August 16, 1984
The August 16, 1984 meeting of the Prior Lake Planning Commission was
called to order by Chairman Arnold at 7:35 P.M. Present were Commis-
sioners Larson, Loftus, Felix and City Planner Graser. Absent was
Commissioner Roseth.
The minutes of the previous meeting were reviewed. Motion by Loftus
to approve the minutes as presented, seconded t Felix. Upon a vote
taken, the motion was duly passed.
Item I, variance continuation for 17164 Sunset Trail S.W.. Mr. Craig
Woodson was present.
Mr. Woodson stated that the request is modified to a 5 foot side yard
variance request and presented "Exhibit A for the record and pictures
showing the surrounding area.
City Planner Graser had no comments at this time.
The Planning Commissioners felt there was no hardship incurred.
Motion by Felix to deny the 5 foot side yard variance for 17164 Sunset
Trail S.W. since no hardship can be found and the property is not unique
with respect to similar lots in the area, seconded by Larson. Upon a
vote taken, 3 aye, 1 nay, the motion carried.
Item II, request for 12 foot side yard variance for 16661 Highway 13.
Mr. Dave Velishek was present to answer questions.
Mr. Velishek commented on the request stating that a hardship appears
from the future road and he is trying to build an asethically pleasing
building.
City Planner Graser commented per memo dated August 16, 1984.
The Planning Commissioners had comments on size, height, roof line, drive-
way, open space and landscaping.

Motion by Larson to approve a 12 foot side yard variance for 16661
W ghway 13 since the existing structure has an 8 foo setback and
the proposal is consistent with a future service street, seconded
by Felix. Upon a vote taken, the motion was duly passed.
At this time a 10 minute recess was called.
The meeting resumed at 8:30 P.M.
Item III, request for a 5 foot side yard variance, a 57 foot Lake-
shore variance and an 18 foot front yard variance for 14480 Shady
Beach Trail. Mr. Donald Price was present to answer questions.
Mr. Price commented that he will be raising the hoase to a 909
elevation and remodeling the cabin to make an asethically pleasing
structure in the neighborhood. This is a triangular shaped lot
and very difficult to work with.
Mr. C. E. Mickley, 14476 Shady Beach Trail M.E., stated that Mr.
Price assured him that water run -off and drainage will be a&equate-
ly taken care of.
City Planner Graser commented per memo dated August 16, 1984.
The Planning Commissioners had concerns over drainage, access, roof
line, elevations and screened part of the porch.
Motion by Arnold to approve a 5 foot west side yard variance for
garage and screened porch, a 60 foot lakeshore variance, and an 18
foot front yard variance since It Is consistent with the character
of the area and not detrimental to the property values in the neigh-
borhood and the publics general health and welfare, seconded by Felix.
Upon a vote taken, the motion was duly passed.
Item IV, continuation of Animal Ordinance. Marty Schmitz stated that
there has been a great deal of research done and the submitted memo
is the result.
City Planner Graser commented that he is in contact with ti.e City
Attorney and they will work out the fine points.
Motion by Loftus to approve to recommend to the City Council to amend
the Zoning Ordinance Section 4 by adding paragraph Q, and add the
definition "livestock" to the Zoning Code and also amend the Civil
Code 10 -1 -1 with the question regarding the use of the term "no person"
being deleted, seconded by Larson. Upon a vote taken, the motion passed.'
Motion by Felix to adjourn the Planning Commission meeting of August 16,
1984, seconded by Loftus. Upon a vote taken, the motion was duly passed
and the meeting adjourned at 9:30 P.M.

August 2, 1984
The August 2, 1984 meeting of the Prior Lake Planning Commission was
called to order by Chairman Arnold at 7:35 P.M. Present were
Commissioners Roseth, Larson, Loftus, Felix and City Planner Graser.
The minutes of the previous meeting were reviewed. Motion by Roseth
to approve the minutes as presented, seconded by Loftus. Upon a
vote taken, the motion was duly passed.
Item I, request for a 32.2 foot lakeshore variance for Lot 24 and P/O
Lot 23 Boudin's Manor. Mr. Kenneth Goewey, contractor, and property
owners Mr. & Mrs. Rolland Gronholz were present to answer questions.
Mr. Goewey commented that he was unware of a needed variance until
applying for a building permit. He is positioning the structure with-
in the site line of the abutting homes which is within the intent of
the ordinance.
City Planner Graser commented per Memo dated August 2, 1984.
The Planning Commissioners felt this is within the Ordinance.
Motion by Roseth to approve a 32.2 foot lakeshore variance for Lot 24
and P/O Lot 23 Boudin's Manor since this is consistent with the develop-
ment of the neighborhood and not contrary to the public interest, second-
ed by Loftus. Upon a vote taken, the motion was duly passed.
At this time a 10 minute recess was called,

Item II, request by John Cates for a 20 foot rear yard variance to con-
struct a 20 X 26 foot detached garage at 16390 Albany Avenue S.E.
Mr. Cates was present to answer questions.
Mr. Cates commented that a variance is needed for a garage due to drainage,
topography, and a protruding patio fence. Also Mr. Cates presented 3 letters
from area neighbors not objecting to the variance.

hairman Arnold entered the 3 letters as Exhibits 1 -3 for the record
City Planner Graser commented per Memo dated August 2, 1984. Also
Mr. Graser stated that Cy Schweich abutting property owner to the site
called to say he had no objection to this variance.
The Planning Commissioners had concern over type of hardship, topography,
drainage and setting a precedent.
Motion by Riseth to deny the variance as requested but approve a 7 foot
rear yard variance for James Cates at 16390 Albany due to drainage,
terrain, and limited design alternatives, seconded by Larson. Upon a
vote taken, the motion was duly passed.
Item ITT, request for a 8 foot side yard variance for 17164 Sunset Trail
S. W. by Craig Woodson. Mr. Woodson was present to answer questions.
Mr. Woodson commented on the request for the variance.
City Planner Graser commented per Memo dated August 2, 1984.
The Planning Commissioners felt there is no real hardship and would be
setting a precedent to grant such a variance.
Motion by Larson to continue the variance request to August 16, 1984 at
7:35 P.M., seconded by Felix. Upon a vote taken, the motion was duly
passed.
Item IV, request for a Home Occupation Permit_ by Craig Woodson for a
suntanning and hot tub salon at 17164 Sunset Trail S.W.. Mr. Woodson
was present to answer questions.
Mr. Woodson stated that he is planning to install the hot tub and sun-
tanning booth for personal use irregardless of the outcome of this
hearing.
city Planner Graser commented per Memo dated August 2, 1984.
Mayor Johnson asked the applicant if this type of operation is regulated
by the State and are there any guidelines to control conditions.
Mr. Woodson stated there was none only an inspection on a yearly basis
by his insurance company.
The Planning Commissioners had concerns over a business in a residential
zoned area, parking, traffic, sanitary control, liability and equipment.
Motion by Larson to deny the request for Home Occupation Permit by Craig
Woodson for a sur,tanning ani. hot tub salon at 17164 Sunset Trail S.W.
due to the fact this is a Commercial service and should be restricted
to a Commercial Area and not conducive to a residential zoned area,
seconded by Felix. Upon a vote taken, 3 aye, 1 nay, the motion carried.
Motion; by Loftus to adjourn the August 2, 1984 Planning Commission meeting,
seconded by Felix. Upon a vote taken, the motion was duly passed. The
meeting adjourned at 10:30 P.M.
