BURGER KING 8:30 P.M. SCHWEICH CONST SUBDIVISION- PUBLIC HEARING CONDITIONAL USE SUBDIVISION - PUBLIC HEARING (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 CITY OF PRIOR LAKE PLANNING COMMISSION - MINUTES - February 16, 1984 The February 16, 1984 meeting of the Prior Lake Planning Commission was called to order by Chairman Arnold at 7:45 P.M. Present were Commissioners Roseth, Felix, Larson, Loftus and City Planner Graser. The minutes of the previous meeting were reviewed. Motion by Roseth to approve the minutes as presented, seconded by Larson. Upon a vote taken, the motion was duly passed. Item I, Subdivision Ilearing for Burger King was called to order. Bill Ranek Representative was present to answer questions. Bill Ranek commented on the 2 acre proposal subdivision site in regards to two buildable lots as opposed to one, drainage, planting, ingress and egress, deliveries, and easement. City Planner Graser commented per memorandum dated February 13, 1984. Also adding that the acreage be dropped to .86 for the site and only tentative approval be given but table the Subdivision for now so the applicant can petition for vacation of right of way. At this time audience input was called for. Steve Delton, 16071 St. Paul Ave. S.E., had concerns over traffice on St. Paul Avenue. The Planning Commissioners had concerns over the down size of the property, road vacation, and utility easement. Motion by Larson to approve the Burger King Subdivision contingent upon the following stipulations: 1. 7 feet of additional right of way for County Road 44. 2. Park dedication fee which is to be determined by the Park Director. 3. The vacation of road easement adjacent to the west property line. 4. Dedication of the utility easement. 5. That the Platt is expanded to the centerline of County Road 44. 6. That there be a variance granted in regards to Parcel A to reduce it to .86 acres. seconded by Felix. Upon a vote taken, the motion was duly passed. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 Motion by Roseth m close the Burger King Subdivision Public Hearing, seconded by Felix. Upon a vote taken, the motion was duly passed. Item 1.I, Conditional Use request by Burger King. Bill Ranek representative was present to answer questions. Mr. Ranek commented on the egress and ingress, parking stalls, drainage, planting, deliveries, and lighting. City Planner Graser commnented per memorandum dated February 13, 1984. Also reviewing the Staff Memo on Planting and Engineering. Audience input was taken at this time. Jim Vallez owner of the Laker Center commented on the ingress and egress in conjunction with his Center. The Planning Commissioners had concerns regarding traffic, deliveries and semi turn - around, drainage, and burming. Motion by Roseth to approve the Conditional Use request by Burger King for Parcel A based on the following contingencies: A. Engineering 1. Turf establishment must follow closely behind excavation. 2. The sanitary sewer manhole cover an water gate valve box in the westerly exist must be adjusted to Y' below the top of the bituminous driveway or finished grade. 3. Where the proposed grades will reduce the cover over the water - main, it must be exposed to determine if lowering or in- sulating will be necessary. B. Planting /landscaping' 1. Addition Norway and Skyline Locust no less than 2 1 :i to 3" caliper balled and burlaped trees as per exhibit. 2. Spacing approximately 25 to 30 feet as outlined by the City Consultant Planner in the map shown. 3. Breaking up the static row of amur maples along the easterly line of the property with additional Mugho Pine and perhaps some shade trees for the parking lot. 4. Possibly additional shrubbery pockets eloLe to Co. Rd.44 5. Japanese Yews on the south side of the restaurant would be replaced with something that can withstand Winter sun. C. Vacation of the roadway to the west property be approved. D. All County and State permits be received and copies be sent to the City Planners Office. E. That the proposed Subdivision be approved by the City Council. F. The 7 soil erosion plans and specifications from Exhibit C -4, because; The use does not result in any conditions which may be dangerous, injurious or noxious to other property in the area and it does produce a visual impression consistant with the area. seconded by Larson. Upon a vote taken, the motion was duly passed. Item III, the Public Hearing for 4th Addition to Lakeside Estates for Schweich Construction was called *o order. Ted and Greg Schweich were present to answer questions. Ted Schweich commented on the parcel with regard to leveling of the parcel and compliance wits: staff. City Planner Graser commented per memorandum dated February 10, 1984. At this time comments from the audience were given. Sterling Robson abutting property owner had concern over the sloping of the property with regard to runoff. Ted Schweich stated they plan on sloping the site inwards. Robert Preussler, 16305 Park Ave., would like to see the development. The Planning Commissioners had no concerns with the proposal. Motion by Larson to approve the Preliminary Plat for 4th Addition to Lakeside Estates contingent upon: 1. The Park Dedication fee of $403. 2. The northwest corner of Lot 1 be regraded to improve sight distances for intersection of Park and Pleasant Avenues as per Engineering specifications requirements seconded by Loftus. Upon a vote taken, the motion was duly passed. Motion by Roseth to adjourn the Public Hearing for the 4th Addition to Lakeside Estates, seconded by Felix. Upon a vote taken, the motion was duly passed. At this time discussion followed regarding a letter sent by Michael McGuire that the 4th Monday night Council meetings will be workshop and the Planning Commission is asked for topic input. Suggested items were: 1. Impact of near lake development and its effect on the lake. 2. Orderly Annexation. 3. Industrial development east of the town along Credit River Rd. Motion by Roseth to adjourn the Feburary 16, 1984 meeting of the Planning Commission, seconded by Loftus. Upon a vote taken, the motion was duly passed. BOX 369 PRIOR LAKE, MINNESOTA 55372 WHI M19 ; i • PLANNING COMMISSION - MINUTES - February 2, 1984 The February 2, 1984 meeting of the Prior Lake Planning Commission was called to order by Chairman Arnold at 7:35 P.M. Present were Commissioners Roseth, Felix, Larson, Loftus and City Planner Graser. The minutes of the previous meeting were reviewed. Motion by Loftus to approve the minutes as presented, seconded by Larson. Upon a vote taken, the motion was duly passed. Item I, variance request for Bill Henning was tabled at this time since no one was present. Item II, Staff's discussion regarding house moving Section 7.7 of the Zoning Ordinance. City Planner Graser commented that there have been problems with houses moved into the City and the Zoning Ordinance needs to be revised and a Public Hearing set. Also the moving contractors and real estate companys will be invited to the Public Hearing. Motion by Felix to schedule a Public Hearing regarding Section 7.7 of the City 'Zoning Ordinance for March 1, 1984 at 7:35 P.M., seconded by Loftus. Upon a vote taken, the motion was duly passed. At this time Item I, variance request for Bill Henning was called back. Mr. Henning was present to answer questions. Mr. Henning commented that the request is for 1'6" variance along the property line which runs diagnal and 11' variance along the north line which runs east and west. The hardship is the plans which are now so far along that it would be costly to change. City Planner Graser commented per memorandum dated February 2, 1984. The Planning Commissioner's had a concern over positioning the house and asked the contractor if the house could be moved 1' to the south to reduce the variance. Bill Henning stated that it would be no problem to move the house. Motion by Roseth to appr.,ve a 6" side yard variance for the North side property line for portion of Lot 4 and all of Lot 5, Conroy's Bay Add. since it is consistant with the neighborhood and not detrimental to the general health and welfare of the community, seconded by Loftus. City Planner Fraser commented that there would be an in- depth. Ludy done regarding the Grendahl Industrial Park and the ea:- area of Prior Lake along County Road 12 or also known as Cn dit River Road. Motion by Felix to adjourn the February 2, 1984 Planning Commission meeting, seconded by Roseth. Upon a vote taken, the motion was duly passed. The meeting adjourned at 8:35 P.M.
