BOX 359 PRIOR LAKE, MINNESOTA 55372 PLANNING COMMISSION MINUTES DECEMBER 19, 1985 The December 19, 1985 Prior Lake Planning Commission meeting was called to order by Chairman Larson at 7:30 P.M. Present were Commissioners Loftus, Felix, Arnold, Roseth anO City Planner Graser. Notion by Loftus to approve the minutes of the December 5, 1985 meeting as presented, seconded by Arnold. Upon a vote taken, the motion was duly passed. Item I, Comprehensive Plan Amendment for Urban Service Areas. City Planner Graser commented per memo drafted for the Planning Commission. Roy Clay, local realtor, commented that this would be a concern for all realtors due to market values and changing direction of growth. The Planning Commissioners had concern regarding the change in direction of growth and any possible legal ramification due to that change. Also staff should make more of a concerted effort to notify the public with letters to realtors and other groups having a special interest in the amendment. The Commissions would like to hear from a representative of the Met Council regarding their projections and haw they apply to Prior Lake. The Jeffers pond area generated concern regarding ultimate development. The Commission would like to look at a development proposal with proposed land use for the Jeffers parcel. Motion by Roseth to continue this item until the foot of the meeting, seconded by Arnold. Upon a vote taken, 3 aye, 1 nay (Felix) the motion carried. At this time a recess was called. The meeting resarned at 9:08 P.M. Item II, Steve Schneider and Roy Clay request for a Non- conforming Use Alteration. Mr. Schneider and Mr. Clay were present to answer questions. Ray Clay, Realtor, stated that this is a 1.2 acre parcel abutting a cemetery and a Senior Citizen High Rise with an existing legal non - conforming use. (612) 447 -4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Steve Schneider. Lindsay Softwater, stated that he :,could like to purchase this property for his business which has outgrown its present location. Also 'ie would like to keep the business in Prior Lake. This is not a high volume traffic business. City Planner Graser commented per memo dated 12/19/85. At this time chairman Larson read a letter from the Scott County H.R.A. who feels a commitment was given by Prior Lake for residential use. City Planner Graser stated that as far as he is aware there is no written commitment from the City. The Planning Comr: ssion commented on the request with concern for this non - existent commitment, more detailed plans, outside refuse cleaned up, storage of equipment. and status of land. Motion by Arnold to approve the Non- Conforming Use Alteration provided that: 1. A detailed site and landscaping plan submitted and approved by staff. 2. Removal of current materials outside on the site be removed on or before June 1, 1986 and landscape plan be implemented before June 1, 1986. 3. There be no outside storaqe of equipment and supplies sold by company. seconded by Roseth. Upon a vote taken, 3 aye, 1 abstention (Loftus, who felt there was not complete information) the motion carried. At this time a 5 minutes recess was called. The meeting resumed at 10:35 P.M. Item I, Comprehensive Plan Amendment was recalled. After much discussion some of the Commissioners felt a continuation was needed. Motion by Felix to continue the Comprehensive Plan Amendment until 7:35 P.M., January 16, 1986, seconded by Loftus. Upon a vote taken, 2 aye (Felix, Loftus) 2 nay (Arnold, Roseth) Chairman Larson aye, the motion carried. The following are suggestions for staff to carry out before the Comprehensive Plan Amendment is brought back to the Commissioners in four weeks: 1. A member or letter from the Metropolitan Council confirming the actions of the proposal. 2. A sample of the proposed plan of the site. 3. A notification of meeting be mailed to the businesses in town. 4. Publicize this issue so that interested citizens and commercial interests can appear to give testimony. 5. A document saying that such change will not have an adverse effect. Motion by Roseth to adjourn the December 19. 1985 Prior Lake Planning Commission meeting, seconded by Loftus. Upon a vote taken, the motion was duly passed. The meeting was adjourned at 11:10 P.M. Density increases are recommended as follows: a) The use of open space - maximum 10% recommended 3%: The only common open space is in front of the dock and not much of it. b) The design, location, setting of dwelling units. maximum 10% Recommended 4 %: The unit feature colonial architecture and will provide and interesting living environment. However there are to many units and excessive variances. The plantings feature must be enlarged and adequate turnaround space provided. c) Location adjacent to collector Street maximum 5% Recommended 5 %: this is an automatic bonus credit since county road 21 is a collector. d) Physical Characteristics of the site maximum 5% Recommended 58: The unusual site dimensions together with the lake and County Road 21 make this a difficult site to develop. BOX 359 PRIOR LAKE, MINNESOTA 55372 WIVA PWI ING COMMISSION 14INLITES DECEMBER 5, 1985 The December 5, 1985 Prior Lake Planning Commission meeting was called to order by Chairman :arson at 7 :30 P.M. Present were Commissioners Loftus, Felix, Roseth (arrived at 8:10), Arnold (arrived at 8:15), and City Planner Graser. Motion by Loftus to approve the minutes of the November 21, 1985 meeting as presented, seconded by Felix. Upon a vote taken, the motion was duly passed. Item I, T.F. James Company, Conditional Use Permit request for Auto Repair Minor in B-1 District at County Road 42 and Highway 13, Lot 3 Block 2 James 1st Addition on .64 acres. Tan LaDerski, Mike Mikunda, and Rob Kapphahn were present to answer questions. Tam LaDerski commented on the request and presented an elevation drawing of the building. City Planner Graser commented per memo dated 12/5/85. The Planning Commissioners had concerns over lighting, windows, landscaping, and storage. Motion by Loftus to approve the Conditional Use Permit for Automobile Repair Minor in the B-1 District at intersection of County Road 42 and Highway 13, Lot 3 Block 2 James 1st Addition provided that: 1. The planting Flan for the site is approved by City Staff. 2. The design of the building roof is revised to consist of gable and pitched roof combination. 3. Two additional windows are added on each west and south sides of the building and such revised plan approved by City Staff. 4. Staff shall review and approve a lighting plan for this facility with future possibility of an eventual overall lighting plan for James 1st Addition. seconded by Arnold. Upon a vote taken, 3 ayes, 1 nay (Felix) the motion carried. Motion by Roseth to incorporate in motion: 5. There be no storage of tires, parts, supplies or tow vehicles outside of the building or service area. seconded by Arnold. Upon a vote taken, the motion was duly passed. BOX 359 PRIOR LAKE, MINNESOTA 55372 Item II, request by Dan Reiland for a 23.5 foot lakeshore and a 12.4 foot front yard variance for 2963 Terrace Circle S.W. Dan Reiland was present to answer questions. Mr. Reiland commented on the request for a variance in a small buildable lot. City Planner Commented per memo 12/5/85. Motion by Roseth to approve a 23.5 foot lakeshore and a 12.4 foot front yard variance for 2963 Terrace Circle S.W., since conditions and circumstances of this proposal are virtually identical to an approved application earlier this year, seconded by Arnold. Upon a vote taken, the motion was duly passed. Motion by Arnold to adjourn the December 5, 1985 Prior Lake Planning Cammissio► meeting, seconded by Loftus. Upon a vote taken, the motion was duly passed. The meeting adjourned at 9:00 P.M.
