BY AMNQA. UPON A VOTE TAKEN, THE MOTION WAS DULY PASSED. (IARSON, LOFTUS, ARM, ROSE3TH) At this time a 2 minute recess was called. The meeting resumed at 9:22 P.M. Item II, Variance Application for Prior Lake Machine, Inc. The application requested a 7 foot north side yard variance for 16801 Industrial Circle S.E. Archie Pavek was present to answer questions. Mr. Pavek, 16430 Park Avenue, President of Prior Lake Machine commented on his resuest for a 7 foot variance. Be explained that the variance was required in order for the dock to be in alignment with the proposed addition. The alignment was necessary in order to facilitate delivery service to the machine shed. Assistant City Planner Garross dented per memo dated 9/2/86. The Planning Commissioners discussed the variance application and survey which had been sutmitted with the application. The Commissioners noted that there was a discrepancy in the survey regarding the north directional arrow.
