BOX 359 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PLANNING COMMISSION MINUTES OCTOBER 17, 1985 On October 17, 1985 the Prior Lake Planning Commissioners took a guided tour of Prior Lake's past, present and future development areas. Present for the tour were Commissioners Larson, Loftus, Arnold, Roseth and City Planner Graser. The tour started from City Hall at 6:45 and ended at 7:45 P.M. The October 17, 1985 Planning Commission meeting in the Council Chambers was called to order at 8:00 P.M. by Chairman Larson. Present for the meeting were Commissioners Arnold, Felix, Larson, Loftus, Roseth, City Planner Graser and City Planning Intern Lee Meilleur. Motion by Loftus to approve the October 3, 1985 minutes as amended: paragraph 4, line 3 change "quite" to "quit "; paragraph 10, line 1 add non before the word owner; 2nd to last paragraph, line 2 change "6:00" to "6:30 ", seconded by Roseth. Upon a vote taken the motion was duly passed. At this time Dave Unmacht, Assistant City Manager, relayed to the Planning Commission from the Prior Lake Economic Development Cammittee that a workshop is requested between the two groups regarding the Downtown Development District Study done by Wilson Management. The Planning Commission was in favor of a workshop and a time and place should be set up. Item I, Nystrom First Addition, Preliminary Plat approval request was called to order. John Nystrom was present to answer questions. John Nystrom commented that this is a Preliminary Plat of 2.5 acres they would like to subdivide into 5 lots for single family dwellings. City Planning Intern Lee Meilleur commented per mama dated 10/17/85. Also commenting on the mama from Parks 8 Recreation dated 10/11/85. It was stated that the drainage plan was received 10/16/85 and addressed. Audience input was taken at this time. John Titus area property owner had a concern on set back and any restrictions. The Planning Commissioners had concern over park access, drainage, ponding, erosion and landscaping. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Notion by Arnold to approve Preliminary Plat for Nystrom First Addition contingent upon submission of dedication of a 10 foot park access, adjacent to the east property line the lot lines be appropriately adjusted to accommodate this dedication, the plan document the drainage easement, the services for Lot 4 be at the expense of the developer, and park dedication fee be $1,282.00 and such plan be acceptable to City Staff, seconded by Loftus. Upon a vote taken the motion was duly passed. Notion by Roseth to adjourn the Nystrom First Addition Preliminary Plat Public Hearing, seconded by Arnold. Upon a vote taken, the motion was duly passed. Item II, Gene Newstron request for a 9 foot variance for Lots 7 & 8, Block 1, Chatonka. Beach. Mr. Newstron was present to answer questions. Mr. Newstron commented that the variance is needed due to the unique topography of the lot for solar access, site line and design. City Planner Graser commented per memo dated 10/17/85. Zhe Planning Commissioners had concern over the existing buildings, setting a precedent, size of lot for building envelope, and a hardship. Motion by Larson to grant a 9 foot variance for Lots 7 & 8, Block 1 Chatonka Beach since it is not detrimental to the health and general welfare of the neighborhood and since it is for a deck and not for living quarters, seconded by Poseth. Upon a vote taken, 3 aye, 2 nays (Felix & Larson) the motion carried. At this time the Planning Commissioners thanked City Planner Graser for the tour. Motion by Arnold to adjourn the October 17, 1985 Prior Lake Planning Commission meeting, seconded by Loftus. Upon a vote taken, the motion was duly passed. She meeting adjourned at 9:00 P.M. BOX 359 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PLANNING COMMISSION MINUTES OCTOBER 3, 1985 The October 3, 1985 Prior Lake Planning Commission meeting was called to order by Chairman Larson at 7:30 P.M. Present were Commissioners Loftus, Felix, Roseth, Arnold, City Planner Graser and City Planning Intern Lee Meilleur. Motion by Loftus to approve the minutes of the September 19, 1985 meeting as presented, seconded by Roseth. Upon a vote taken, the motion was duly passed. Item I, Hubert Goracke request for a Conditional Use Permit to convert a single family dwelling into a duplex at 16399 Itasca Avenue. Mr. & Mrs. Goracke were present to answer questions. Mrs. Eileen Goracke commented that they tried to sell their house 2 or 3 years now and they need the additional income for taxes and such since her husband had to quite work due to health. City Planning Intern Lee Meilleur commented per memo dated October 3, 1985. Also Mr. Meilleur stated that he received a phone call from Mary Kiesmer- Tuttle, 16400 Fillmore Avenue, who said she was totally against the Conditional Use Permit request. At this time audience input was received. John Mueller, 16323 Itasca Avenue, was concerned over devaluation of hones and property if this is allowed. Fred Lindquist, 16408 Itasca Avenue, was concerned over devaluation of homes. Dave Bennett, 5495 Brooks Circle, was concerned over devaluation of property and perking. The Planning Commissioners had concern over density, parking, zoning, owner occupied and affects on neighborhood. Notion by Roseth to deny the Conditional Use Permit for the conversion of a single family hone to a duplex at 16399 Itasca Avenue for Hubert Goracke beca >1Ne it is not within the spirit and intent of the code, it is a non conforming use and an isolated case, detrimental to area property values, threatens the homogeneity of an R-1 District. Permitting this would set a dangerous precedent with far reaching ramifications in an R-1 zoned area, seconded by Loftus. Upon a vote taken, the motion was duly passed. (612) 447 -4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Item II, Landice Wilson request for a 7 foot side yard variance for 16252 Lakeside Avenue SE. Ms. Wilson was present to answer questions. Ms. Wilson commented that the old deck was removed and a new one would be somewhat larger and extend across the front of the house improving the appearance. `Ihe affected neighbor has no objection to the improvement. City Planning Intern Meilleur commented per memo dated October 3, 1985. The Planning Commissioners commented on the variance amount that was requested and perhaps would be setting a precedent. Motion by Felix to approve a seven foot sideyard variance for 16252 Lakeside Avenue S.F., since it is not detrimental to the health, general welfare and property values of the surrounding area, and because of the age of the hone this type of construction would be the only solution to the walkway situation and drainage Problem of this unique lot, seconded by Arnold. Upon a vote taken, the motion was duly passed. Item III, Ordinance Invalidation for Title 5. Section 5-6 -8, and Prior Lake Zoning Ordinance 83-6, section 7.8. Notion by Roseth to reomnend to the City Council to adopt Title 5, Section 5-6 -8 of the Prior Lake City Code, but delete on the end "or to preserve the spirit and intent of this Title." and a period after variance and in the City of Prior Lake Zoning Ordinance 83 -6, Section 7.8 and delete on the end "or to preserve the spirit and intent of this ordinance" and a period after variance, seconded by Arnold. Upon a vote taken, the motion was duly passed. On October 17, 1985 there will be a tour of Prior Lake Planned Developments fran 6:00 -7:45 P.M. by the Planning Commissioners. Motion by Roseth to adjourn the October 3, 1985 Planning Comnission meeting, seconded by Arnold. Upon a vote taken, the motion was duly passed. The meeting adjourned at 9:00 P.M.
